period of two years from and after the effective date. Any person violating the law<br />

can, upon conviction, be fined no less than fifty dollars ($50.00) but no more than<br />

one hundred dollars ($100.00) for a first offense and shall also be sentenced for a<br />

period of up to ninety (90) days for each offense. Each subsequent offense after the<br />

first offense shall be punished with “a greater monetary fine, and/or increased jail<br />

offense (sic). No offense shall be deemed a continuing offense and each individual<br />

item of flora or fauna taken or disturbed shall be deemed a separate offense that<br />

may be punished separately.<br />

DAMAGING CORAL REEFS<br />

• . Koror State Public Law No. K6-121-2001 This Koror State Public Law,<br />

effective as of approximately July 8, 2001, mandates that any party, including all<br />

courts of competent jurisdiction, must recognize and include in any consideration,<br />

estimation or deliberation by any party regarding the monetary value of any and all<br />

unlawful damage to any portion of the coral reef ecosystem located in the waters of<br />

the State of Koror, direct use values, indirect use values and non-use values of the<br />

portion of the coral reef ecosystem damaged.<br />

NGEDERRAK REEF MPA<br />

• Koror State Public Law No. K6-133-2002 This Koror State Public Law, effective as<br />

of approximately July 2002, amends section 2(D) of K6-119-2001 by extending the<br />

conservation moratorium for Ngederrak Reef from two to four years.<br />

NGERKEBESANG CONSERVATION ZONE<br />

• Koror State Public Law No. K6-136-2002 This Koror State Public Law, effective as<br />

of approximately November 2002. Located to the west of Ngerkebesang Island and<br />

the Palau Pacific Resort. The boundaries include all areas below the highest high<br />

tide watermark, within the boundary from the breakwater at Ngereksong 100 meters<br />

west, and south to Ngerdis point, to the shore at the Palau Pacific Resort.<br />

Demarcation markers have defined this area. There will be: No Fishing, capture,<br />

remove, touching, or otherwise disturb any form of marine flora or fauna. Marine<br />

flora and fauna means all forms of corals, invertebrates, fish, and other living<br />

organisms of any kind. The Governor of State of Koror may provide written<br />

authorization to any person to undertake conservation measures consistent with the<br />

provisions of this Act or to remove or deal with any flora or fauna for the purpose of<br />

conducting scientific studies or research. The Palau Pacific Resort management<br />

shall take all steps reasonable and necessary to inform the guests and visitors of the<br />

boundaries and restrictions of the Conservation Zone. It shall be unlawful for any<br />

person to fish for, capture, net, take, molest, destroy, alter, move, remove, touch, or<br />

otherwise disturb any form of marine flora or fauna in the Ngerkebesang<br />

Conservation Zone. The prohibitions do not include the removal of litter, trash,<br />

debris, or other inorganic objects that may have organisms growing on or in such<br />

foreign objects.<br />

FISHING LAW (AMENDMENT)<br />

Koror State Public Law No. K6-138-2003 This Koror State Public Law, effective as of<br />

approximately May 2003, amends and repeals certain portions of KSPL K4-68-95.<br />

Specifically, the new law: Prohibits non-Palauans from fishing in Koror (unless from a<br />

boat) and Increases to $200 per year or $20 per month the fee charged to non-Palauans<br />
