B. COMPLIMENTARY TICKETS<br />

Employer will supply each Artist with ten (10) complimentary tickets, in addition to one<br />

(1) complimentary ticket for opening night, for New York City Center season. On tour,<br />

Employer will make best efforts to supply each Artist with one (1) pair <strong>of</strong> complimentary tickets<br />

for each local series <strong>of</strong> performances when tickets are available.<br />

C. BENEFIT PERFORMANCE<br />

The Employer and <strong>Artists</strong> will establish a jointly administered “Ailey Dancers’ Resource<br />

Fund.” Ten (10%) percent <strong>of</strong> the net proceeds for one public performance, selected by the<br />

Company, during each New York season shall be contributed to said Fund for the benefit <strong>of</strong><br />

<strong>Artists</strong>. The Dancer’s Fund Night will include at least one new repertory piece. It is understood<br />

and agreed that AGMA assumes no responsibility or liability for said Fund.<br />

D. INDEMNIFICATION<br />

The Employer retains the exclusive responsibility to provide a safe and healthful<br />

workplace, and is exclusively liable under its Workers’ Compensation Insurance Policy and<br />

indemnifies and holds AGMA harmless in the event <strong>of</strong> job-related injuries, illnesses or deaths,<br />

which come there under.<br />

E. WORK POLICY<br />

Students shall not be cast in leading dancing roles. The Employer will advise all guest<br />

choreographers <strong>of</strong> this provision.<br />

F. PHYSICAL THERAPIST<br />

Employer will provide and pay for at least one experienced Physical Therapist during<br />

New York City Season and while on tour. The Physical Therapist will be contracted to work on<br />

<strong>Artists</strong> and Stage Managers at least five (5) hours a day. In case <strong>of</strong> two (2) performance days,<br />

the Physical Therapist is contracted to work at least two (2) hours before matinees, and three (3)<br />

hours before evening performances. In case <strong>of</strong> performance days that consist <strong>of</strong> miniperformances,<br />

the Physical Therapist will still be expected to fulfill a five (5) hour day in a room<br />

provided backstage. If AGMA delegates, after consulting with a majority <strong>of</strong> the Dancers, advise<br />

that they want a Physical Therapist replaced, it will not be unreasonably denied by the Employer.<br />

Physical Therapist will schedule 30 minute, 20 minute, and 15 appointments within each<br />

5 hours day.<br />

G. FORCE MAJEURE<br />

This Agreement and every contract entered into between the Employer and any Artist<br />

shall be deemed to contain the following provisions:<br />
