Corporate Profile<br />
The <strong>Malaysian</strong> <strong>Timber</strong> <strong>Certification</strong> <strong>Council</strong> (MTCC) is an independent organisation established in<br />
October 1998 to develop and operate the voluntary <strong>Malaysian</strong> <strong>Timber</strong> <strong>Certification</strong> Scheme (MTCS).<br />
Incorporated under the Companies Act 1965 as a company limited by guarantee, MTCC is governed<br />
by a Board of Trustees and started its operation in January 1999.<br />
MTCC’s main activities are to:<br />
• Be the national governing body (NGB) which has overall responsibility for the MTCS<br />
• Support the standard-setting process by serving as the secretariat to the appropriate standard<br />
setting body in formulating standards related to timber certification and keeping them under<br />
review periodically<br />
• Process applications for MTCS notification of <strong>Certification</strong> Bodies (CBs) operating forest<br />
management system and/or chain-of-custody certification and issuance of logo usage licences<br />
to Certificate Holders<br />
• Implement a procedure for the investigation and resolution of disputes, complaints and appeals<br />
related to its role as the NGB<br />
• Liaise closely with the national accreditation body and other certification organisations in matters<br />
related to timber certification<br />
• Coordinate with national, regional and international bodies related to timber certification to<br />
facilitate cooperation and mutual recognition arrangements<br />
• Conduct programmes to promote and publicise the MTCS, both locally and internationally
Board of Trustees<br />
The Board of Trustees, comprising the Chairman and ten other members, is the governing body which decides the<br />
overall policy and direction in carrying out MTCC’s activities. In addition to the Chairman, the members comprise<br />
of two representatives each from academic and research institutions, the timber industry, social and environmental<br />
non-governmental organisations (NGOs) and government agencies.<br />

Soon after it commenced operational activities in 1986, the International Tropical <strong>Timber</strong> Organization (ITTO)<br />
commissioned a study to establish a baseline on the state of tropical forest management. The findings of<br />
the study were most alarming. Only about one million hectares of tropical forests could be described as<br />
being under sustainable management. There was then, no forest certification to determine with any certainty<br />
whether the one million hectares could be certified in accordance with current principles and standards. Such<br />
a finding shocked and galvanized the International Tropical <strong>Timber</strong> <strong>Council</strong> (ITTC) into action to assist producer<br />
member countries to implement sustainable forest management (SFM) through policy initiatives and project<br />
activities funded by the ITTO’s small donor community.<br />
Some 25 years later, on 7 June <strong>2011</strong>, the ITTO released another report. There was improvement, but hardly<br />
encouraging. It was found that about 30.6 million hectares were under management, out of which only 17 million<br />
hectares were certified. Malaysia accounted for 5.0 million hectares, or about 35 per cent of its permanent<br />
reserved forests. Amongst ITTO’s 33 producer member countries, Brazil, Gabon, Guyana, Malaysia and Peru<br />
were reported to be making notable progress. These statistics must be situated within and in the context of the<br />
forest area in ITTO’s 33 producer member countries which totalled an estimated 1.42 billion hectares. Apparently,<br />
implementation of sustainable management and certification of tropical forest is most challenging in spite of the<br />
best efforts of tropical countries, the international community, the many organizations and all stakeholders with<br />
numerous initiatives.<br />
In view of the foregoing, impatience by certain countries and parties is understandable, but the ill-conceived<br />
earlier idea of calling for a boycott of tropical timber to cure the ills of tropical forestry is no longer heard. Now there<br />
is a wave of green consumerism demanding sustainable or legal timber. And this move is spreading and gathering<br />
momentum into a tsunami! Many developed countries demand sustainable or legal timber for public procurement<br />
with elaborate procedures and in some cases, ever-stringent standards. The United States of America is now<br />
implementing the amended Lacey Act which compels timber importers to deal only with legal timber in compliance<br />
with the laws of the exporting countries. To this end, timber importers need to undertake due care to ensure the<br />
legality of imported timber in order to avoid penalties. With similar objectives of combating illegal logging and<br />
trade in illegal timber, the European Union (EU) has enacted its <strong>Timber</strong> Regulation. When it comes into force on 3<br />
March 2013, all timbers imported into its member states will be subjected to due diligence to ensure their legality.<br />
However, exporting countries, which have concluded a Forest Law Enforcement Governance and Trade (FLEGT)<br />
Voluntary Partnership Agreement (VPA), may enter the EU markets through a ‘green lane’. At the heart of the VPA<br />
is the <strong>Timber</strong> Legality Assurance System (TLAS), listing all the relevant legislation of the exporting country which<br />
must be complied with. Like forest certification, an independent third party monitor will verify compliance with<br />
relevant legislation in the forestry and timber sectors identified in the TLAS. Malaysia is negotiating with the EU<br />
to conclude a VPA, whilst a few countries in Africa, and Indonesia, have concluded negotiations and are in various<br />
stages of finalizing institutional arrangements and procedures to implement their respective VPAs and TLASs.<br />
Malaysia’s home-grown certification scheme, the <strong>Malaysian</strong> <strong>Timber</strong> <strong>Certification</strong> Scheme (MTCS) was endorsed<br />
by the PEFC in 2009 after almost a decade of hard work. Also, substantial progress has been made in negotiations<br />
with the EU to conclude the FLEGT VPA. Malaysia has therefore gained considerable first-hand experience on<br />
issues related to timber certification for sustainability and verification for legality. Both are most challenging<br />
needing strong institutions, knowledge and resources, both human and financial, all of which are in short supply in<br />
developing tropical countries. And the difficulties are further compounded by the complexity of the tropical forest<br />
ecosystem and social issues, in addition to markets which are often less than remunerative.<br />
Undoubtedly, certification has contributed to sustainable forest management, which is both a difficult and longterm<br />
goal as indicated in the recently released ITTO report. Obviously, both are evolving processes with no instant<br />
solutions. The standard used in the MTCS, for example, needed to be reviewed and strengthened in order to reach<br />

