7.6.8 Section VIII<br />

DEPTH RESTRICTIONS<br />

No person shall operate a PWC where the water is less than five (5) feet deep, as<br />

determined by an absolutely vertical measurement from the water level downward to the<br />

sea floor, unless the PWC is located within a Water Sport Zone or the PWC is<br />

proceeding at idle speed to be imminently docked, launched or otherwise secured.<br />

7.6.9 Section IX<br />

CAPACITY RESTRICTIONS<br />

No more than one operator and one individual passenger are permitted on a PWC<br />

simultaneously, unless expressly authorized by the PWC manufacturer’s user manual.<br />

No more than one individual may be towed by a PWC unless expressly authorized by<br />

the PWC manufacturer’s user manual.<br />

7.6.10 Section X<br />

SAFETY EQUIPMENT REQUIREMENTS<br />

Every PWC operator, passenger and person being towed by a PWC shall wear a Type I,<br />

II or III personal floatation device while on a PWC or in or on the water. Every PWC<br />

shall at all times contain a signaling device, paddle, tow strap, and a functioning,<br />

waterproof, battery-operated flashlight. In addition, a radio or cellular communication<br />

device is strongly recommended.<br />

7.6.11 Section XI<br />

DEALER RESTRICTIONS<br />

Any person offering a PWC for sale within the state shall procure and maintain a valid<br />

business license from the state and shall provide every PWC buyer with a summary of<br />

all laws and regulations governing PWC operation in state waters and shall, on request,<br />

provide instruction free-of-charge regarding safe PWC operation. Every such dealer<br />

shall require each PWC purchaser to acknowledge in writing that the purchaser has<br />

been provided with a summary of all laws and regulations governing PWC operation in<br />

state waters and that the purchaser has read and understood them. The dealer must<br />

retain each signed form for no less than six (6) months from the respective sale’s date.<br />

This Section XI shall not apply to private individuals offering for sale no more than one<br />

(1) at any given time.<br />

7.6.12 Section XII<br />

RENTAL RESTRICTIONS<br />

Every person offering a PWC for rent within the state shall procure and maintain a valid<br />

business license from the state and shall provide every renter with:<br />

a) a summary of all laws and regulations governing PWC operation in state waters;<br />

b) a Type I, II or III personal flotation device, and all other equipment required<br />

herein; and<br />
