As Germanys biggest mail order service distributing inflatable balloons, displays, balloon accessories 

and promotional inflatable objects, we are happy to introduce our new four coloured- catalog 

2007-2008. We cordially welcome you to overlook the following pages. 

As usually you will find exclusive products, which we commonly use and therefore we are convinced 

about their 100 % quality. We produce many of them on our own, for example balloon accessories. 

We prepared a selection of the products according to the demand of our customers and the 

limits of our suppliers and according to up-to-date trends, so you have an opportunity to choose 

decoration and promotional things for any kind of event. 

We are broadening our offer of promotional prints and promotional objects 

and also objects of special shapes. 

Maybe it happens that a certain product will not be available in our assortment, even with a storarge 

space of more than 1000 m2 . In this case, refer to us. We will arrange any balloon or 

accessories available on the market in a short time.

Ballongröße: Die Größenangaben unserer Luftballons sind die vorgegebenen Größenangaben des Herstellers. 

ø Folienballons: Größter Durchmesser im unaufgeblasenen Zustand, ohne Ballonhals. 

ø Latexballons: Größter Durchmesser vertikal im aufgeblasenen Zustand, ohne Ballonhals. 

Farben: Die abgebildeten Farben und Motive können je Hersteller variieren und Abweichungen aufweisen. 

Druckfarben: Druckfarben können nur annähernd der gewünschten Pantonenummern gedruckt werden. 

Druckqualität: Ballondruck ist kein Papierdruck. Daher kann es zu leichten Verwischungen, Passerungenauigkeiten, 

Verblassen der Druckfarbe, Durchscheinen der Ballonfarbe oder gar Abfärbungen kommen. 

Nachdrucke: Bei Nachdruckaufträgen können Ballonfarbe, -größe, -qualität, Druckfarbe und Druckbildgröße 

vom ersten Auftrag abweichen. 

Druckstand: Bitte teilen Sie uns mit, ob der bedruckte Werbeballon mit Helium gefüllt (schwebend), oder mit Luft gefüllt 

(von der Decke abgehängt) wird. Fehlen diese Angaben, wird automatisch Normaldruck angewendet.

Balloon Size: The stated balloon sizes are the recommended sizes of our manufacturers. 

ø Foil-Ballons: Largest diametre unfilled, without balloon neck. 

ø Latex-Ball.: Largest diametre vertical, inflated, without balloon neck. 

Colours: The shown balloon colours and motives might vary. 

Printing Colours: Printing colours are similar to the chosen Pantone-Colour. 

Printing Quality: There’s a big difference between printing on paper and printing on balloons. 

The quality is not compareable. 

Reprints: Reprint-orders might vary from the first order in: 

size, shape, colour, quality of the balloon and print. 

Print: Please let us know how the custom printed balloon will be used. Helium-filled floating or air-filled hanging 

from the ceiling. We always print standard if there are no further information.

zurück. Sobald der äußerste Füllraum aufgeblasen 

ist, können Sie von Außen nach Innen, einen 

Füllraum nach dem anderen freigeben und aufblasen. 

Füllen Sie die Figuren nicht so schnell 

wie herkömmliche Ballons. 

How to inflate: 

Example: balloons in the shape of a rabbit: The first step 

of inflation, hold the tummy and the head of the balloon 

tight in your hands, so the used gas or air fills the ears 

first. As soon as one of the ears is filled, fill the other one. 

After you have both ears filled, let the head slip out of your 

hands and fill it. Release the tummy and inflate it. 

All other figure-shaped balloons are inflated in the same 

way, extremities or extending parts at first 

(ears, beak, honker). 

Please keep in mind, that figure shaped balloons should 

not be inflated as quickly as regular round balloons.

10 l mit 200 Bar Druck für ca. 120 Ballons ø 28 cm, 

1 l für ca. 10 Ballons ø 25 cm und 1 Spraydose für einen 18” (45cm ø) Folienballon. 

Wir organisieren Ihnen Helium, Abfüllarmaturen und Ballonzubehör 

an einen beliebigen Ort innerhalb Deutschlands. 

Ob in Ihren Shop oder auf einen Messestand, wir liefern zuverlässig

Important notes for the helium use 

Helium is a noble gas, not explosive and not inflammable. 

