E. AIRPLANE TRAVEL, CONDITIONS OF 1. In the event the Employer chooses to transport the Artists by airplane, AGMA will approve flights upon regularly scheduled airlines, which are FAA and IATA approved. 2. The Employer agrees to purchase insurance on the life of each Artist during said airplane travel, having, a value of no less than fifty thousand ($50,000.00) dollars, which may be purchased personally by each Artist if Employer pays cost of premium directly to each Artist. When the Employer purchases the flight insurance, he will provide beneficiary cards at the beginning of each contract year. 3. The Employer agrees that in all cases where it is necessary for Artists to travel between airport terminals and airports the Employer will arrange for and pay for the transportation of the Artist between city airport terminals and airports. 4. Should departure by airplane be delayed due to any conditions, adequate accommodations shall be provided for all Artists including hotel rooms between 12:01 A.M. and 8:00 A.M. in convenient nearby hotel(s) where the entire company can be assembled for the flight simultaneously. 5. When a flight is chartered by the Employer, the make-up kits and practice clothes will, whenever possible, be carried on the same plane as the Artists. Scenery and other equipment will not be carried in the passenger section of the plane if it is of a nature and size that will cause discomfort to or endanger the Artists. 6. The Artist shall be granted a minimum of two (2) hours rest for any flight of two (2) hours or less and for each additional flight hour, Artist shall receive one half (1/2) hour of rest time. The time off will be counted from the time of arrival at hotel. If the Artist is called upon to perform any services for the Employer during the established rest period following flight, the Artist shall be paid at one-half (1/2) the hourly Penalty Rate for each half-hour (1/2) or part thereof that the rest period is violated. 7. Any Artist who is required to travel by air more than: (a) (b) (c) 6 hours on a one-performance day, or 8 hours on a non-performance day, or 2 hours on a two-performance day shall be compensated for such travel at the travel overtime rate in one-half (1/2) hour increments. AGMA agrees that it shall waive the provisions of this subparagraph provided that the Employer submits to AGMA, two (2) weeks prior to any contemplated air travel of a duration that would otherwise trigger overtime payments under this subparagraph, proof that there is no available commercial air travel of a shorter duration to reach the tour destination 27
8. Air travel shall be timed from the time of baggage call until arrival at destination hotel and is to include all waiting time at terminals as well as limousine transit time at both ends of the flight and the same applies returning to city of origination and including all delays at terminals, limousine transport, etc. The Employer will not be responsible for payment of the overtime travel penalty contained in this paragraph if the excess travel time was due to inclement weather, mechanical failure, or delay in departure or landing of the aircraft over which the Employer has no control. Baggage call may be prior to 8:00 AM without penalty. 10. GUARANTEED EMPLOYMENT 1. Rehearsals in City of Origination - When Artists under Guaranteed Employment contracts have commenced rehearsals, any Rehearsal Weeks in the City of Origination at any time subsequent thereto shall include all such Artists who have already commenced rehearsals. 2. Artists shall be guaranteed six (6) weeks off-time within each contracted year. The Employer will guarantee one (1) 3-consecutive week off period following a New York season of 4 weeks or more. The Employer shall have the right to request a waiver of this guaranteed period, which shall not be unreasonably denied. There shall be at least one (1) week of rehearsal prior to commencement of a domestic tour. 11. SINGLE PERFORMANCE 1. In the event the Employer contemplates engaging Artists on a single performance basis, the Employer shall so notify AGMA. 2. All Artists, on a single performance basis, shall be paid not less than Two hundred eighty ($280.00) Dollars for each single performance in the City of Origination. If the Artist is required to perform outside the City of Origination the Employer will provide the Artist with a hotel room, explained under Accommodations Section 9.A.1. of this Agreement, plus standard meal money allowance. 3. Guarantee of Rehearsal Hours – All Artists engaged shall be guaranteed not less than ten (10) paid rehearsal hours to be paid for at the rate of Seventy-five ($75.00) Dollars per hour. No free hours of rehearsal shall be permitted. 12. RUN-OUTS When an Artist is required to perform more than fifty (50) miles beyond the central point of departure, but is not required to stay overnight, the Employer shall compensate the Artist with the appropriate meal allowance as set forth in 13.G. Employer will provide transportation to and from such performance or an equivalent allowance for transportation. 28
