Student Complaint and Hearing Process<br />

Every effort will be made to first resolve conflicts through informal discussions<br />

with the involved parties. If this fails, a written complaint may<br />

be filed as outlined below. In computing any time limit specified under<br />

this process, Saturdays, Sundays, official school closings, and holidays<br />

will be excluded. The Vice President of Student and Educational Services<br />

has the authority to adjust time lines as deemed necessary because of<br />

extraordinary circumstances.<br />

A. Complaint<br />

1. A complaint alleging violations of a <strong>College</strong> rule and/or regulation<br />

may be filed in writing against any student through the<br />

Department of Public Safety on a State of Michigan Standard<br />

Incident Report Form, UD-107. Complaints must be filed within<br />

a reasonable length of time. This report shall then be forwarded<br />

to the Office of the Vice President of Student and Educational<br />

Services (or designee) for action.<br />

2. After consultation with the student involved and after undertaking<br />

other investigtions that may be appropriate under the circumstances,<br />

the Vice President of Student and Educational Services<br />

or designee shall take one of the following actions:<br />

a. Dismiss the complaint.<br />

b. Conduct an informal hearing and invoke a sanction if the<br />

alleged violation is admitted.<br />

c. Refer to a Case Review Officer selected from a list prepared<br />

by September 1 each year by the Office of the President and<br />

named within three working days of the receipt of the complaint,<br />

barring unforeseen circumstances.<br />

3. The action taken by the Office of the Vice President of Student<br />

and Educational Services (or designee) will be communicated<br />

to the student in writing.<br />

B. Case Review<br />

Purpose: To consider complaints referred by the Office of the Vice<br />

President of Student and Educational Services (or designee) and<br />

to recommend appropriate action to be taken by the Office of the<br />

Vice President of Student and Educational Services.<br />

1. The Case Review Officer will conduct a case review, normally<br />

including discussion with all parties involved, prepare a written<br />

report, and recommend that one of the following actions be taken<br />

by the Office of the Vice President of Student and Educational<br />

Services:<br />

a. Dismiss the complaint.<br />

b. Invoke a specific sanction.<br />

c. Activate the Formal Hearing Panel.<br />

2. The Case Review Officer will make a recommendation within<br />

five working days of receiving the complaint, barring extenuating<br />

circumstances.<br />

3. Action by the Office of the Vice President of Student and Educational<br />

Services shall be communicated to students in writing.<br />

C. Formal Hearing Panel<br />

1. Members of the Formal Hearing Panel shall serve for one year (September<br />

1 through August 31 of the following year) and include:<br />

a. A non-voting chair designated by the Office of the Vice<br />

President of Student and Educational Services who has not<br />

previously ruled on the case.<br />

b. Three students selected by the Student Senate Committee.<br />

c. One faculty selected by the Faculty Executive Committee.<br />

d. One staff member selected by the Senate President.<br />

e. A sufficient number of alternates shall be designated to assure<br />

full panel representation when a hearing is scheduled.<br />

2. The Formal Hearing may be requested:<br />

a. By the student filing a written request with the Office of the<br />

Vice President of Student and Educational Services within<br />

five working days following notification of the action taken<br />

or<br />

b. By the Office of the Vice President of Student and Educational<br />

Services.<br />

3. Within 10 working days of the receipt of a written request for a<br />

formal hearing, the Office of the Vice President of Student and<br />

Educational Services shall convene the Hearing Panel. The student<br />

will be advised of the date, time, and place of the scheduled<br />

hearing.<br />

4. The Formal Hearing Panel will review all previous actions and<br />

conduct a formal hearing. Within 8 working days, barring extenuating<br />

circumstances, the Panel shall make a ruling specifying its<br />

findings.<br />

Such ruling may result in:<br />

a. Confirmation of the action of the Office of the Vice President<br />

of Student and Educational Services.<br />

b. Dismissal of all or a portion of the complaint.<br />

c. Instructions to the Office of the Vice President of Student and<br />

Educational Services to invoke a specific sanction or initiate<br />

other disposition as the Hearing Panel deems appropriate<br />

under the circumstances.<br />

5. The decision of the Formal Hearing panel will be communicated<br />

to the student in writing<br />

6. The decision of the Formal Hearing Panel shall be final except<br />

that action involving suspension or dismissal from the <strong>College</strong><br />

must be ratified by the Office of the President before implementation.<br />