During nonusage of the bottle or in 

the case of transport (bottle secured, if possible transverse to the 

driving direction) the lit must be screwed on. With the employment 

of helium the bottle must become secured against falling down and/or 

rolling away. Do not inhale the helium, in order to get a “Mickey 

Mouse voice”, since this can cause to an oxygen under-supply of 

the brain. (You will need: 50 l with 200 bar pressure for 

approx. 600 x 11” balloons, 10 l with 200 bar pressure 

for approx. 120 pcs. 1 l for approx. 5 - 6 pcs. and 1 spray tank for 

an 18” foil balloon)

Allgemeine Geschäftsbedingungen 

1. Allgemeines 

1.1 Für unsere Angebote, Lieferungen und Leistungen gelten ausschließlich unsere nachfolgend aufgeführten allgemeinen Verkaufs- und Lieferbedingungen. Allgemeine Geschäftsbedingungen Dritter sind für 

uns unbeachtlich; ihnen wird hiermit vielmehr ausdrücklich widersprochen. 

1.2 Alle mündlich, fernmündlich oder telegraphisch getroffenen Abmachungen sind nur bei schriftlicher Bestätigung verbindlich. 

2. Angebote 

Die Angebote erfolgen stets freibleibend und wir behalten uns insbesondere das Recht vor, Änderungen bezüglich der angebotenen Sortimente, Farben und Modelle vorzunehmen. 

3. Lieferung 

Die Lieferung erfolgt auf Rechnung und Gefahr des Bestellers. Mangels besonderer Anweisungen des Bestellers bewirken wir die Versendung auf dem nach unserem Ermessen besten und billigsten Wege. Wir 

sind dazu berechtigt, die versandten Güter auf Kosten des Bestellers gegen Transportschäden zu versichern. Eine Versicherungspflicht unsererseits besteht jedoch nicht. Die Verpackung erfolgt nach fach- und 

handelsüblichen Gesichtspunkten. Sonderverpackungen und Ersatzpackungen werden zum Selbstkostenpreis berechnet. 

Bei Lieferungen von bedruckten Waren sind Mehr- beziehungsweise Minderlieferungen bis 10% zulässig. Die Berechnung erfolgt aufgrund der tatsächlich gelieferten Menge. 

4. Lieferzeiten 

Lieferfristen gelten nur dann als vereinbart, wenn sie schriftlich vereinbart wurden. Die Lieferfristen beginnen mit dem Tag der Auftragsannahme; im Falle des Bedruckens der bestellten Ware jedoch erst, nach 

Beibringung vom Kunden zu beschaffender Unterlagen, Freigaben sowie dem Eingang einer vereinbarten Anzahlung. Die Lieferfristen sind unverbindlich und annähernd und werden soweit möglich eingehalten. 

Sie gelten als eingehalten, wenn die bestellten Waren bis zu ihrem Ablauf unser Lager verlassen haben. 

4.1 Sollten wir aus von uns zu vertretenden Gründen einen Liefertermin nicht einhalten können, so kann uns der Besteller eine Nachfrist setzten. Die Nachfrist beträgt mindestens 3 Wochen. Für Artikel, die wir 

aus dem Ausland beziehen müssen, mindestens 12 Wochen. 

4.2 Bei höherer Gewalt kann der Besteller uns die Nachfrist erst nach deren Wegfall setzen, Ereignisse, welche höhere Gewalt darstellen, verlängern die Lieferzeit entsprechend. Als höhere Gewalt gelten insbesondere: 

Streik, Rohstoff- oder Warenmangel, Betriebsstörungen, Stockungen der An- und Ablieferung und zwar auch, soweit diese Umstände im Bereich unserer Zulieferer eintreten. 

4.3 Teillieferungen sind gestattet. Sie gelten als in sich abgeschlossene Geschäfte und können entsprechend fakturiert werden. 

5. Rücktrittsvorbehalt 

5.1 Wir sind berechtigt, von einem zustandegekommenen Vertrag zurückzutreten, falls Ereignisse höherer Gewalt eintreten, unbefriedigende Auskünfte über die wirtschaftliche und persönliche Bonität des 

Bestellers eingehen oder dieser nach Auftragserteilung das Insolvenz- bzw. Vergleichsverfahren anmeldet. 

5.2 Ist der Kunde mit der Bezahlung einer früheren Lieferung in Verzug, so sind wir berechtigt, Lieferungen zurückzuhalten, ohne zum Ersatz eines etwa entstehenden Schadens verpflichtet zu sein. 

