9. Extended Sick Pay - For all non-work related injuries and all illnesses,<br />

each Artist shall receive the sick pay as provided for in paragraph C.1 above followed by a<br />

2-week waiting period. Thereafter Employer shall pay the Artist $250 per week each week the<br />

company is working for a period <strong>of</strong> 6 calendar months. It is agreed that such extended sick leave<br />

shall be monitored.<br />

10. Where the inability to perform is a result <strong>of</strong> pregnancy or childbirth,, the<br />

Artist shall be entitled to an unpaid leave <strong>of</strong> absence. Artist shall resume work without loss <strong>of</strong><br />

seniority with Company not later than four (4) months after childbirth. In addition, the Employer<br />

will continue Health Fund contributions for such Artist during the leave <strong>of</strong> absence. The Artist<br />

shall also receive the paid sick time in accordance with the formula provided in sub-paragraph<br />

17.C.1 and then the Extended Sick Pay provided in subparagraph 17.C.9. Sixty (60) days<br />

following childbirth the Dancer shall provide Employer with an update <strong>of</strong> progress.<br />

D. FREE DAYS<br />

1. During each five (5) day Rehearsal Week each Artist will receive two (2)<br />

Free Days as defined herein.<br />

2. Each Performance Week shall have one (1) Free Day in each Monday<br />

through Sunday Week. If <strong>Artists</strong> are called for 14 consecutive work days, there must be a free<br />

day following the 14 th consecutive work day. Compensation is not an option.<br />

3. For tours, which are in excess <strong>of</strong> twenty-one (21) days, the Employer shall<br />

designate the Free Day on the first business day or a mutually agreeable day immediately<br />

following the Company’s return to the City <strong>of</strong> Origination.<br />

E. HOLIDAYS<br />

<strong>Artists</strong> may not be required to rehearse and/or perform on the following legal holidays:<br />

Labor Day, Independence Day, Memorial Day, Martin Luther King Day, Thanksgiving,<br />

Christmas, New Year’s Day, Easter Sunday. All such legal holidays shall be in addition to the<br />

regularly scheduled Free Days. If the Artist is required to perform or rehearse on a legal holiday<br />

or if the holiday is scheduled to be the regular Free Day, the <strong>Artists</strong> shall receive an extra Free<br />

Day within the succeeding or preceding two (2) week period <strong>of</strong> employment except<br />

Thanksgiving, Christmas, New Year’s Day and Martin Luther King Day which shall have the<br />

extra Free Day scheduled within the succeeding or preceding four (4) week period <strong>of</strong><br />

employment. If an alternate Free Day cannot be scheduled <strong>Artists</strong> will be compensated at<br />

one-sixth (1/6) <strong>of</strong> the weekly salary. Legal holidays, which fall on a Sunday do not require an<br />

additional Free Day during that same week, provided the Artist shall have an alternate Free Day<br />

scheduled.<br />