the level for endorsement by PEFC. Even now it is not<br />
free from demands for more stringency from certain<br />
countries. But then certification is voluntary unlike<br />
FLEGT VPA, which is legally binding, once concluded<br />
and signed. The VPA focuses on legality which may<br />
be considered as a milestone to sustainability. Its<br />
implementation can therefore significantly contribute<br />
to achieving the long-term goal of sustainability<br />
– a goal that we all share. The VPA is perhaps the<br />
most promising initiative to assist tropical countries<br />
towards such a goal by establishing a baseline<br />
through the TLAS which is legally binding. And from<br />
such a baseline further progress can be made. Also,<br />
unlike certain initiatives, timber exporting countries<br />
are fully consulted on the development of the TLAS<br />
in addition to financial and technical assistance for<br />
capacity building provided by the EU.<br />
The small area of tropical forests certified to date<br />
must be indicative of the capacity of tropical countries<br />
to implement sustainable forest management and<br />
certification, irrespective of the scheme adopted. Will<br />
the EU FLEGT VPA, backed by the <strong>Timber</strong> Regulation,<br />
be more successful? If the requirements to be<br />
implemented are too cumbersome and stringent,<br />
it will have dire unintended consequences. Equally,<br />
requirements which are too ‘soft’ will not achieve the objective of delivering legal timber. Clearly, a judicious<br />
compromise will need to be struck between the realities on the ground and hence the capacity of tropical countries<br />
on the one hand, and the need for a credible system to ensure timber legality. Such a compromise, between<br />
what we wish to do and what we can do, will establish a baseline – legally binding on tropical countries – which<br />
can be strengthened from time to time based on experience, use of modern methods and technologies and<br />
most importantly, a positive market response. In such a complex situation, prudence will dictate that we aim for<br />
progress incrementally. If the requirements are so cumbersome and stringent, and beyond the capacity of tropical<br />
countries to deliver, the future of the tropical timber trade with the EU looks bleak. Let us pause and reflect on<br />
these issues to ensure the success of the FLEGT VPA which we must all agree has the potential to contribute to<br />
better tropical forestry.<br />
Many have rightly pointed out that tropical forests are in crisis. In presenting MTCC’s annual report for <strong>2011</strong>, I offer<br />
some personal thoughts on the way to make progress in which the EU FLEGT VPA offers a ray of hope if we all<br />
can work together cooperatively and with greater understanding on the problems of tropical forestry.<br />

Review of Operations<br />
The beginning of <strong>2011</strong> saw the Kelantan FMU<br />
successfully making the transition to be awarded<br />
a PEFC certificate. Therefore by February, all<br />
the nine existing holders of the Certificate for Forest<br />
Management, as well as 177 holders of the Certificate<br />
for Chain of Custody under the MTCS had been<br />
awarded the PEFC certificate which qualified them to<br />
use the PEFC logo, upon signing the logo usage licence<br />
agreement with MTCC. Following this development, the<br />
shipment of PEFC-certified timber products increased<br />
nearly ten times from 2,510 cubic metres in 2010 to<br />
23,052 cubic metres in <strong>2011</strong>.<br />
In line with the decision by PEFC International to use<br />
the revised international chain of custody standard,<br />
PEFC ST 2002:2010, with effect from 26 November,<br />
the process of auditing the holders of the Certificate for<br />
Chain of Custody to assess compliance with the new<br />
standard has started.<br />
Exports of timber products certified under the MTCS<br />
showed a slight increase from 72,267 cubic metres in<br />
2010 to 73,670 cubic metres in <strong>2011</strong>. The Netherlands<br />
remained as the largest market for timber products certified under the MTCS, accounting for 56% of the total<br />
exports. With the export performance in <strong>2011</strong>, the total cumulative volume of certified timber products exported<br />
under the MTCS reached 512,751 cubic metres.<br />
The process to review the <strong>Malaysian</strong> Criteria and Indicators for Forest Management <strong>Certification</strong> [MC&I(2002)] was<br />
successfully concluded in September with the finalisation and adoption of the revised standard by the Standards<br />
Review Committee (SRC). The revised standard is now renamed the <strong>Malaysian</strong> Criteria and Indicators for Forest<br />
Management <strong>Certification</strong> (Natural Forest) or MC&I(Natural Forest). The review process thus took 29 months<br />
(from April 2009 to September <strong>2011</strong>) involving three meetings of the SRC, three meetings of the Panel of Experts,<br />
three public comment periods and regional-level stakeholder consultations in Sabah, Sarawak and Peninsular<br />
Malaysia. MTCC is indeed grateful to all the stakeholder groups for their inputs in the form of comments and<br />
proposals during the various stages of the review process.<br />
MTCC’s activities in capacity building were continued, with the organisation of an auditor training course on<br />
the PEFC ST 2002:2010 conducted by PEFC International, which was followed by briefing sessions by MTCC<br />
on the same standard to certificate holders in Sabah, Sarawak and Peninsular Malaysia. Briefing sessions were<br />
also conducted for representatives of certified FMUs on the new documents related to the MC&I(2002) which<br />
were issued by MTCC in connection with the assessment of the MTCS by the <strong>Timber</strong> Procurement Assessment<br />
Committee (TPAC) in The Netherlands. In addition, briefing sessions on the MC&I(Forest Plantations) were<br />
conducted for interested managers of forest plantations.<br />

Review of Operations<br />
Activities to promote and widely publicise the MTCS as a PEFC-endorsed scheme were continued through<br />
participation and/or dissemination of publicity brochures in missions, business visits, seminars, trade fairs and<br />
exhibitions, through the MTCC Newsletter as well as through one-to-one discussions with key contacts by the<br />
MTCC or its public relations representatives.<br />
With regard to the assessment of the MTCS by the TPAC, the public hearing convened by the SMK Board of<br />
Appeal on the appeal lodged by MTCC against the TPAC’s Revised Final Judgement took place in August. MTCC<br />
however suffered a further set back when the Board of Appeal announced its decision in November to dismiss<br />
the appeal, thus ignoring the steps that have been taken by MTCC to address the non-compliances identified by<br />
the TPAC.<br />
During the course of the year, MTCC continued to contribute to other initiatives and activities which have linkage,<br />
either directly or indirectly, to its core responsibility of operating the MTCS. In this connection, MTCC spearheaded<br />
a project to formulate guidelines and procedures for social impact assessment (SIA) and monitoring of forest<br />
management operations. MTCC also participated in several projects and activities, i.e. (i) a pilot study on group<br />
certification of rubber small holdings under the MTCS, (ii) capacity building of companies for compliance with<br />
requirements for certification under the MTCS, (iii) on conservation of biodiversity through improved forest<br />
planning tools and (iv) the <strong>Malaysian</strong> Forest Dialogue which dealt with the development of a code of conduct for<br />
the timber industry. Another important contribution by MTCC is its participation in the discussions and stakeholder<br />
consultations related to the on-going negotiations between Malaysia and the EU on the FLEGT VPA.<br />
MTCC is grateful for the continued cooperation and support from the forest managers, timber companies,<br />
certification bodies, accreditation body, the forestry and timber-related agencies and representatives of the<br />
environmental, social and economic stakeholder groups in Sabah, Sarawak and Peninsular Malaysia towards<br />
its activities and initiatives in <strong>2011</strong>, in particular the review the MC&I(2002). MTCC looks forward to continue<br />
working with all parties concerned to achieve the common objective of the sustainable management of our forest<br />
resources.<br />

Forest Management <strong>Certification</strong><br />
Kelantan Forest Management Unit (FMU) was awarded with the PEFC accredited Certificate for Forest Management on 9<br />
February, bringing the total number of PEFC-certified FMUs to nine in <strong>2011</strong>.<br />
Details on the date of issuance of certificate, the CB involved, and the dates of the surveillance audits for the nine certified<br />
FMUs carried out in <strong>2011</strong> are as shown in Table 1.<br />

In terms of the extent of area certified, the nine FMUs cover a total of 4,646,068 hectares of Permanent Reserved Forests<br />
(PRFs) in Malaysia as shown in Table 2.<br />