5.3 Nimmt der Besteller die Ware infolge seines Verschuldens nicht rechtzeitig ab, so sind wir berechtigt, ihm eine Nachfrist von mindestens 8 Tagen zu setzen. Nach Ablauf dieser Frist, die mit Zugang der 

Nachfristsetzung an den Besteller beginnt, können wir Schadensersatz verlangen und vom Vertrag zurücktreten. 

6. Preise und Zahlung 

6.1 Unseren Katalogpreisen enthalten 19% Mehrwertsteuer. Maßgebend für den jeweils erteilten Auftrag sind diejenigen Preise, die in dem Zeitpunkt Gültigkeit haben, in welchem der Auftrag für uns bindend wird. 

Ist jedoch eine Lieferfrist von mehr als einem Monat vereinbart, so gelten die im Zeitpunkt der Lieferung maßgebenden Preise. Die Frist von einem Monat wird von dem Zeitpunkt an gerechnet, in welchem der 

erteilte Auftrag für uns bindend geworden ist. 

6.2 Die Preise sind sofort zahlbar. Abweichende Vereinbahrungen behalten wir uns vor. 

6.3 Zahlung Inland: Nachnahme, Vorkasse, Bankeinzug, MasterCard oder Visa mit je 2% Skonto, sofern zum Zeitpunkt der Zahlung keine sonstigen fälligen Forderungen bestehen. 

Zahlung Ausland: Vorkasse, MasterCard oder Visa mit je 2% Skonto. 

Die Bezahlung gilt erst als erfolgt, wenn wir über den Betrag frei verfügen können. 

6.4 Bei Zahlungsverzug werden die gesetzlichen Verzugszinsen berechnet. Tritt Zahlungsverzug ein, so sind wir berechtigt, unter Ablehnung der Erfüllung Schadensersatz zu verlangen oder vom Vertrag zurückzutreten. 

6.5 Wir behalten uns vor, über die Hereinnahme von Schecks von Fall zu Fall zu entscheiden. Die Gutschrift erfolgt nur unter banküblichem Vorbehalt. Der Besteller verpflichtet sich, sein Konto so zu führen, dass 

der Scheck von uns ohne Verzögerung eingelöst werden kann. 

6.6 Für den Fall, dass der Scheck nicht termingemäß eingelöst wird oder Umstände beim Kunden eintreten, die nach unserer Auffassung das Gewähren eines Zahlungszieles nicht mehr rechtfertigen, sind wir 

berechtigt, die gesamte Forderung sofort einzuziehen. 

6.7 Der Besteller ist zur Aufrechnung, auch wenn Mängelrügen oder Gegenansprüche geltend gemacht werden nur berechtigt, wenn die Gegenansprüche rechtskräftig festgestellt, von uns anerkannt wurden 

oder unstreitig sind. Zur Ausübung eines Zurückbehaltungsrechtes ist der Besteller nur befugt, wenn sein Gegenanspruch auf demselben Kaufvertrag beruht. 

7. Mängelhaftung 

7.1 Etwaige Transportschäden an von uns gelieferten Waren sind gegenüber dem Frachtführer sofort geltend zu machen. Die Beweise hierfür sind – eventuell mit Hilfe eines Sachverständigen – zu sichern. 

7.2 Der Besteller, welcher nicht Verbraucher im Sinn von § 13 BGB ist, ist verpflichtet die Lieferung unverzüglich auf Qualitäts- und Mengenabweichungen zu untersuchen und Mängel gegenüber uns schriftlich zu 

rügen. Die Rüge von offensichtlichen Mängeln ist rechtzeitig, wenn sie innerhalb von 5 Arbeitstagen ab Ablieferung der Ware bei uns eingeht. Die Rüge verdeckter Mängel ist rechtzeitig, wenn sie innerhalb von 5 

Arbeitstagen ab deren Entdeckung bei uns eingeht. 

Der Besteller, der Verbraucher im Sinn von § 13 BGB ist, ist verpflichtet, die Ware auf Vollständigkeit, Transportschäden, offensichtliche Mängel, Beschaffenheit und deren Eigenschaften zu untersuchen. Vom 

Besteller sind die offensichtlichen Mängel innerhalb von 5 Arbeitstagen ab Ablieferung des Vertragsgegenstandes schriftlich uns gegenüber zu rügen. 

