E. DISCRIMINATION FORBIDDEN<br />

Employees and applicants for employment shall not be subjected to discrimination as to<br />

race, creed, color, national origin, sex, age, disability, marital status, sexual orientation or<br />

citizenship status in all employment decisions, including but not limited to recruitment, hiring,<br />

compensation, training and apprenticeship, promotion, upgrading, demotion, downgrading,<br />

transfer, lay-<strong>of</strong>f and termination, and all other terms and conditions <strong>of</strong> employment, except<br />

where bona fide occupational qualifications may, as recognized by the law <strong>of</strong> the jurisdiction, be<br />

shown to exist. The Employer shall not unlawfully discriminate against any <strong>Artists</strong> because <strong>of</strong><br />

his/her activities on behalf <strong>of</strong> AGMA.<br />

F. DRUG FREE WORKPLACE<br />

<strong>Artists</strong> understand and agree that Employer prohibits from the workplace the unlawful<br />

manufacture, distribution, dispensation, possession or use <strong>of</strong> a controlled substance. Conviction<br />

for a violation <strong>of</strong> this policy will be grounds for immediate termination <strong>of</strong> employment and shall<br />

be considered a material breach <strong>of</strong> the Standard Artist’s <strong>Contract</strong>.<br />

5. DEFINITIONS<br />

Whenever used in this Agreement, unless otherwise provided:<br />

A. Artist - All Dancers, Narrators, Singers, Choreographers, Stage Managers,<br />

Assistant Stage Managers, Production Assistants, Stage Directors and Assistant Stage Directors<br />

employed by the Employer.<br />

B. Ailey Dancer - Artist may not be billed as an Ailey Dancer without<br />

permission <strong>of</strong> the Company. Artist must provide advance written notice to the Employer if<br />

he/she plans to accept any dance-related work outside the Company. Such notice shall be to the<br />

Artistic Director, Senior Director <strong>of</strong> Performance and Production and Stage Manager.<br />

C. The City <strong>of</strong> Origination - The term “City <strong>of</strong> Origination” shall mean the<br />

city <strong>of</strong> New York, New York. An engagement will be considered outside the City <strong>of</strong> Origination<br />

if such engagement takes place more than a radius <strong>of</strong> seventy-five (75) miles from the<br />

company’s point <strong>of</strong> in-city departure.<br />

D. Cover - The term “Cover” for the purposes <strong>of</strong> this Agreement shall be<br />

defined as any Artist who is required to remain on call and be present during the performance for<br />

which he or she has been assigned to cover. The requirement to call in prior to the performance<br />

shall not be considered a Cover if that Artist is not required to remain on call during the<br />

performance.<br />

E. Curtain Time - Curtain Time shall be defined as seven (7) minutes past<br />

advertised Curtain Time or the beginning <strong>of</strong> the music <strong>of</strong> the first (1st) dance piece whichever<br />

occurs first.<br />
