Forms <strong>of</strong> State Support<br />
A pronounced change <strong>in</strong> <strong>the</strong> approach to state <strong>support</strong> <strong>for</strong> pr<strong>of</strong>essional artistic life s<strong>in</strong>ce<br />
1992 occurred with <strong>the</strong> <strong>in</strong>itiation <strong>of</strong> grant proceed<strong>in</strong>gs to subsidise pr<strong>of</strong>essional <strong>arts</strong>, <strong>in</strong>itially <strong>in</strong>tended<br />
only <strong>for</strong> civic associations. After experience with runn<strong>in</strong>g grant proceed<strong>in</strong>gs <strong>for</strong> civic associations,<br />
<strong>in</strong> 1996 <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Culture opened <strong>the</strong> grant proceed<strong>in</strong>gs to o<strong>the</strong>r legal and physical<br />
persons. The <strong>in</strong>troduction <strong>of</strong> Act No. 479/2003 Coll., amend<strong>in</strong>g Act No. 218/2000 Coll., on<br />
Budgetary Rules and on Amendments to Certa<strong>in</strong> Related Acts (Budgetary Rules), as subsequently<br />
amended, Act No. 337/1992 Coll., on <strong>the</strong> Adm<strong>in</strong>istration <strong>of</strong> Taxes and Fees, as subsequently<br />
amended, and Act No. 353/2003 Coll., on Excise Duties, <strong>the</strong> range <strong>of</strong> potential grant recipients<br />
was expanded to <strong>in</strong>clude also foundations and endowment funds. Ow<strong>in</strong>g to <strong>the</strong> large number<br />
<strong>of</strong> applications <strong>the</strong> grant proceed<strong>in</strong>gs were limited from <strong>the</strong> outset by pre-specified eligibility<br />
terms.<br />
The State Fund <strong>of</strong> Culture <strong>of</strong> <strong>the</strong> Czech Republic<br />
The State Fund <strong>of</strong> Culture <strong>of</strong> <strong>the</strong> Czech Republic was founded <strong>in</strong> 1992 (Act No.<br />
239/1992 Coll., on <strong>the</strong> State Fund <strong>of</strong> Culture <strong>of</strong> <strong>the</strong> Czech Republic, as subsequently amended)<br />
as ano<strong>the</strong>r extra-budgetary source <strong>of</strong> fund<strong>in</strong>g <strong>in</strong> <strong>support</strong> <strong>of</strong> <strong>the</strong> <strong>arts</strong>. Although <strong>the</strong> act stipulates<br />
that <strong>the</strong> Fund is able to obta<strong>in</strong> <strong>support</strong> from <strong>the</strong> state budget, its goal is to obta<strong>in</strong> fund<strong>in</strong>g primarily<br />
from sources o<strong>the</strong>r than at <strong>the</strong> expense <strong>of</strong> taxpayers. The basic problem <strong>of</strong> <strong>the</strong> Fund’s existence<br />
from <strong>the</strong> start has been <strong>the</strong> fact that <strong>the</strong> sources <strong>of</strong> fund<strong>in</strong>g directly stipulated <strong>in</strong> <strong>the</strong> act<br />
have proved ei<strong>the</strong>r <strong>in</strong>adequate or unrealistic <strong>for</strong> <strong>the</strong> Fund’s needs. The State Fund <strong>of</strong> Culture distributed<br />
fund<strong>in</strong>g <strong>for</strong> <strong>the</strong> first time <strong>in</strong> 2002, that is, ten years after it had been founded, when<br />
5 475 000 Czk was distributed <strong>in</strong> <strong>support</strong> <strong>for</strong> cultural projects. The Fund obta<strong>in</strong>ed this fund<strong>in</strong>g out<br />
<strong>of</strong> <strong>the</strong> proceeds from <strong>the</strong> EuroLotto number lottery and <strong>the</strong> “Meloun” scratch-card lottery run by<br />
<strong>the</strong> EuroLotto company. This lottery was un<strong>for</strong>tunately term<strong>in</strong>ated, however, ow<strong>in</strong>g to its commercial<br />
failure. In 2004 <strong>the</strong> Fund received a special donation <strong>of</strong> 20 000 000 Czk, with which it<br />