Die Untersuchungs- und Rügepflicht gilt bei berechtigten Teillieferungen für jede Teillieferung gesondert. Bei Verletzung der Untersuchungs- und Rügepflicht gilt die Ware in Ansehung des betreffenden Mängel als 

genehmigt. 

7.3 Ist die von uns gelieferte Ware mangelhaft, so sind wir berechtigt, entweder den Mangel an der gelieferten Ware zu beseitigen oder neu zu liefern. Die Herabsetzung des Kaufpreises oder der Rücktritt vom 

Vertrag sind bis einschließlich des zweiten Mangelbeseitigungsversuchs und/ oder Nacherfüllungsversuchs ausgeschlossen. Scheitert die Nacherfüllung (Mangelbeseitigung/Neulieferung) zum zweitenMal, oder 

haben wir die Nacherfüllung insgesamt verweigert, kann der Besteller nach seiner Wahl Herabsetzung des Kaufpreises (Minderung) verlangen oder den Rücktritt vom Vertrag erklären. 

7.4 Wir sind nicht zur Mängelhafung verpflichtet, wenn der Besteller einen offensichtlichen Mangel nicht rechtzeitig schriftlich gerügt hat, der Kaufgegenstand unsachgemäß behandelt, insbesondere unsachgemäß 

montiert und in Betrieb genommen wurde und/oder Eingriffe oder Änderungen am Kaufgegenstand von anderer Seite vorgenommen wurden. 

7.5 Ware, die wir, ohne hierzu verpflichtet zu sein, aus Kulanz zurück nehmen, wird unter Abzug von 20% des Nettowertes für Kontrolle und Umpacken gutgeschrieben. 

8. Eigentumsvorbehalt 

8.1 Alle von uns gelieferten Waren bleiben bis zur vollständigen Bezahlung aller unserer aus den laufenden Geschäftsbeziehungen bestehenden Ansprüchen unser Eigentum. 

8.2 Unsere Kunden dürfen die unter unseren Eigentumsvorbehalt stehenden Waren nur im Rahmen eines ordnungsgemäßen üblichen Geschäftsverkehrs im eigenen Namen an Dritte weiter veräußern. Die 

Weiterveräußerung an Abnehmer, die die Abtretung der gegen sie gerichteten Forderung auf Entgeltzahlung ausgeschlossen haben, wird untersagt. 

8.3 Für den Fall der Weiterveräußerung unserer Eigentumsvorbehaltsware, ihrer Beschädigung oder ihres Verlustes tritt der Besteller schon jetzt seine hieraus bestehenden Ansprüche gegen den Erwerber und 

alle Eigentumsvorbehaltsware vom Besteller zusammen mit anderen, uns nicht gehörenden Waren zu einem Gesamtpreis veräußert, erfolgt die Abtretung nur in Höhe des von uns in Rechnung gestellten Wertes 

unserer Ware. Entsprechendes gilt für den Umfang der Abtretung einer etwa bestehenden Kontokorrentforderung des Bestellers gegenüber seinem Arbeitnehmer. Der Besteller verpflichtet sich, uns über den 

Bestand der abgetretenen Ansprüche Auskunft zu erteilen und uns die zu ihrer Geltendmachung erforderlichen Urkunden herauszugeben. 

8.4 Übersteigt der Wert der uns auf Grund bevorstehender Vereinbarungen gestellten Sicherheiten 120% des Gesamtbetrages unserer Forderungen gegen den Besteller, so sind wir verpflichtet, ihm dem übersteigenden 

Teil der Sicherheiten zurück zu übertragen. Welche Sicherheiten zurückübertragen werden, liegt bei uns. 

9. Urheberrechte 

Für die Prüfung des Rechts der Vervielfältigung der Druckvorlagen ist der Besteller allein verantwortlich. 

10. Rücksendung 

10.1 Die Rücksendung bereits gelieferter Waren bedarf unserer vorherigen schriftlichen Zustimmung. Sie hat Frachtfrei zu erfolgen. Zurückgenommen werden können nur unbeschädigte und original verpackte 

Waren. Sie sind durch ausreichende zusätzliche Verpackung auf eigene Kosten gegen die Beschädigung bei der Rücksendung zu schützen. 

