13. COMPENSATION<br />

A. WEEKLY PAYMENT<br />

AGMA agrees to a weekly payroll. The Employer agrees that all <strong>Artists</strong>, except<br />

those <strong>Artists</strong> engaged for single performance, shall be paid by cash or check or direct deposit not<br />

later than 12:00 noon on Friday <strong>of</strong> each week <strong>of</strong> employment. <strong>Artists</strong> who are engaged on a<br />

single performance basis shall be paid by cash or check immediately preceding the<br />

commencement <strong>of</strong> each individual performance for which they have been engaged. All overtime<br />

payments, penalty payments, or any other payments which arise separate and apart from the<br />

weekly minimum salaries shall be paid by the Employer to the Artist no later than two (2) weeks<br />

following the submission <strong>of</strong> the overtime schedule to the Employer.<br />

While on tour, <strong>Artists</strong> shall be paid by direct deposit or check with suitable<br />

arrangements made for cashing <strong>of</strong> checks. When the arrival in a foreign city is on either<br />

Saturday, Sunday or a holiday, the Employer will ensure that provisions will be available to<br />

change U.S. dollars into the foreign currency. Payment <strong>of</strong> meal money will be paid at the same<br />

time as the weekly salary.<br />

B. NON-PAYMENT OR PARTIAL PAYMENT OF SALARIES<br />

1. Non-payment, or partial payment <strong>of</strong> salaries when due shall be deemed a<br />

material breach <strong>of</strong> contract, giving any Artist the right to terminate forthwith his or her contract<br />

with the Employer. However, upon application and sufficient pro<strong>of</strong> by the Employer, AGMA in<br />

its discretion may grant the Employer a grace period not to exceed seven (7) days.<br />

2. If the Employer fails to pay the salary due the Artist, the Artist, in lieu <strong>of</strong><br />

termination <strong>of</strong> the contract, shall have an alternative right to receive his or her contracted salary<br />

out <strong>of</strong> the security deposit put up with AGMA by the Employer. AGMA shall notify the<br />

Employer <strong>of</strong> its intention to so pay the Artist; and if the Employer fails to institute an arbitration<br />

proceeding within two (2) weeks, AGMA will proceed to commence payment to the Artist. The<br />

Employer agrees to replenish the security deposit upon receipt <strong>of</strong> a request from AGMA to<br />

replenish the security deposit.<br />

C. CHOREOGRAPHER’S CONTRACTS<br />

Choreographers shall be compensated for their work as Choreographers, in<br />

addition to any and all compensation which may be due them hereunder for their work as<br />

Dancer, Stage Director, Stage Manager, or Assistant. The Employer shall make a written<br />

Agreement with such Choreographers containing the terms and conditions, upon which the<br />

Choreographer agrees to choreograph and the Employer agrees to engage the Choreographer to<br />

choreograph.<br />

D. COSTUME FITTINGS<br />
