C. REHEARSALS<br />

1. Rehearsals During Performance Weeks<br />

(a) The Artist may be called upon to rehearse during each Performance Week<br />

without the payment <strong>of</strong> additional compensation provided that:<br />

(1) The Artist shall not be required to rehearse in excess <strong>of</strong> two (2)<br />

hours on a performance day unless there is a Dress Rehearsal when the Artist shall not be<br />

required to rehearse in excess <strong>of</strong> three (3) hours. The Employer shall schedule Dress Rehearsals<br />

on non-performance days whenever possible.<br />

On tour, up to sixty (60) minutes per week <strong>of</strong> additional rehearsal time<br />

may be required and scheduled as such. This time shall be posted as non-compensated time, if<br />

needed, on single performance days only, when no dress rehearsal or other service is scheduled.<br />

It is recognized that the sixty (60) minutes per week may be utilized in smaller segments <strong>of</strong> not<br />

less than fifteen (15) minutes. Any use <strong>of</strong> this additional non-compensated time, even if used for<br />

individuals or small groups, shall reduce the sixty (60) minutes availability. It is further<br />

understood that rehearsal time beyond this sixty (60) minutes will be compensated for at the<br />

applicable rate.<br />

(2) On non-performance days during Performance Weeks, the Artist<br />

may be required to rehearse not more than five (5) hours per day, i.e., rehearsals during<br />

Performance Week:<br />

Opening night is the first (1st) performance <strong>of</strong> a new ballet or revival.<br />

(3) The Artist shall not be required to rehearse within the two (2) hour<br />

period prior to the commencement <strong>of</strong> any performance unless such rehearsal is scheduled under<br />

emergency conditions as herein defined and further provided that such Emergency Rehearsal is<br />

compensated for as provided in Section 8.C.1(b) <strong>of</strong> this Agreement. Emergency Rehearsal shall<br />

be compensated at the applicable rate<br />

(b) If the Artist shall be required to rehearse in excess <strong>of</strong> the maximum<br />

number <strong>of</strong> hours per day or per week, as above provided, he or she shall be paid not less than the<br />

rate <strong>of</strong> one-half (1/2) the hourly Overtime Rate for each such additional rehearsal half hour or<br />

fraction there<strong>of</strong>. It is further agreed that spill-over overtime rehearsal as defined herein will be<br />

paid for at the rate <strong>of</strong> one-half (1/2) the hourly Overtime Rate for each additional half-hour <strong>of</strong><br />