10.2 Verlangen wir für die Rücknahme der Ware Schadenersatz wegen Nichterfüllung, beträgt der zu ersetzende Schaden grundsätzlich 10% des Kaufpreises. Der Schadensbetrag ist aber höher oder niedriger 

anzusetzen wenn wir einen höheren oder der Käufer einen niedrigeren Schaden nachweist. 

10.3 Die Bestimmungen gelten nicht, wenn der Käufer in Folge Geltendmachung von Mängelhaftungsansprüchen Waren an uns zurück schickt oder wir in von uns zu vertretender Weise falsche Waren ausgeliefert 

haben. 

11. Haftungsbeschränkung 

Soweit wir bezüglich der Ware oder Teilen derselben eine Beschaffenheits- /oder Haltbarkeitsgarantie abgegeben haben, haften wir auch im Rahmen dieser Garantie. Für Schäden, die auf dem Fehlen der garantierten 

Beschaffenheit oder Haltbarkeit beruhen, aber nicht unmittelbar an der Ware eintreten, haften wir allerdings nur dann, wenn das Risiko eines solchen Schadens ersichtlich von der Beschaffenheits- und 

Haltbarkeitsgarantie erfasst ist. 

Wir haften uneingeschränk für Schäden an Leben, Körper und Gesundheit, die auf einer fahrlässigen oder vorsätzlichen Pflichtverletzung von uns, unseren gesetzlichen Vertretern oder unseren Erfüllungsgehilfen 

beruhen, sowie für Schäden, die von der Haftung nach dem Produktionsgesetz umfasst werden, sowie für Schäden, die auf vorsätzlichen oder grob fahrlässigen Pflichtverletzungen sowie Arglist beruhen. 

Wir haften auch für Schäden, die durch einfache Fahrlässigkeit verursacht werden, soweit diese Fahrlässigkeit die Verletzung solcher Vertragspflichten betrifft, deren Einhaltung für die Erreichung des 

Vertragszweckes von besonderer Bedeutung ist (Kardinalpflichten). Wir haften jedoch nur, soweit die Schäden in typischer Weise mit dem Vertrag verbunden und vorhersehbar sind. Bei einfachen fahrlässigen 

Verletzungen nicht vertragswesentlichen Nebenpflichten haften wir im Übrigen nicht. Die vorher genannten Haftungsbeschränkungen gelten auch, soweit die Haftung für die gesetzlichen Vertreter, leitenden 

Angestellten und sonstigen Erfüllungsgehilfen von uns betroffen ist. 

12. Kennzeichnung 

Eine Bearbeitung oder Veränderung unserer Waren sowie das Entfernen unserer Typenschilder oder sonstiger von uns angebrachten Kennzeichen oder Ursprungszeichen, sowie das Anbringen anderer 

Typenschilder oder sonstiger Zeichen, die als Ursprungszeichen unseres Bestellers angesehen werden könnten, sind unzulässig. 

13. Erfüllungsort und Geschäftsstand 

13.1 Erfüllungsort für alle Lieferungen und Leistungen ist der Sitz unserer Gesellschaft. 

13.2 Für sämtliche gegenwärtigen uns zukünftigen Ansprüche aus unserer Geschäftsverbindung mit Bestellern, die Vollkaufleute sind, einschließlich für Wechsel- und Scheckforderungen, ist das Amtsgericht Bad 

Säckingen beziehungsweise Landgericht Waldshut-Tiengen 1 ausschließlicher Gerichtsstand. Der gleiche Gerichtstand gilt, wenn der Besteller keinen allgemeinen Gerichtsstand im Inland hat oder nach 

Vertragsschluss seinen Wohnsitz oder gewöhnlichen Aufenthaltsort zum Zeitpunkt der Klageerhebung nicht bekannt ist. 

14. Auslandsgeschäfte 

Die Bestimmungen der Haagener Abkommen für internationale Kaufverträge finden keine Anwendung. Für die mit unseren Bestellern abgeschlossenen Verträge gilt ausschließlich deutsches Recht. 

Schlussbestimmungen 

Sollte eine Regelung dieser allgemeinen Geschäftsbedingungen unwirksam oder undurchführbar sein oder werden, so berührt diese die Wirksamkeit der allgemeinen Geschäftsbedingungen im Übrigen nicht.

General Business Terms 

1. General notes 

1.1Our undermentioned General business and delivery terms are exclusively valid for all offers, delivery, and services. General business terms of third parties are not obligatory for us, in particular if they are in 

conflict. 

