Chairman Tucker called the meeting to order at 9:31 a.m.<br />

Chairman Tucker led the Pledge of Allegiance and gave the invocation.<br />

1. Building Official’s Comments<br />

Mr. Rune Lero spoke in reference to the fee schedules that were approved by the Board<br />

of <strong>County</strong> Commissioners. The new fee schedule will take effect on July 1, 2008. Mr.<br />

Lero advised the Board there was information available regarding the fee schedule in<br />

the Permitting Offices as well as the web portal.<br />

Hearing of Appeals<br />

1. PCCB2008-228 Joseph Soto<br />

Mr. Lero read the case into the record.<br />

Mr. Joseph Soto stated his name for the record. He understood the reason for denial<br />

was because of his financial situation. He stated he had documentation to show he<br />

could pay his expenses.<br />

Mr. Lero explained that Mr. Soto had originally presented proof of his work experience,<br />

5 years with one company, which was acceptable. The financial statement that Mr.<br />

Soto presented was very brief; however it met minimum criteria for the Board for his net<br />

worth. Mr. Lero stated the reason for denial was because of Mr. Soto’s credit report,<br />

which was very poor.<br />

Mr. Soto explained the reasons for the credit report’s history status and stated he was<br />

only 25 years old.<br />

Mr. Carroll asked Mr. Soto if he had anything to present that the <strong>County</strong> had not already<br />

received.<br />

Mr. Soto said he had paid everything off since his denial but he had no proof of<br />

documentation to present.<br />

MR. STEVENSON MOVED to uphold the Building Official’s decision; MR. CURRIE<br />

SECONDED.<br />

V. Request for Reduction of Fines / Extension of Time<br />

1. CCEB2006-196 Teresita Tiglao<br />

REQUEST FOR EXTENSION ON PAYING FINE<br />

Mr. Lero read the case into the record.<br />

Ms. Terresita Tiglao stated her name for the record. Ms. Tiglao requested that her fine<br />

be reduced due to the recent death of her daughter. She was limited on funds due to<br />

medical bills.<br />

Mr. Lero explained the history of the case which was originally heard by this Board on<br />

August 16, 2006. The violation was for un-permitted irrigation on the site. The Board<br />

gave Ms. Tiglao 30 days to obtain an irrigation permit or face a $100 per day fine. The<br />

case moved forward to 490 days of non-compliance; fines have accrued to $49,000.00<br />

plus interest and filing fees. The Board heard a request on February 20, 2008 for a<br />

reduction of fines. The action of the Board was a $250.00 fine payable in 90 days,<br />

which was due on May 20, 2008 or the fine would revert back to the original fine.<br />

Discussion followed regarding the reason for non-compliance and reducing the fines.<br />

Chairman Tucker confirmed that the homeowner was asking that the fine be further<br />

reduced from $250.00 to $100.00 and would have until the end of July to pay the fine.<br />

Ms. Tiglao again asked that it be reduced to $100.00.<br />

Mr. Carroll explained to Ms. Tiglao that the Board was working with her; technically she<br />

owed the original $49,000.00.<br />

MR. CURRIE MOVED to reduce the fine to $150.00 due by July 31, 2008 or it would<br />

revert back to the original $49,000.00; MR. BLACK SECONDED.<br />

2. CCEB2007-179 Elsa Larson<br />

REQUEST FOR WAIVER/REDUCTION OF FINE<br />

Mr. Lero read the case into the record.<br />

Ms. Elsa Larson stated her name for the record. She stated that most of the issues at<br />

hand were something she could have avoided. The contractor, who originally placed<br />

the doublewide mobile home in place in July, 2005 did not put it together and it got<br />

damaged during the rain storms. She stated the history of her case and her dealings<br />

with repairs to the mobile home as well as with the <strong>County</strong>. She was originally told she<br />

couldn’t get a demolition permit because the trailer was too old and she couldn’t keep it<br />

there. She went back to the <strong>County</strong> in February, 2008 to get a demolition permit and<br />

was asked why she wanted to remove it. She has since been approved for the permit<br />

to place the mobile home there. In the meantime, fines have been assessed and<br />

accruing for non-compliance.<br />

Mr. Lero explained this was a PID that came to him in March, 2007 and heard by the<br />

Board on June 20, 2007. At that time, the Board allowed 60 days to obtain the permit or<br />

face a $100.00 per day fine. The fine amount at this time is 268 days of noncompliance<br />

with a total of $26,800.00 plus interest and filing fees.<br />

Chairman Tucker asked if it was in compliance now.<br />

Mr. Lero stated the Board Order was they obtain a permit which they have done, so the<br />

fine was stopped on May 15, 2008; the day prior to the issuance of the permit.<br />

Chairman Tucker confirmed that all they were dealing with now was the fine.<br />

Mr. Carroll asked if Ms. Larson had documentation that the <strong>County</strong> had sent her to<br />

show that she tried to stay on top of this.<br />

Ms. Larson stated she had a lot of documentation.<br />

CHAIRMAN TUCKER MOVED to review the documentation and move it into evidence;<br />