Issuance of Two New Documents<br />
In connection with the Revised Final Judgement on the MTCS by the <strong>Timber</strong> Procurement Assessment Committee<br />
(TPAC) of The Netherlands, MTCC issued two new documents on specific aspects of the MC&I(2002) to the MTCSnotified<br />
CBs on 16 February as follows:<br />
(i) A normative document MC&I 2/<strong>2011</strong> – Interpretation of Criterion 6.10 of the MC&I(2002) to provide a clearer<br />
interpretation of Criterion 6.10 to address the concern that the allowable threshold for conversion of PRFs to forest<br />
plantations and non-forest land uses entailing “a very limited portion of the FMU” is not being quantified. This<br />
normative document supersedes the earlier document MC&I 2/2010 dated 7 April 2010.<br />
(ii) A guidance document MC&I 3/<strong>2011</strong> – Interpretation of the Term ‘Free and Informed Consent’ in the MC&I(2002)<br />
to provide clearer guidance on the interpretation of the term “free and informed consent” which is specified in several<br />
Criteria and Indicators.<br />
Subsequent to the issuance of the two documents, MTCC conducted four briefing sessions from April to May to inform<br />
the certified FMUs in Peninsular Malaysia with regard to the requirements of these two documents.<br />
Participants being briefed on the requirements of the MC&I(2002) including the<br />
two new documents and participation in field trip<br />
Chain of Custody <strong>Certification</strong><br />
In <strong>2011</strong>, 24 companies were awarded the PEFC Certificate for Chain of Custody by the five PEFC-notified CBs under the<br />
MTCS.<br />
Of this total, 10 certificates were issued by SGS (Malaysia) Sdn. Bhd., eight by SIRIM QAS International Sdn. Bhd., four by<br />
SGS South Africa Pty Ltd., and one certificate each by Moody International <strong>Certification</strong> (Malaysia) Sdn. Bhd. and Scientific<br />
<strong>Certification</strong> Systems.<br />
With the issuance of the new certificates and the withdrawal of the certificates issued to seven companies, the number<br />
of PEFC certificate holders increased to 177 by the end of <strong>2011</strong>. The full list of the holders of the Certificate for Chain of<br />
Custody issued by PEFC-notified CBs is as shown in Appendix I.<br />
Use of Revised PEFC CoC Standard<br />
At the 14 th PEFC General Assembly that was held on 12 November 2010 in Rio de Janeiro, Brazil, a number of changes<br />
to the PEFC <strong>Council</strong> documentation were adopted. The changes made are a result of the process undertaken by various<br />
Technical Working Groups (TWGs) since 2009 to revise and streamline the documentation with international requirements<br />
and specifications.<br />
The General Assembly had adopted the revised chain of custody standard entitled PEFC ST 2002:2010 Chain of Custody<br />
of Forest Based Products–Requirements.<br />

Operations<br />
The revised standard replaces Annex 4: Chain of Custody of Forest Based Products-Requirements of the Technical<br />
Document which has been used as the chain of custody standard under the MTCS since 2008. Chain of custody certificate<br />
holders were informed that Annex 4 will be withdrawn on 26 November, after a one-year transition period.<br />
The General Assembly had also adopted the second edition of the PEFC Logo Usage Rules (PEFC ST 2001:2008 v2). The<br />
document reflects the changes to the label claim text, as well as the treatment of recycled material, for labeling purposes.<br />
PEFC ST 2001:2008 v2 is applicable only to the PEFC Logo usage licence holders that have been certified against the<br />
PEFC ST 2002:2010.<br />
In order to provide a better understanding of the PEFC ST 2002:2010 and changes made in comparison to the Annex 4<br />
document as well as their implications, MTCC conducted a series of briefing sessions in <strong>2011</strong>. In Peninsular Malaysia, the<br />
briefing sessions were held on 6 October in Ipoh, 10 October in Kuantan and 20 October in Kuala Lumpur. In Sabah and<br />
Sarawak, the briefing sessions were held in Bintulu and Kota Kinabalu on 8 and 9 November, respectively. The briefing<br />
sessions were attended by a total of 180 representatives of holders of the Certificate for Chain of Custody under the<br />
MTCS.<br />
Issuance of MTCC Logo Usage Licence<br />
Seven applications for the MTCC Logo Usage Licence were approved by the Notification Committee in <strong>2011</strong>. The seven<br />
companies are:<br />

Export of <strong>Timber</strong> Products CERTIFIED UNDER MTCS<br />
The export of timber products certified under the MTCS in <strong>2011</strong> showed a slight increase, going up by 2% from<br />
72,267 m 3 in 2010 to 73,670 m 3 in <strong>2011</strong>. The United Arab Emirates (UAE) became the latest destination, adding<br />
to the existing list of 22 countries comprising The Netherlands, Belgium, Germany, UK, France, Australia, Greece,<br />
Denmark, Poland, Italy, Norway, Indonesia, South Africa, South Korea, USA, Japan, Mauritius, New Zealand, Albania,<br />
Ireland, Singapore and the Philippines.<br />
Out of the total 73,670 m 3 exported in <strong>2011</strong>, 56% or 41,935 m 3 reached The Netherlands, which continued to be the<br />
largest market for the certified products. The highest volume of 7,288 m 3 was exported in the month of May.<br />
Hence, by the end of <strong>2011</strong>, a total cumulative volume of 512,751 m 3 timber products certified under the MTCS had been<br />
exported, with The Netherlands as the largest market importing 261,758 m 3 (or 51%) of the total quantity exported since<br />
July 2002. The range of certified timber products includes sawn timber, plywood, mouldings, veneer, laminated fingerjointed<br />
timber, finger-jointed dressed timber (S4S), furniture and furniture components, door and window components,<br />
picture frames and parquet flooring.<br />
Figure 1 shows the export of timber products certified under the MTCS by month as well as the cumulative volume since<br />
July 2002. Figures 2 and 3 provide the percentage breakdown of the certified products exported in <strong>2011</strong> by product type<br />
and destination, respectively.<br />

The export of PEFC-certified timber products that started in September 2010 continued to increase, with a total of 23,052<br />
m 3 exported in the year <strong>2011</strong>. Six new destinations (Australia, Denmark, France, Germany, Japan and New Zealand)<br />
joined Belgium, Italy, The Netherlands, Norway, UK and USA as<br />
the countries importing such timber.<br />
The highest volume of PEFC-certified products exported was<br />
recorded in the month of May, totalling 3,209 m 3 . Of the total,<br />
45.6% or 10,519 m 3 reached The Netherlands, again making it the<br />
largest market for PEFC-certified products from Malaysia.<br />
Hence, by the end of <strong>2011</strong>, a total cumulative volume of 25,562<br />
m 3 of PEFC-certified products had been exported, with The<br />
Netherlands importing 12,002 m 3 (or 47%). The range of certified<br />
products exported comprise sawn timber, plywood, mouldings,<br />
laminated scantling, and woodchips, with plywood making up the<br />
highest volume (19,805 m 3 ) or 77.5% of the total exports.<br />
Figure 4 shows the export of PEFC-certified timber products<br />
by month as well as the cumulative volume since September<br />
2010. Figures 5 and 6 provide the percentage breakdown of the<br />
PEFC-certified products exported in <strong>2011</strong> by product type and by<br />
destination, respectively.<br />