was able <strong>in</strong> 2005 to provide a total <strong>of</strong> 10 000 000 <strong>in</strong> <strong>support</strong> <strong>for</strong> 111 projects selected <strong>in</strong> a second<br />
application procedure; it will distribute <strong>the</strong> second half <strong>of</strong> <strong>the</strong> donation <strong>in</strong> a third application<br />
procedure <strong>in</strong> 2006. In 2004 <strong>the</strong> Fund acquired adm<strong>in</strong>istrative competence over <strong>the</strong> National<br />
House <strong>in</strong> V<strong>in</strong>ohrady, on <strong>the</strong> condition that <strong>in</strong>come from rent would be used to <strong>support</strong> cultural<br />
projects <strong>in</strong> subsequent years. At present <strong>the</strong> Fund cont<strong>in</strong>ues to manage two properties owned<br />
by <strong>the</strong> state – U HybernÛ House and <strong>the</strong> House <strong>of</strong> <strong>the</strong> Black Madonna. U HybernÛ House has<br />
been leased <strong>for</strong> a fifty-year term to Hybernia a. s., which is currently reconstruct<strong>in</strong>g <strong>the</strong> build<strong>in</strong>g<br />
<strong>in</strong>to a music <strong>the</strong>atre, which it will <strong>the</strong>n also operate. S<strong>in</strong>ce December 2003 <strong>the</strong> House <strong>of</strong> <strong>the</strong><br />
Black Madonna has been home to <strong>the</strong> National Gallery <strong>in</strong> Prague’s permanent exhibition <strong>of</strong><br />
Czech Cubism. The ground and underground floors have been leased at market price to tenants,<br />
and on <strong>the</strong> first floor <strong>the</strong> orig<strong>in</strong>al Cubist cafe has been reopened.<br />
Ano<strong>the</strong>r source <strong>of</strong> <strong>in</strong>come, pursuant to § 26 par. 2 <strong>of</strong> <strong>the</strong> Copyright Act, Act No. 121/2000<br />
Coll. on Copyright, on Rights Related to Copyright and on Amendments to Certa<strong>in</strong> Acts (<strong>the</strong> Copyright<br />
Act), as amended <strong>in</strong> Act No. 81/2005 Coll., whereby Act No. 121/2000 Coll. is amended,<br />
is <strong>the</strong> <strong>in</strong>come from <strong>the</strong> exercise <strong>of</strong> <strong>the</strong> ownership rights <strong>of</strong> authors and per<strong>for</strong>m<strong>in</strong>g artists that<br />
have passed by escheat to <strong>the</strong> state.<br />
After <strong>the</strong> found<strong>in</strong>g responsibilities <strong>for</strong> <strong>the</strong> basic network <strong>of</strong> <strong>the</strong>atres and symphony orchestras<br />
was transferred from state adm<strong>in</strong>istration to <strong>the</strong> regional authorities, and after <strong>the</strong> new tax<br />
system was adopted <strong>in</strong> 1993, <strong>the</strong> state lost its <strong>in</strong>fluence on fund<strong>in</strong>g <strong>the</strong> regional activity <strong>of</strong> <strong>the</strong>se<br />
organisations. This generated a need <strong>for</strong> <strong>the</strong> renewal <strong>of</strong> direct state <strong>support</strong> <strong>of</strong> regional <strong>the</strong>atres<br />
and symphony orchestras. For this reason <strong>in</strong> 1996 <strong>the</strong> Programme <strong>for</strong> <strong>the</strong> Support <strong>of</strong> Czech<br />
Theatres (Program podpory ãesk˘ch divadel) was launched, and <strong>in</strong> 1997 <strong>the</strong> Programme <strong>for</strong> <strong>the</strong><br />
Support <strong>of</strong> Symphony Orchestras and Choirs (Program stál˘ch symfonick˘ch orchestrÛ a pûveck˘ch<br />
sborÛ). For f<strong>in</strong>ancial reasons <strong>the</strong> Programme <strong>of</strong> State Support <strong>for</strong> <strong>the</strong> Exhibition <strong>of</strong> Contemporary<br />
Art <strong>in</strong> Galleries, Museums and Exhibition Halls has not yet been launched.<br />