MR. BLACK SECONDED.<br />

Discussion followed regarding the evidence submitted by Ms. Larson.<br />

Mr. Lero read the case into the record.<br />

Mr. Bobby Morrow stated his name for the record. He explained originally he required<br />

an extension because he now had the permit for the pool. He had applied for a<br />

Vacation of Easement but he was told by Lisa in the Real Estate Department that they<br />

no longer accepted them because the new <strong>County</strong> Attorney had several on file and was<br />

going to try something new. He iwas scheduled to go before the BOCC on July 8, 2008<br />

to request a Revocable Utility Easement Permit. He still had to obtain a permit through<br />

the <strong>County</strong> which had been applied for.<br />

Chairman Tucker asked how much time he needed.<br />

Mr. Morrow said he was not sure how long it would take after going before the BOCC.<br />

He felt 30 to 60 days after the 8 th of July would be sufficient.<br />

Mr. Lero recommended Mr. Morrow he be given 90 days to come into compliance. He<br />

stated there were no fines as of yet; today was the due date.<br />

Mr. Carroll asked Mr. Lero if he could confirm the process Mr. Morrow was talking about<br />

was factual.<br />

Mr. Lero said it was correct that the Revocable Easement was a new concept. If the<br />

<strong>County</strong> needed to come through the area for something down the road and Mr. Morrow<br />

had anything in the way, they would to do whatever they needed to do to continue and<br />

Mr. Morrow was aware of this. He also pointed out that behind Mr. Morrow’s home was<br />

swamp and doubted that it would ever be a major issue.<br />

Chairman Tucker stated the recommendation from the <strong>County</strong> of allowing 90 days.<br />

Chairman Tucker asked the applicants to confirm they resided at the same address and<br />

that they were asking for a reduction of fine and to state their reason.<br />

Mr. Loucks stated the <strong>County</strong> had sent them a letter informing them that they had not<br />

pulled permits on building a shed. The property that was in question had an object that<br />

was a pipe frame put up previously and had been there about 15 years.<br />

Discussion followed regarding terms of compliance and exact requirements needed for<br />

compliance. Further discussion followed regarding the history on the case and <strong>County</strong>’s<br />

recommendations on reducing fines.<br />

revert back to the original fine; MS. SODERLAND SECONDED.<br />

Ms. Courtney McCoy, representative for the applicant, stated her name for the record.<br />

She said the homeowner was requesting the extension because they needed a<br />

Vacation of Right-of-Way. They had been held up because the survey that was<br />

originally submitted was not acceptable to the <strong>County</strong> so that had to be re-done. The<br />

issue with the taxes was paid by the applicant’s bank and they were waiting for proof<br />

from the <strong>County</strong>. She requested an extension of 120 days.<br />

fines assessed were $1,350.00. Mr. Perkins had stated in his letter the reasons for noncompliance<br />

were financial and medical issues and had requested an extension.<br />

MR. CURRIE MOVED to waive the existing fine and allow 6 months to come into<br />

compliance or face $150.00 per day fine; MR. STEVENSON SECONDED.<br />

Chairman Tucker called on the motion; the motion carried with Mr. Carroll, Mr. Gottberg<br />

when he purchased the property; he installed a spa inside the room which required<br />

taking the doors down so he put drywall over the existing metal and stuccoed it.<br />

Discussion followed regarding the reason for the violation and requirements needed to<br />

be in compliance. Further discussion followed regarding the <strong>County</strong>’s<br />

recommendations. Mr. Aaron was informed that he was not being told he had to demo<br />

the structure; he could can do one of two things, either obtain proper permitting or demo<br />

the structure.<br />

Mr. Lero stated he would like a motion to authorize the Chairman to sign the liens for<br />

case numbers CCEB2006-217, CCEB2007-240, CCEB2006-209, CCEB2007-198 and<br />

CCEB2004-168.<br />

Chairman Tucker called on the motion; the vote was unanimous and the motion carried.<br />

Chairman Tucker asked Mr. Lero if he would like to bring before the Board the<br />

information he had mentioned earlier regarding the fee schedule.<br />

Mr. Lero said yes and displayed fee scheduled on the overhead projector. Discussion<br />

followed regarding the fees applicable to come before the Board effective July 1, 2008.<br />

Further discussion followed regarding the time length to come before the Board and inprogress<br />

permitting.<br />

Mr. Lero stated that in December, 2007, the 180 days was put into place to include<br />

inspections for recommendations and motions. He said today was the 180th day and<br />

that he would bring more information before the Board in July.<br />

Mr. Carroll commented on approximately thirty percent of the cases were in compliance.<br />

Mr. Lero stated that the Board only saw about twenty-five percent of cases; the other<br />

seventy-five percent usually took care of themselves prior to the hearings.<br />

Mr. Black asked what about the people who plead “no funds”.<br />

Mr. Lero stated that the decision was up to this Board.<br />
