Evaluation and assessment of Uruguayan Forest Certification scheme against the requirements of the PEFC Council Executive Summary Recommendation to PEFC Council Board of Directors The Uruguayan Forest Certification Scheme (UFCS), as presented by PEFC Uruguay on 8 January 2010, together with supporting documentation (refer to 2.3 of this Report), does not meet the requirements of the Programme for the Endorsement of Forest Certification (PEFC) Scheme. The UFCS has several incidences of non-conformity, further detailed in parts 1(b), 1(c), 2(b), 5(c) and 5(d) of Summary of Findings. The consultants consider that the identified non-conformities, with exception of 1(b), do not hamper creditable and reliable UFCS implementation consistent with PEFCC requirements. The consultants base this conclusion on detailed commentary included in the body of the following report. The consultants recommend that PEFCC consider the option of conditional endorsement of the UFCS, subject to PEFCC approval of the organisational and individual participation arrangements implemented by Instituto Uruguayo De Normas Técnicas (UNIT) to develop and approve forest management standards (UNIT 1151: 2009 and UNIT 1152: 2009). Summary of Findings The justification for endorsement is based on the following findings: 1. For standard setting processes – initiated by the Uruguayan Society of Forestry Producers and managed by Instituto Uruguayo de Normas Técnicas (UNIT) - against PEFCC requirements: a. Independence processes conform with PEFCC requirements (refer to Section 3.1.1); b. Participatory processes do not conform to PEFCC requirements. Documentation presented by PEFC Uruguay and the Instituto Uruguayo De Normas Técnicas (UNIT) does not provide evidence that environmental non-government organisations were formally invited to participate in development and approval of forest management standards (as detailed in Section 3.1.2 and 3.5 of Report); c. Public consultation processes do not conform to PEFCC requirements. The public consultation processes implemented by UNIT for final draft of forest management standards (as detailed in Sections 3.1.2 and 3.5 of Report) was less than 60 days specified in PEFCC requirements; d. Pilot testing practices conform with PEFCC requirements (refer Section 3.3); e. Review of standard documentation conforms to PEFCC requirements (refer to Section 3.4). 2. For implementation of the UFCS against PEFCC requirements: a. General requirements of the UFCS in areas such as types of forests, management systems, auditing verification, property and land tenure, and customary and traditional rights conform with requirements of PEFCC (refer to Sections 4.1.1 and 4.1.2); b. Documented process for the UFCS do not conform with PEFCC requirements for making a summary of forest management plan publicly available (as detailed in Section 4.1.2 of Report); c. Required compliance with laws and regulations conform to PEFCC requirements (refer to Section 4.1.3); d. Level of implementation for individual and group forest certification processes for the UFCS conform with PEFCC requirements (refer to Section 4.2); e. Appeals, complaints and dispute procedures documented for the UFCS conform to PEFCC requirements (refer to 4.3). 3. The forest management standards (UNIT 1151: 2009 and UNIT 1152: 2009) conform to PEFCC requirements for compliance with Pan European Operational Level Guidelines for Sustainable Forest Management (PEOLG) (refer to Section 5). www.itsglobal.net Page 7