Following the incorporation of comments received from the three Regional Consultations held in Sabah, Sarawak and<br />
Peninsular Malaysia, the Second Draft of the MC&I(Natural Forest) was reviewed by the Panel of Experts (PoE) on 27-28<br />
January.<br />
Subsequently, the Third Draft of the MC&I(Natural Forest) including the views of the PoE was considered by the Second<br />
Meeting of the Standards Review Committee (SRC) held on 16-18 March in Miri, resulting in the Final Draft of the<br />
MC&I(Natural Forest).<br />
The Final Draft was subjected to a Third (final) Public Comment period from 14 May – 12 July, resulting in further<br />
comments and proposals being received from the following stakeholder groups:-<br />

<strong>Certification</strong> Standards<br />
The Final Draft incorporating the comments received from the Third Public Comment period was considered by the Third<br />
Meeting of the SRC held on 20-22 September in Langkawi. The SRC finalised and adopted the MC&I(Natural Forest),<br />
which would replace the MC&I(2002) as the standard for forest management certification.<br />
Overall, the review of the MC&I(2002) had been conducted in an inclusive, participatory and transparent manner, with<br />
the various drafts of the MC&I(Natural Forest) being subjected to extensive consultations through three Public Comment<br />
periods and Regional Consultations, as well as review by the PoE and deliberation and consideration by the SRC, which<br />
met three times each in the course of the review process.<br />
Update on the Endorsement of MC&I(Forest Plantations) by the PEFC <strong>Council</strong><br />
In January 2010, MTCC submitted the MC&I(Forest Plantations) for endorsement by the PEFC <strong>Council</strong> to extend the<br />
scope of the PEFC-endorsed MTCS to cover forest plantations. Following an assessment against the ITTO Guideline<br />
for the establishment and management of planted forests (1993) and relevant sections of ITTO/IUCN Guidelines for the<br />
conservation and sustainable use of biodiversity<br />
in tropical timber production forests, the PEFC<br />
appointed consultant, Indufor Oy recommended<br />
to the PEFC <strong>Council</strong> in December 2010 the<br />
endorsement of the MC&I(Forest Plantations)<br />
under certain conditions.<br />
However, the PEFC Board of Directors which met<br />
on 4 February decided not to recommend the<br />
endorsement of the MC&I(Forest Plantations) to<br />
the PEFC <strong>Council</strong> General Assembly until MTCC<br />
submits evidence demonstrating compliance<br />
with Principle 12 and 13 of the ITTO Guidelines<br />
for the establishment and management of planted<br />
forests.<br />
In view of the fact that PEFC has adopted a new PEFC standard, i.e. PEFC ST 1003:2010: Sustainable Forest Management<br />
- Requirements which shall be used to assess all national forest management certification standard with an application<br />
date of May <strong>2011</strong> and transition date of May 2013, MTCC decided to subject the MC&I(Forest Plantations) to a new<br />
assessment by PEFC based on the requirements of the new PEFC standard. Subsequently, MTCC resubmitted the<br />
MC&I(Forest Plantations) to the PEFC <strong>Council</strong> on 20 July for assessment against the requirements of PEFC ST 1003:2010.<br />
Indufor Oy was again appointed as the consultant to undertake the assessment.<br />
Indufor Oy in its Final Report dated 5 September has recommended the endorsement of the MC&I(Forest Plantations) as<br />
part of the PEFC-endorsed MTCS, with condition that the PEFC <strong>Council</strong> takes a stand on how its policies on conversion<br />
are interpreted in the recently converted sites, i.e. between the period that the MC&I(Forest Plantations) was adopted<br />
under the MTCS in November 2008 and January 2010, which is the cut-off date for the conversion of forest areas<br />
regarded as high conservation value forest (HCVF).<br />
By end of <strong>2011</strong>, the PEFC Board has yet to make a decision on the endorsement of the MC&I(Forest Plantations).<br />

Training<br />
Training Course on PEFC ST 2002: 2010 - Chain of Custody of Forest Based Products<br />
– Requirements<br />

A training course on the revised PEFC International chain of custody standard, the PEFC ST 2002:2010, was held for<br />
auditors on 3 October in Kuala Lumpur. The main aim of the course was to brief the auditors with regard to the scope and<br />
requirements of the PEFC ST 2002:2010.<br />
The training course is also aimed at increasing the number of auditors who have a good understanding of the revised<br />
standard, to fulfil the requirement for eligibility to undertake audits under the MTCS.<br />
The course was attended by a total of 27 auditors representing PEFC-notified CBs [SGS (Malaysia) Sdn. Bhd., SIRIM<br />
QAS International Sdn. Bhd. and Moody International Sdn. Bhd.] as well as from other organisations [Saytech General<br />
Inspection Services Sdn. Bhd. and Forest Research Institute Malaysia (FRIM)]. Officers from the national accreditation<br />
body, STANDARDS MALAYSIA, also attended the course. The course was conducted by Christian Kammer, Technical<br />
Officer from the PEFC <strong>Council</strong>, Geneva.<br />

Economic Mission to Australia<br />
The Economic Mission to Australia led by the Minister of Plantation<br />
Industries and Commodities, Tan Sri Bernard G. Dompok, involved three<br />
main commodities (palm oil, timber and rubber) and was held from 24 July<br />
to 2 August with the following objectives:<br />
For the timber industry, the main objectives of the Working Visit were:<br />
(i)<br />
to discuss and exchange views with senior government officials and<br />
the media regarding issues pertaining to palm oil, timber and rubber<br />
industries and trade between Malaysia and Australia;<br />
Bilateral meeting between Tan Sri Dompok (left)<br />
and Senator Joe Ludwig, Minister for Agriculture,<br />
Fisheries and Forestry, Australia (right)<br />
(ii) to deliver the keynote address and officiate the Seminar on the<br />
<strong>Malaysian</strong> <strong>Timber</strong> Industry held in Melbourne and Sydney;<br />
(iii) to discuss and voice Malaysia’s views and concerns regarding the<br />
proposed Food Standards Amendment (Truth in Labelling – Palm Oil)<br />
Bill <strong>2011</strong>, and the draft Illegal Logging Prohibition Bill <strong>2011</strong>; and<br />
(iv) to further strengthen the export trade of palm oil, timber and rubber<br />
products to Australia.<br />

