While <strong>Artists</strong> are under contract, all publicity is controlled by the Employer. <strong>Artists</strong> shall<br />

cooperate by providing publicity information to the Employer. <strong>Artists</strong> shall not communicate<br />

with the media about work related subject matter without coordinating with the Employer.<br />

In the event an identifiable likeness <strong>of</strong> a single Artist is used on a product <strong>of</strong>fered for sale<br />

by the Employer or its agent, the Artist will receive 15% percent <strong>of</strong> the Employer’s revenue for<br />

that product. In the event an identifiable likeness <strong>of</strong> up to four <strong>Artists</strong> is used on a product<br />

<strong>of</strong>fered for sale by Employer or its agent, the <strong>Artists</strong> shall share 15% <strong>of</strong> the Employer’s revenue<br />

for that product. For an identifiable likeness <strong>of</strong> up to four <strong>Artists</strong>, <strong>Artists</strong> will be credited on the<br />

product if there is space and <strong>Artists</strong> will each receive one <strong>of</strong> that product, free <strong>of</strong> charge,<br />

regardless <strong>of</strong> price.<br />

B. PHOTOGRAPHY<br />

1. No photo calls shall be permitted on a two (2) performance day, unless the<br />

Artist is compensated at the Penalty Rate with a one (1) hour minimum call guaranteed.<br />

2. On a rehearsal or performance day the Employer agrees that if it shall<br />

require any Artist to pose for photographs <strong>of</strong> regular dance pieces for the purpose <strong>of</strong> publicizing<br />

and advertising performances <strong>of</strong> the Employer, that Artist shall receive at least twenty-four (24)<br />

hours notice <strong>of</strong> such photographing, and such photography or waiting time shall be compensated<br />

for at the appropriate rehearsal rates. The Employer shall make best efforts to provide fortyeight<br />

(48) hours notice. For B Roll Photo shoots, the Artist shall receive at least one (1) week<br />

advance notice. <strong>Artists</strong> shall be given one-half (1/2) hour paid time to prepare for photography<br />

for the purpose <strong>of</strong> preparing hair, makeup and costume.<br />

3. If the Artist is required to pose for photographs on the Artist’s Free Day<br />

the Artist shall be compensated 1/6 TH <strong>of</strong> weekly contracted salary. The provisions <strong>of</strong> this<br />

agreement regarding the scheduling <strong>of</strong> rehearsal days, including rest time, shall apply to photo<br />

shoot days. If hours are exceeded, overtime rate will be applied.<br />

4. All photos which are used for publicity purposes in any document which is<br />

solely under the Employer’s control which have four (4) <strong>Artists</strong> or less must be approved by the<br />

<strong>Artists</strong> involved and shall carry the line: “Please credit Dancers - (Dancers’ names)”. If <strong>Artists</strong><br />

fail to show-up upon request to approve photographs, Employer shall consider said photographs<br />

approved without the consent <strong>of</strong> the Artist. If violated Artist shall receive Fifty Dollars ($50.00).<br />

<strong>Artists</strong>’ names shall appear along with all solo and duo photos on Employer brochures and<br />

publicity materials. For materials produced by the Employer which include photos <strong>of</strong> three (3)<br />

or four (4) <strong>Artists</strong>, first initials and last names <strong>of</strong> <strong>Artists</strong> shall be used instead <strong>of</strong> full names. For<br />

photos <strong>of</strong> up to four (4) <strong>Artists</strong> that are used by the Employer for social media, <strong>Artists</strong> will be<br />

given notice by e-mail <strong>of</strong> photos to be used. If <strong>Artists</strong> in the photo do not object within twentyfour<br />

(24) hours from such notice to use <strong>of</strong> the photo, the photo may be posted. If an Artist later<br />

objects to continued use <strong>of</strong> the photo, it will be removed. This provision does not apply to links<br />

to a third party’s site.<br />