1.2All verbal, phone and telegraphic agreements are mandatory only after written confirmation. 

2. Offers 

Offers are never mandatory and they do not bind us to accept an order. We reserve the right to change our range of goods, colors and types. 

3. Delivery 

Delivery is paid by the customer and the delivery is on his own risk. If the delivery is not specified by the customer, we choose the best and the cheapest delivery way according to our opinion. We are authorized 

to insure the goods against damage or loss during delivery on customer's expenses. However, we are not obliged to arrange insurance. Packing is performed according to usual and professional commercial 

experience. Special and substitute packaging will be added to the price. 

In case of deliveries of goods with printing, bigger and smaller numbers up to 10 % can be accepted. Final price is based on actually delivered amount. 

4. Delivery time 

Delivery time is considered obligatory only if it was confirmed in writing. Delivery time starts on the day of order acceptation, in case of goods with printing after providing of source data by the customer, their 

approval and advance payment for the goods. Delivery time is not obligatory, it is approximate and will be observed if possible. Delivery time is considered as fulfilled, if the goods leave our store before its expiration. 

4.1 If the delivery time cannot be fulfilled due to our fault, an additional delivery time can be determined by the customer. Additional delivery time should be at least three weeks. In case of products from abroad, at 

least twelve weeks. 

4.2 In case of force majeure, the customer can determine additional delivery time only after the influence of force majeure passes. Force majeure extends delivery time according to its impact. Force majeure is 

namely strike, lack of raw material or goods, operation breakdown, delivery and expedition caused by our suppliers. 

4.3 Partial delivery is allowed. This is valid for independent contracts and they can be invoiced separately. 

5. Withdrawal right 

5.1 We are authorized to withdraw a contract due to force majeure, insufficient information about financial and personal credibility of the customer or if the customer is in bankruptcy. 

5.2 If the customer was delayed with payment for an earlier order, we are authorized to take hold the delivery without obligation to reimburse possible loss. 

5.3 If the customer does not pick up the goods due to his own fault, we are authorized to determine an additional term at least 8 days. After this term, which begins by the day of delivery of a notice of additional 

term, we can claim compensation for the loss and back out of the contract. 

6. Prices and payments 

6.1 Our prices are prices include value-added tax. Prices crucial for each order are prices valid in the moment, when the order is validated. If the negotiated delivery term is longer than one month, crucial prices 

are those valid in time of delivery. Term of one-month starts at the moment when the order becomes obligatory for us. 

6.2 We only accept payment in advance via Bank Transfer or Credit Card 

6.3 We provide a discount of 2 %, if there are no other due claims. Payment is considered paid as soon as we can dispose the paid amount. 

6.4 If the payment is delayed, a legal delay interest is charged. If the payment is delayed, we are authorized to reject fulfillment and to claim compensation for loss or we can back out of the contract. 

6.5 We stipulate a right to decide whether we accept a check in each specific case. A credit note is accepted with a usual bank stipulation. The customer is obliged to keep his account so the check can be paid 

without a delay. 

6.6 If the check is not cashed in time or circumstances on the customer side according to our opinion do not guarantee maturity, we are authorized to encash whole claim immediately. 

6.7 The customer is authorized to count in counter claims, even if reclamation of defects of counter claims are applied, only when we determined and recognized these counter claims or when they are indisputable. 

The customer can use the right of lien only if his counter claim deals with the same contract. 

7. Warranty 

7.1 A potential damage on the supplied goods during shipping should be claimed immediately to the carrier. Proves should be collected and secured, if necessary with a help of an expert. 

7.2 A customer, which is not the end consumer according to article 13 of the Civil Code, is obligated to check immediately quality, amount, defects of the supply and possible claims should be reclaimed in written. 

Reclamation of obvious defects is realized in time, if it is provided to us within 5 working days after goods expedition. Reclamation of hidden defects is realized in time, if it is provided to us within 5 working days 

after defect finding. 

A customer which is the end consumer according to article 13 of the Civil Code, is obligated to check immediately quality, properties, amount, shipping damages, visible defects of the supply. The customer should 

reclaim visible defects in written within 5 days after goods expedition. 

Obligation to such a control and reclamation is held in case of justified partial supplies for each partial supply separately. If the obligation to a control and reclamation is not held, the supply is considered in terms 

of possible defects as approved. 