(NASH), as well as two Members of Parliament. MTCC was represented by the Senior Manager (Product), Harnarinder<br />
Singh.<br />
During the Mission, Tan Sri Dompok held a number of bilateral meetings with his Ministerial counterparts in Melbourne,<br />
Sydney and Canberra, participated in visits and media interviews, and officiated the Seminar on the <strong>Malaysian</strong> <strong>Timber</strong><br />
Industry.<br />
In Sydney, the Minister and delegation also had discussions with the Training and Further Education (TAFE) of New South<br />
Wales, one of the largest training institutes in Australia, and the Australian Trade Commission (AUSTRADE), the agency<br />
responsible for promoting the export of Australian products to the international market. In Canberra, discussions were<br />
held with the Australian Food and Grocery <strong>Council</strong> (AFGC) where the Minister explained Malaysia’s stand with regard to<br />
sustainable development of the palm oil industry.<br />
The Minister also led the Palm Oil Industry Dialogue held on 29 July in Sydney which was attended by 19 representatives<br />
from importers and users of palm oil and its derivatives. The Dialogue was held to discuss and convey Malaysia’s concerns<br />
on the proposed labelling of palm oil in food products sold in Australia, and provide clarification on the sustainable<br />
development of the palm oil industry in Malaysia.<br />
The Minister and his delegation also visited Canterbury Window and Door Manufacturers in Springvale, Melbourne, one<br />
of the largest manufacturer of wooden doors and windows that uses <strong>Malaysian</strong> timber; Holmesglen Institute, Chadstone<br />
Campus (Furnishing Industry Training Centre) in Melbourne, a vocational training institute that provides training to the<br />
workforce in the construction industry; and Bunnings DIY Centre in Mascot, Sydney that retails in construction and<br />
furnishing materials, including timber products and wooden furniture from Malaysia.<br />

During the Mission, much of the dialogue and discussions were focused on Malaysia’s views and concerns regarding<br />
the proposed Food Standards Amendment (Truth in Labelling – Palm Oil) Bill, and the draft Illegal Logging Prohibition Bill<br />
<strong>2011</strong>.<br />
The purpose of the Illegal Logging Prohibition Bill <strong>2011</strong> is for an Act to combat illegal logging, and to reduce the harmful<br />
environmental, social and economic impacts of illegal logging by prohibiting the importation and sale of illegally logged<br />
timber products in Australia. The Bill will require Australian timber importers to show proof that the timber and timber<br />
products imported into Australia have been sourced from legal sources, and is similar to the EU <strong>Timber</strong> Regulation that<br />
will only allow the importation of legal timber into the EU.<br />
In his bilateral meetings, Tan Sri Dompok informed that Malaysia has no objection to the implementation of this Bill, as<br />
long as it is non discriminatory and is applied to all types of timber products, and is not specifically for tropical timber<br />
products. He pointed out that Malaysia has developed and implemented a credible timber certification scheme, the<br />
MTCS, which has been accorded international recognition with the endorsement by the PEFC <strong>Council</strong> and is also in the<br />
final stages in developing the Voluntary Partnership Agreement (VPA) with the EU under the FLEGT process.<br />
The Minister officiated two seminars on the <strong>Malaysian</strong> timber industry in Melbourne on 26 July and in Sydney on 28 July,<br />
as part of the MTC’s Business Visit to Australia aimed at promoting the <strong>Malaysian</strong> timber trade and multi-use of timber<br />
species, updating on the forestry and sustainable forest management (SFM) practices in Malaysia, fostering close working<br />
relationship with the public and private sectors, and assuring Australian consumers and buyers that <strong>Malaysian</strong> timber<br />
products are manufactured from sustainable sources. The seminars were attended by participants representing local<br />
government agencies, timber industry, consumer associations and private companies in Australia. MTCC’s presentation<br />
at the seminars entitled The <strong>Malaysian</strong> <strong>Timber</strong> <strong>Certification</strong> Scheme (MTCS) – Your Assurance of Sustainable and Legal<br />
<strong>Timber</strong> touched on the operation of the MTCS, achievement in terms of certified areas and CoC companies, PEFC<br />
endorsement, recognition of the scheme internationally and export of PEFC-certified timber products from Malaysia.<br />
Business Visit to United State of America<br />
MTCC participated in a Business Visit to the United States of America on<br />
9 - 20 April organized by the MTC. The Visit, which covered the cities of<br />
Los Angeles, New Orleans and Memphis, was held in conjunction with the<br />
participation of a <strong>Malaysian</strong> delegation at the 55th World of Wood Convention<br />
of the International Wood Products Association (IWPA) which took place in<br />
New Orleans on 13 - 15 April.<br />
The main objectives of the Business Visit were:<br />

(ii) to promote <strong>Malaysian</strong> timber products and create awareness on the<br />

business opportunities; and<br />
(iv) to look into remanufacturing opportunities with USA manufacturers<br />
and explore the possibility for sourcing of American hardwood.<br />
The 12-member delegation comprised representatives from MTC, Sarawak<br />
<strong>Timber</strong> Industry Development Corporation (STIDC), Sarawak <strong>Timber</strong><br />
Association (STA), timber companies and MTCC’s representative, CEO<br />
Chew Lye Teng.<br />

Promotion<br />
The main objective for MTCC’s participation was to generate more awareness on the MTCS in the USA market and<br />
provide an update on the MTCS, particularly its endorsement by the PEFC.<br />
During the IWPA Convention, the presentation by MTCC highlighted the PEFC endorsement and international recognition<br />
of the MTCS. More than 260 participants attended the Convention including from overseas.<br />
MTCC also participated in the Seminar on <strong>Malaysian</strong> <strong>Timber</strong> Industry in Los Angeles organised for timber importers and<br />
distributors, and the discussion with the National Hardwood Lumber Association (NHLA) in Memphis, to highlight the<br />
latest development in the MTCS and the availability of PEFC-certified timber products from Malaysia.<br />
Updating Key Contacts in Germany<br />
On 2 - 8 November, CEO Chew Lye Teng took advantage of his attendance at the PEFC General Assembly in Montreux,<br />
Switzerland, to hold discussions with key contacts in Germany to update them on the latest developments in the<br />
MTCS.<br />
Discussions were held with federal ministries i.e. the Ministry for Food, Agriculture and Consumer Protection (which is<br />
in charge of the federal public procurement policy) and the Ministry for Environment, Nature Conservation and Nuclear<br />
Safety, associations i.e. the German <strong>Timber</strong> Trade Federation (GD Holz) and the Federal Association of the German DIY<br />
Stores and one of its members, Globus Boumarkt, ENGOs i.e. Association for the Protection of German Forests (SDW)<br />
and the department in charge of environment and forestry matters in the State of Bremen. Meetings were also held with<br />
a Member of the German Parliament (Bundestag), Georg Schirmbeck, who is also the President of the German Forestry<br />
<strong>Council</strong>.<br />
During these discussions the CEO highlighted the international recognition of MTCS as a PEFC-endorsed scheme,<br />
availability of PEFC-certified products and Malaysia’s leading position as a source of certified tropical timber products.<br />
The itinerary also included meetings with journalists from timber-related publications during the German <strong>Timber</strong> Day <strong>2011</strong><br />
in Cologne and visits to several project sites in Hamburg, where MTCS-certified laminated scantlings had been used in<br />
window frames.<br />

Four building projects involving the use of wooden windows made from MTCS-certified laminated scantlings have been<br />
built in Hamburg as a result of the full recognition of the MTCS by the City of Hamburg.<br />
Three of the projects by the wooden window manufacturer, Sehlmann, use MTCS-certified Dark Red Meranti laminated<br />
scantlings wooden windows type IV68 with historical special frames, wooden rungs window and sound insulating<br />
window of type IV78. In total, 730 wooden windows were installed in three buildings. Two of the buildings were heritage<br />

buildings in the centre of Hamburg where the refurbishment of the old heritage buildings were executed in co-operation<br />
with the Monument Protection Authority of Hamburg.<br />
The fourth project involved two different school buildings i.e. an elementary school and a district school. This project was<br />
co-financed between the wooden window manufacturer, Radbruch and the city of Hamburg. This project has resulted in<br />
a total of 234 wooden windows using MTCS-certified laminated scantlings being installed.<br />
There are other buildings which use MTCS-certified laminated window scantlings across Germany, e.g. in Kühlungsborn<br />
and Heidelberg.<br />

