• Assisting the observer to safely embark and disembark the vessel at an agreed place and<br />

time.<br />

• Assisting the observer to carry out all duties safely.<br />

• Providing the observer with food, ac<strong>com</strong>modations, medical facilities, and sanitary<br />

facilities of a reasonable standard equivalent to those normally available to an officer on<br />

board the vessel.<br />

• Facilitating access by the observer to all areas and facilities of the vessel necessary to<br />

conduct observer duties, including the bridge, <strong>com</strong>munications equipment and personnel,<br />

deck, and areas used to process, weigh, and store fish, gear, and equipment.<br />

• Provide access to certificate of registry, safety certificate and navigation and fishing log.<br />

• Permitting the observer to remove samples from the catch and providing appropriate<br />

storage space for specimens collected and retained by the observer.<br />

• Ensuring actions and equipment are consistent with fishing regulations and permit<br />

conditions.<br />

• Ensuring that captain or crew do not obstruct, intimidate, influence, or interfere with the<br />

observer or impede or delay observer duties. <strong>Observer</strong>s may not act as vessel crew.<br />

2.4.3 <strong>Observer</strong> Rights and Responsibilities<br />

The observer’s rights include:<br />

• Access to all areas and facilities of the vessel necessary to conduct observer duties,<br />

including the bridge, deck, areas used to process, weigh, and store fish, gear, and<br />

equipment..<br />

• Access to the vessel’s records including its logs and documentation for the purpose of<br />

records inspection, access to navigational equipment, charts and radios, and reasonable<br />

access to other information relating to fishing.<br />

• Access to and use of <strong>com</strong>munications equipment and personnel, upon request, for entry,<br />

transmission, and receipt of work related data or information.<br />

• Access to additional equipment, if present, to facilitate the work of the observer while on<br />

board the vessel, such as binoculars, electronic means of <strong>com</strong>munication, etc.<br />

• Access to the working deck during net or line retrieval and to specimens (alive or dead) in<br />

order to collect samples.<br />

• Notice of at least fifteen (15) minutes before fish are brought on board, unless the<br />

observer specifically requests not to be notified.<br />

• Access to food, ac<strong>com</strong>modations, medical facilities, and sanitary facilities of a reasonable<br />

standard equivalent to those normally available to an officer on board the vessel.<br />

• The provision of adequate space on the bridge or galley for clerical work and adequate<br />

space on the deck for observer duties.<br />

• Freedom to carry out their duties without interference, intimidation, or obstruction.<br />

The observer’s responsibilities include:<br />

• Acceptance and <strong>com</strong>pliance with agreed confidentiality rules and procedures with respect<br />

to the fishing operations of the vessels. Data, images and other information collected by<br />

the observer shall remain confidential and should be handled in a secure manner.<br />

• Maintenance of independence and impartiality at all times while on board the fishing<br />

vessel.<br />

• Documenting <strong>com</strong>pliance with the laws and regulations set by the managing agency.<br />

• Respecting the hierarchy and general rules of behavior that apply to all vessel personnel.<br />

• Performance of duties in a manner that minimizes interference with fishing operations.<br />