7.3 Supplementary fulfillment is possible based on a choice of the customer by remedy defects of by a supply of respective new items. We are authorized to reject a supplementary fulfillment chosen by the customer, 

if it would mean inadequate expenses. Lowering of the purchase price or contract cancellation by the customer is not possible. Supplementary fulfillment is considered as failed, if even the second attempt to 

fulfill fails. If the supplementary fulfillment is failed of we have rejected it as a whole, the customer can claim lowering of the purchase price (discount) of he can cancel the contract. 

7.4 We do not warrant any damages, if the customer failed to reclaim them obviously in due time in written, in case of improper usage, mainly in case of wrong installation or putting into operation and/or changes 

or alterations have been made to the delivered items. 

7.5 Goods, which we accept back with no obligation from our side, will be credited after deduction of 20% of the net price. 

8. Ownership terms 

8.1 All supplied goods remain in our possession until complete payment of all claims related to the business relations. 

8.2 Our customers can sell the goods, which are under ownership terms, to the third parties under their own name only within regular business contacts. Other distribution to customers, which exclude the transfer 

of the claim for the reimbursement, is not allowed. 

8.3 The customer transfers related claims toward the third party (including insurance) in case of the sale to the third party under the ownership terms. 

In case of goods under the ownership terms, which is sold together with other goods, which are not in our possession, for a total price, the assignment is limited to the price, which we charge for our goods. This is 

valid for a range of assignment of an existing order paid from a checking a account of a customer towards his employer. The customer undertakes to inform us about a state of transferred claims and to hand over 

all necessary documents for their enforcing. 

8.4 If the cost of provided principal exceeds 120% of the total price of our claims towards the customer, we are obligated to transfer the difference to the customer. We can decide which principal will be transferred. 

9. Copyright 

The customer is solely responsible for copyright for copying of the printing templates. 

10. Returns 

10.1 Returns of the already supplied goods are possible only with our written approval. Refund is realized without expenses for shipping. Only goods without any damage and originally packed can be returned. 

The goods have to be returned on customer’s own expenses and have to be repacked with another packaging to avoid any damage during the return shipment. 

10.2 Charge for incomplete fulfillment is usually 10% of the purchase price for damage compensation. However, the compensation will be higher if we prove that the damage is higher, or lower, if the customer 

proves that the damage is lower. 

10.3 This clause is not valid, if the customer returns back the goods based on reclamation or if we sent off wrong goods due to our own fault. 

11. Limited warranty 

We warrant the quality and/or durability within the provided warranty for the goods or their parts. We warrant the loss caused by defects of the goods within the provided warranty for the quality and durability only 

if the risk of such a loss is clearly included in the quality and durability warranty. 

We provide an unlimited warranty for life, health harm and injury damages caused by breaking of our duties due to negligence or intention by us, our legal representatives, or our assistants, and for damages 

which are included in the warranty covered by the Industrial Code, and for damages caused by breaking of duties due to gross negligence, intention or ill intention. 

We warrant also damages caused by simple negligence, if it is related to breaking contract duties, which have special significance for the purpose of the contract (principal duties). However, we warrant them only 

if the damages are caused by a way related to the contract and are unpredictable. We do not warrant breaking of side duties, which are not principal for the contract and are broken by simple negligence. Abovementioned 

limitation to the warranty is valid also in case, when the warranty of legal representatives and other assistants is in concern. 

12. Marking 

Processing or alteration of our goods and removal of our type labels or other our tags or labels informing about the product origin and replacing them by different ones, which can be considered as type labels or 

labels of the product origin is not allowed. 

13. Place of fulfillment and company residence 

13.1 The company residence is the place of fulfillment for all deliveries and services. 

13.2 Exclusive court residence for all current and future claims related to business contracts with customers, which are traders listed in the Trading register including claims related to bills and checks is the district 

court in Bad Säckingen, or regional court in Waldshut-Tiengen 1. This is valid even in case that the customer does not have an inland residence or if his residence becomes unknown after the contract has been 

made and his residence is unknown when a possible legal action is brought. 

14. Foreign trade 

Terms of the Haag Treaty about international business contracts are not used. Exclusively German laws are used for contracts with our customers. 

Closing terms 

If one or more of terms of these General business terms becomes ineffective or unfeasible, other terms are not affected by this fact.