Recognition of MTCS<br />
As a PEFC – endorsed scheme, the MTCS has been accepted under the national timber procurement policies<br />
of Denmark, United Kingdom, Germany, Finland, Belgium, Switzerland and France as well as the Keurhout<br />
System of The Netherlands as meeting the requirements for sustainable timber.<br />
In addition, the authorities in the following countries and several Green building systems have recognised and<br />

green building schemes such as in Australia, Italy, Singapore, The<br />
Netherlands, UK, Canada, USA, Japan and Abu Dhabi, UAE.<br />
In addition, the Green Building Index (GBI) in Malaysia recognises the MTCS under its Sustainable <strong>Timber</strong> criteria.<br />

Recognition of MTCS<br />
Evaluation of MTCS by the <strong>Timber</strong> Procurement Assessment Committee of The<br />
Netherlands<br />
With regard to the assessment of the MTCS by the <strong>Timber</strong> Procurement Assessment Committee (TPAC) in The Netherlands,<br />
on 22 October 2010, the TPAC concluded that the MTCS had not conformed to the Dutch <strong>Timber</strong> Procurement Criteria<br />
for <strong>Timber</strong>. On 3 December 2010, MTCC filed a Notice of Appeal to the Board of Appeal against the TPAC Revised Final<br />
Judgement on the MTCS.<br />
Subsequent to the filing of appeal by MTCC, the Board of Appeal held a hearing on 5 August in Utrecht, The Netherlands.<br />
The hearing, involving MTCC (as appellant), TPAC (as respondent) and the Dutch civil society coalition which had lodged a<br />
conditional cross-appeal, was conducted by a three-member Board. Unfortunately, the Board in its 9 November decision<br />
upheld TPAC’s negative judgement of the MTCS and stated that it did not take into consideration any new development<br />
and improvement on the MTCS after the negative decision made on 22 October 2010.<br />
PEFC Related Activities<br />
PEFC 15 th General Assembly<br />
The 15 th General Assembly of the PEFC <strong>Council</strong>, held on 11 November in Montreux, Switzerland, was attended by<br />
approximately 100 Members and Extraordinary Members, invited guests and members of the Board of Directors.<br />
The report for 2010 by Ben Gunneberg, PEFC Secretary General, highlighted the increase of 16% (8,585) in the number<br />
of chain of custody certificates, the increase of 20% (12,086) in the number of companies covered, the increase of 6.5%<br />
(15 million ha) in the forest area certified (in Belarus, Latvia, Poland), the new members [Argentina, China, Russia (rejoined),<br />
Building and Woodworkers International, Earth Focus Foundation] and the new International Stakeholder Member<br />
applicant (APP <strong>Timber</strong>).<br />
On the implementation of the PEFC marketing plan, he highlighted the importance of the validation of public procurement<br />
policies, stressing that inclusive policies reduce risk, expand supply and ensure widest sourcing. In this connection, the<br />
TPAC process in The Netherlands was identified as being particularly challenging, with the appeal of the NGOs against the<br />
TPAC decision on acceptance of PEFC International being due to be heard in February 2012. The parallel process involving<br />
the MTCS was also mentioned. In independent initatives, such as ‘green building’ systems, the remaining challenge posed<br />
by the US Green Building <strong>Council</strong> was mentioned.<br />
Other important aspects highlighted in the 2010 report were the activities to expand PEFC’s profile, the growth of the<br />
scheme in Russia and Central Africa, standards revision, endorsements and re-endorsements (Austria, Belarus, Sweden,<br />
USA), capacity building, training and support.<br />
From MTCC’s viewpoints, the most important developments related to the 15 th General Assembly were (i) the presentation<br />
by Wang Wei, Chairman of the China Forest <strong>Certification</strong> <strong>Council</strong> (CFCC) the newly elected national scheme from China, (ii)<br />
the presentations by Dr. Dilip Kumar, Director General and Head of the Indian Forest Service and Special Secretary to the<br />
Government of India and Dr. Dradjad Wibowo, representing the Indonesian Forestry <strong>Certification</strong> Cooperation (IFCC), and<br />
(iii) the election of Mrs. Sheam Satkuru-Granzella, Director of MTC London as Vice-Chairman of the PEFC <strong>Council</strong>.<br />
The admittance of the CFCC as a member of the PEFC is a significant event, in view of China’s current position and role<br />
in the world economy and trade. In addition, if the interest shown by India is able to result in a decision at a later stage<br />
to join the PEFC, the presence of two of Asia’s largest economies will provide an important boost to PEFC’s profile and<br />
image in the Asia Pacific region.<br />

The keynote address for the Dialogue entitled Contributions of the<br />
Forest Sector in a Green Economy was presented by Professor Sten<br />
Nilsson, CEO of Forest Sector Insights AB, Sweden. He made the<br />

be the lead sector in the transformation to green economy;<br />
(v) It has to be proven that the new economy will be a quality and<br />
smart economy contributing to the consumer’s quality of life;<br />
(vi) The forest sector is ahead of most sectors on the sustainability path and can take the lead on the green economy<br />
path;<br />
(vii) The forest sector should demonstrate how it can contribute to the solutions of major societal concerns under a<br />
green economy;<br />
(viii) The forest sector should produce a concrete vision on how to green the economy with needed policy changes and<br />
implementation schedules; and<br />
(ix) The forest sector should establish innovation networks for greening of the economy and establish partnerships<br />
outside the conventional sector. R&D&D (design) & P (psychology – to convince) instead of just R&D.<br />

in Promoting the Sustainability of Forestry, Products and Trade (Panel 1), Incorporating Forest Values throughout the<br />
Production Chain (Panel 2) and Building on <strong>Timber</strong>: Latest Initiatives and Innovations to Position the Sector (Panel 3).<br />

Certified Forests Under Various <strong>Certification</strong> Schemes<br />
In the year <strong>2011</strong>, the total area of certified forest worldwide saw an increase to 394.03 million ha, up 5.2% from 2010<br />
(374.63 million ha).<br />
The 394.03 million ha certified forest represented nearly 10% of the total global commercial forest area. Of this total,<br />
245.13 million ha (62.2%) were certified under the PEFC scheme which included the MTCS (4.65 million ha or 1.2%),<br />
147.83 million ha (37.5%) under the FSC scheme, and 1.07 million ha (0.3%) under the Lembaga Ekolabel Indonesia (LEI)<br />
(Figure 7) 1 .<br />
The PEFC-certified forests in Europe accounted for 80.00 million ha. Outside Europe, besides the MTCS which accounted<br />
for 4.65 million ha, the PEFC-certified forests also included 56.88 million ha under the Canadian Standards Association<br />
(CSA), 90.35 million ha under the Sustainable Forestry Initiative (SFI) and American Tree Farm System (ATFS) of the USA,<br />
10.06 million ha under the Australian Forestry Standard (AFS), 1.91 million ha under the Chilean Standard for Sustainable<br />
Forest Management (CERTFOR), and 1.26 million ha under the Brazilian Programme of Forest <strong>Certification</strong> (CERFLOR).<br />
In terms of geographical distribution (Figure 8), still more than half (52.8%) of the world’s certified forests were located in<br />
North America, with around one-third (36.6%) in Europe. The certified forest area outside Europe and North America only<br />
accounted for 10.6% of the global total, of which 2.4% was in the Asia-Pacific region.<br />

