C. BOAT TRAVEL, CONDITIONS OF
Where transportation can only be provided for by boat, the accommodations for the Artist
shall be what is commonly termed “Tourist” passage or better. In the event that any boat does
not have “Tourist” passage, the accommodations shall be such passage as is comparable to what
is commonly termed “Tourist” passage or better.
D. BUS TRAVEL, CONDITIONS OF
1. In any Monday through Sunday week, travel by bus shall not exceed a
total of nine (9) hours excluding any in-city travel.
2. There shall be an uninterrupted two (2) hour rest period after a bus trip
during which time the Artist may not be called upon by the Employer to participate in any
rehearsal for the Employer. If the Employer shall violate the provisions in this paragraph, the
Employer agrees to compensate each Artist at the hourly Penalty Rate for each hour or fraction
thereof for each such violation. The two hours shall not apply when the distance traveled is
seventy-five (75) miles or less, or if the time traveled is one and one-half (1-1/2) hours or less.
3. Proof of Insurance- The Employer agrees to submit proof to AGMA, in
writing, that the carrier company carries liability insurance of a minimum of one hundred
thousand ($100,000) dollars for each Artist engaging in travel.
4. Bus Standard - The Employer agrees that transportation by bus shall be by
first-class bus, with heating and ventilating facilities in working order and with toilet facility,
sufficient seating capacity, and luggage facilities when trip is scheduled to exceed one (1) hour.
In the event of an emergency, a replacement bus shall meet the same standards as required for
the initial bus. If the standards are not met, the Artists shall have the right to refuse to travel by
bus. The Employer will not be responsible for payment of the overtime travel penalty contained
in this paragraph if the excess travel time is due to mechanical failure over which the Employer
has no control. Buses must be clean and have clean, working toilet facility.
5. Rest Stops – The Employer agrees that where an Artist is required to
travel by means of bus the Artist will have a one hour rest stop for every 4 hours of travel and a
20 minute rest stop for every 2 hours of travel.
6. Should the Artists not receive a full hour lunch stop, Artists shall be
compensated at the Travel Overtime Rate.
7. Two (2) buses will be provided for any bus trip of four (4) or more hours.
Two (2) buses will always be provided when Artists and Crew Members travel together.
For overseas bus travel, the Employer may provide and pay for one (1) bus large
enough for each Artist to occupy two (2) seats. Otherwise Employer will provide and pay for
two (2) buses.
