Specific Regions and Sectors<br />
These Options would have larger impacts in countries where the current legal<br />
requirements may be interpreted as requiring on-site inspections, while in countries<br />
where no such requirement appears to be in force (e.g. in France) the impacts would<br />
be comparatively smaller.<br />
Public Health and Safety<br />
The Belgian competent authority identified potential benefits but as no specific<br />
problems have been identified, it is not expected that these benefits would be<br />
significant.<br />
Conclusion<br />
The consultation conducted for this study has confirmed problems with lack of clarity<br />
as regards existing requirements. However, it has been suggested that notified bodies<br />
which account for 90% of the notification market already use assessment modules,<br />
suggesting that the impacts of Options D2 and D3 would likely be limited. Inspections<br />
may be required by legislation as subsystems are already assessed by means of<br />
conformity assessment modules some of which do not require on-site inspections.<br />
Therefore, the main impact of the proposed Options would arise in relation to<br />
eliminating disparities in legal interpretation and the lack of legal clarity. In this<br />
respect, however, Option D2 is not seen as effective in reducing legal uncertainty and<br />
Option D3 is seen as preferable.<br />