<strong>Malaysian</strong> Forest Dialogue<br />
The <strong>Malaysian</strong> Forest Dialogue (MFD) Steering Committee, in which the MTCC is a member, once again organised a forum<br />
on 6-7 July in Kuala Lumpur with the theme Code of Conduct: Strengthening Confidence in the <strong>Timber</strong> Industry. The MFD<br />
<strong>2011</strong> was the fifth in the series of dialogues that had been held over the period 2006-2009. This time around, the Steering<br />
Committee chose to explore the potential of a code of conduct for the timber industry in Malaysia, as a means to provide<br />
guidance for responsible business practices that will help to enhance the industry’s reputation.<br />
Opinion leaders from various sectors, representing ethical business advocates, palm oil, pulp and paper, chemical, packaging<br />
and the food industry, shared their experiences on the development and promotion of a code of conduct. Representatives<br />
of timber industry associations and federations in the U.K., USA and The Netherlands, and a major timber products retailer<br />
from Australia, also spoke on how their codes of conduct were developed and applied.<br />
More than 150 participants representing the various relevant ministries and agencies, timber industry, forestry authorities,<br />
academia, banks, social and environmental non-government organisations (NGOs), and invited observers from Cambodia,<br />
China, Indonesia, Laos, Myanmar, Thailand and Vietnam attended the event.<br />
Tan Sri Bernard G. Dompok, Minister of Plantation Industries and Commodities, in his keynote address, highlighted that<br />
Malaysia is one of the five tropical timber producing countries that have been lauded by the ITTO as making notable<br />
progress in the implementation of SFM. The implementation of the MTCS since 2001 has contributed to this recognition.<br />
He suggested that the <strong>Malaysian</strong> timber industry should consider developing its code of conduct to provide confidence<br />
to consumers that the industry follows ethical business practices, where the timber and wood-based products are from<br />
legal and sustainable sources.<br />
The first day saw presentations that provided an overview of code of conduct in various sectors, and the key drivers for<br />
the code. The different Codes of Practices or Conduct of the mostly non-timber industries sectors presented showed<br />
that codes can range from a set of rules on proper business conduct of the sector or an organisation, an employee’s<br />
work behaviour, or an industry or company’s responsibilities towards its employees or to communities. When related to<br />

forestry, corporate codes of behaviour deal mainly with sustainability of forest resource, efficiency of material or energy<br />
use, product quality and resultant profitability. Having a code for the timber industry could be helpful in ensuring industry<br />
members’ compliance with consumers’ requirements for legality and sustainability status of their timber products.<br />
On the second day, speakers shared their experiences in developing and implementing a code of conduct. The UK<br />
<strong>Timber</strong> Trade Federation (TTF) informed that under its Responsible Purchasing Policy, risk assessments are systematically<br />
undertaken for its membership, and that members are committed to the TTF Code of Conduct and apply the Environmental<br />
Code of Practice as well in their wood procurement. The Royal Netherlands <strong>Timber</strong> Trade Association (NTTA) members<br />
have to abide by its policy that requires them to provide an annual statement of the volume of certified and verified legal<br />
timber imported. The American IWPA has its Code of Conduct and standards motivating its members who voluntarily<br />
agree to seek and provide the clearest practical information regarding product sources.<br />
The participants heard that developing a corporate code of conduct takes time and requires increasing engagement with<br />
a wide range of stakeholders and a commitment to responsibility, transparency and continuous improvement. The code<br />
needs to be communicated widely to the industry players.<br />
The panel discussions focused on the way forward for code of conduct, with diverse opinions expressed by the government,<br />
industry and NGO representatives. Questions on whether the market would pay a premium to compensate for the extra<br />
work and investment in coming up with a code, what gaps the code was intended to address, and why the industry needs<br />
to follow the dictates of the market, were posed. The Dialogue agreed that even though the code of conduct is not similar<br />
to certification, it is nevertheless a positive way to meet the expectations of the market, by evidence of commitment to<br />
good practices.<br />

The Tenth Meeting of the Working Group on a Pan ASEAN <strong>Timber</strong> <strong>Certification</strong> Initiative was held in Yogyakarta, Indonesia<br />
on 25-26 May. It was attended by delegates from six ASEAN Member States (AMS), i.e. Brunei Darussalam, Cambodia,<br />
Indonesia, Lao PDR, Malaysia and Myanmar, and the ASEAN Secretariat. A representative from the European Union (EU)<br />
FLEGT Asia Programme was also present to report on training activities related to the WG’s work carried out under the<br />
Programme.<br />
The Meeting was updated on the development of C&I for legality of timber, sustainable forest management/forest<br />
management certification and implementation of timber certification through the Country Reports presented by each<br />
AMS. The Meeting agreed that the AEC Score card be updated based on the Country Reports presented and submitted<br />
for consideration of the 14 th ASOF Meeting. The Meeting also discussed the targets within the AEC Blueprint and<br />
recognised that ASEAN would need to specify the requirements for legal and sustainable timber to be met by timber<br />

product manufacturers and exporters within the ASEAN market, as there are many existing initiatives already undertaken<br />
by the AMS, such as timber certification and EU-FLEGT VPA.<br />
The Meeting further agreed to look into the possibility of appointing a consultant to take stock of the existing initiatives<br />
and consider these initiatives as references to meet the targets set in the AEC Blueprint. Malaysia developed the first<br />
draft of the TOR for the consultant, which was circulated to the AMS in July for their comments and finalisation. The<br />
ASEAN Secretariat was also requested to inform the WG on the possibility of funding sources for this project and its<br />
implementation.<br />
The WG discussed the ASEAN Guidelines for CoC of Legal <strong>Timber</strong> and Sustainable <strong>Timber</strong> which had been endorsed<br />
by the 32 nd AMAF Meeting held on 23 October 2010 in Phnom Penh, Cambodia. The Meeting agreed to make slight<br />
amendments and circulate the draft artwork for publication to the AMS for finalisation.<br />
The FLEGT Asia Programme representative presented the outcome of the first Sub-Regional Training Workshop on<br />
<strong>Timber</strong> Legality Assurance Systems that was held in Hanoi, Viet Nam. The representative also proposed a similar training<br />
workshop for the Mekong region, based on the ASEAN C&I for timber legality. In relation to this, the second Sub-<br />
Regional Training Workshop was subsequently held on 25-27 October in Kota Kinabalu.<br />
Indonesia and Malaysia also shared their respective experiences on their negotiations with the EU on the VPA. The<br />
Meeting took note that the FLEGT-VPA between the EU and Indonesia had been concluded. There was also exchange<br />
of information on experiences related to the implementation of the Lacey Act and its impact, particularly on timber trade<br />
and export market.<br />
The WG participants visited a certified community forest and a certified community timber industry, to witness agroforestry<br />
practices. The environmental aspects that were emphasised included selective harvesting, replanting of harvested areas,<br />
no harvesting near water sources and no hunting of protected fauna.<br />

