Act,1975 and also in accordance with the Statutory Master Plan/Zonal Development Plans along with the existing Government Orders, Rules and Regulations, which are in force. The Mandal Revenue Officer, Tirupati Urban Mandal in the reference 4 th cited has certified that the lands covered by the Layout are patta lands. The applicant has submitted the detailed Layout plan along with measurement vide letter 3 rd cited, dated 18-10-06 duly demarcating on ground the proposed road network, plotted area and open spaces in the said land to an extent of 9.00 Ac. As per the Layout Rules, the applicant executed a Registered Mortgage Deed No.5071/06, dated 12-10-06 in favour of Vice-Chairman,T.U.D.A., for the plot Nos. from 4 to 25 part and 51 part to 53 to an extent of 1.38.42 Ac. Hence, the applicant has fulfilled all the layout conditions the layout in Survey 210/3, 4, 5, 6 and 7, 205/2,3 and 209/1 of Chennaiahgunta Village, Settipalli Gram Panchayat of Tirupati Urban Mandal is hereby approved in L.P.No.69/G1/06 and is hereby communicated subject to the following conditions. 1) The applicant/Layout Owner/Developer is hereby permitted to sell the Plot Nos. from 1 to 3 and 25 part to 51 part and 54 to 87 2) The applicant is not be permitted to sell the plots/area which are mortgaged in favour of T.U.D.A. i.e. from plot Nos. 4 to 25 part and 51 part to 53 document NO.5071/06, dated 12-10-06 and the local authority shall ensure than no development like buildings authorized or unauthorized should come up in the site. 3) This permission for developing the land shall not be used as proof of the title of the land. 4) The applicant shall solely be responsible for the development of Layout and in no way T.U.D.A. will take-up development works. 5) The deed of Mortgage by conditions of sale executed by the applicant in favour of T.U.D.A. is purely a measure to ensue compliance of the conditions of development of infrastructure by the applicant/developer and T.U.D.A. is no way accountable to the plot purchaser in the event of default by the applicant/developer.

6) In case the Applicant/Developer fails to develop the layout area with the<br />

infrastructure facilities as specified by T.U.D.A. the area so mortgaged in<br />

favour of shall be forfeited and also T.U.D.A. has every right to take Criminal<br />

action against such Applicant/Developer as per the Provisions of<br />

A.P.U.A.(Dev.)Act,1975.<br />

7) The Layout development works consists of road formation with W.B.M.,<br />

Drainage channels, Cross Drainage works, Boundary pillars all round the Park<br />

Avenue Plantation, Mass Plantation in the area and Rain Water Harvesting<br />

Pits and trenches as per the specifications enclosed.<br />

8) Boundary pillars all round the park shall be constructed at 20’ C.C. as per the<br />

specifications and also to construct Rain Water Harvesting pit and trench<br />

alround the park area.<br />

9) It is responsibility of the Layout Owner to provide water supply and electricity<br />

in the Layout and T.U.D.A. is no way concerned in this regard.<br />

10) The Electric lines/Telephone lines if any passing across the Layout, have to<br />

be shifted to the proposed road margins before releasing the final layout.<br />

11) The layout applicant is directed to complete the above developmental works<br />

within a period of one year i.e. by 3-11-2007 and submit a requisition letter<br />

for releasing of mortgaged plots/area which is in favour of Vice-<br />

Chairman,T.U.D.A. duly enclosing letter of local authority and Gift Deeds etc.,<br />

with a regard to Roads, Open space taken over by the local authority along<br />

with the Gram Panchayat Resolutions.<br />

12) The applicant is permitted to sale the plots, other than mortgaged plots as<br />

mentioned in item No.(2) above.<br />

13) The Layout applicant shall display a board at prominent place in the above<br />

site showing the layout pattern with permit L.P.No.69/G1/06 and with full<br />

details of the layout specifications and conditions to facilitate the public in the<br />

matter.<br />

14) The local authority should ensure that the open space shall be developed by<br />

the applicant along with other developments.<br />

15) The local authority shall ensure that areas covered by roads and open spaces<br />

of the layout shall be taken over from the applicant, by way of Registered Gift<br />

Deed before release of Layout to the applicant, duly collecting necessary<br />

charges and fee as per the rules in force.<br />

16) Proportionate Betterment charges from the individual plot owners shall be<br />

collected for provision of amenities and faculties in the layout.<br />

17) The permission of layout development shall remain valid for one year during<br />

which the layout work shall be completed and if not completed or<br />

commenced the permission can be revalidated on application to rules then in<br />

force and on payment of 20% of the fee and charges.<br />

18) Other conditions :<br />

The party has to pay Amenities cost of Rs.7,19,000/-or than prevailing<br />

market value, which ever is higher before final confirmation of layout failing<br />

which 2% of plotted area in the layout has to be registered before<br />

relinquishment of mortgage property by this Authority.<br />