OTHER ACTIVITIES<br />
EU Forest Law Enforcement, Governance and Trade Voluntary Partnership Agreement<br />
(EU FLEGT VPA)<br />
Due to its involvement in the various aspects of SFM and CoC of certified timber products in the MTCS, MTCC continued<br />
to provide technical support to the ongoing negotiations between Malaysia and the European Union on the EU FLEGT<br />
Voluntary Partnership Agreement (VPA), especially related to the <strong>Timber</strong> Legality Assurance System (TLAS), which is one<br />
of the core components of the VPA. As part of this supporting role, MTCC participated in meetings of the relevant working<br />
groups, the National Steering Committee as well as the stakeholder consultations and briefings.<br />
Project on Formulation of Guidelines and Procedures for Social Impact Assessment<br />
and Monitoring of Forest Management Operations<br />
The project on the Formulation of Guidelines and Procedures for Social<br />
Impact Assessment and Monitoring of Forest Management Operations was<br />
conceptualised and implemented to take into account the need for the conduct<br />
and monitoring of social impact assessment (SIA) of forest management<br />
operations as prescribed in the MC&I(2002). The project which commenced<br />
in January 2010 was implemented by the Institute of Tropical Forestry and<br />
Forest Products (INTROP), Universiti Putra Malaysia (UPM).<br />
Four Project Technical Committee (PTC) meetings were held throughout<br />
the year to deliberate on the progress of implementation of the project.<br />
The Third Meeting of the PTC held on 5 May discussed the questionnaires<br />
taking into account the feedback received from the Stakeholder Workshop,<br />
while the Fourth Meeting held on 1 June deliberated on the first draft of the<br />
Guidelines.<br />
Fifth Meeting of the PTC<br />
The first draft was subjected to a one-month Public Comment period from<br />
22 July to 21 August. The comments received from the various stakeholder<br />
groups were considered and incorporated by INTROP resulting in the second<br />
draft of the Guidelines.<br />
The Fifth Meeting of the PTC held on 24 October deliberated on the second<br />
draft, resulting in the third draft. Additionally, the Fifth Meeting deliberated on<br />
the Project Final Report.<br />
Sixth Meeting of the PTC<br />
The Sixth Meeting of the PTC held on 15-16 December further deliberated on and finalised the third draft of the Guidelines.<br />
Besides the members of the PTC, four additional representatives from FDPM i.e. one each from the Pahang, Perak,<br />
Kelantan and Negeri Sembilan State Forestry Departments, also participated in the Sixth Meeting to provide their views<br />
regarding the practical aspects of applying the Guidelines in their respective FMUs. The Sixth Meeting agreed that a special<br />
meeting should be convened so that representatives from more State Forestry Departments as well as the Department<br />
of Orang Asli Development (JAKOA) could be invited to provide further feedback on the content and practicability of the<br />
Guidelines. The Meeting also agreed that the final draft should be subjected to one final round of public comment in early<br />
2012.<br />

OTHER ACTIVITIES<br />
Pilot Study on Group <strong>Certification</strong> of Rubber Smallholdings under MTCS<br />
Rubberwood is the main raw material used by the <strong>Malaysian</strong> furniture industry for the manufacture of wooden furniture<br />
and it is mainly harvested from small-holdings with an average area ranging from 1.5 – 3.0 ha.<br />
In view of the increasing demand by the international market for timber products, including furniture, that are certified for<br />
sustainability, and the relatively small size of the rubber small-holdings which render them uneconomic to undergo individual<br />
certification, the implementation of group certification of rubber small-holdings under the MTCS is being explored.<br />
The Pilot Study on Group <strong>Certification</strong> of Rubber Smallholdings under the MTCS has therefore been conceptualised and<br />
implemented with the following objectives:<br />
(i) Develop a manual on the requirements of the MC&I(Forest Plantations) and how rubber small-holders can meet<br />
these requirements under a group certificate;<br />
(ii) Develop the administrative arrangements for managing a group of small-holders for group certification under the<br />
MTCS; and<br />
(iii) Provide information on the cost of group certification of rubber small-holders under the MTCS.<br />
The project, to be implemented over 24 months, is spearheaded by MTIB in collaboration with the MTCC, MTC, MFPC,<br />
<strong>Malaysian</strong> Rubber Board, Federal Land Development Authority (FELDA), Rubber Industry Smallholders Development<br />
Authority (RISDA) and Federal Land Consolidation and Rehabilitation Authority (FELCRA). A project Group Manager has<br />
been appointed in December to oversee the implementation of the project which will be conducted in FELDA Bukit Rokan<br />
in Negeri Sembilan.<br />
Two committees have been formed to oversee the implementation of the project, i.e. a Project Steering Committee (PSC) to<br />
provide advice and overall decision-making pertaining to technical and financial matters, as well as to monitor the progress<br />
of project implementation; and a Project Technical Committee (PTC) to provide technical advice on the implementation of<br />
project activities.<br />
Throughout the year, the PSC met three times i.e. on 7 June, 6 December and 22 December while the PTC met once on<br />
13 September.<br />
Capacity Building for Compliance with Requirements for <strong>Certification</strong> under MTCS<br />
In order to boost the export and supply of certified timber products from Peninsular Malaysia, the <strong>Malaysian</strong> <strong>Timber</strong><br />
Industry Board (MTIB) embarked on a two-year project in <strong>2011</strong> funded under the <strong>Timber</strong> Industry Development Levy Fund<br />
(Tabung Levi Pembangunan Industri Kayu-Kayan Malaysia). The Project entitled “Capacity Building for Compliance with the<br />
Requirements for Chain of Custody <strong>Certification</strong> under MTCS” is aimed at increasing the number of PEFC-certified timber<br />
manufacturers and exporters in Peninsular Malaysia, as well as is aimed at providing financial assistance to the companies<br />
to obtain PEFC certification under the MTCS. The project was approved by the National Committee of the <strong>Timber</strong> Industry<br />
Development Levy Fund on 25 May <strong>2011</strong>.<br />
To provide more details of the project, a number of briefing sessions were conducted, with the first session held on 2<br />
November in Kuala Lumpur and the second in Ipoh on 15 December. More briefing sessions had been planned for 2012 to<br />
be held covering the other parts of Peninsula Malaysia. The briefing sessions covered overall information pertaining to the<br />
project (presented by MTIB); the requirements for legal and sustainable timber in the global market (presented by MTC);<br />
and details on obtaining PEFC CoC certification under the MTCS (presented by MTCC).<br />

OTHER ACTIVITIES<br />
<strong>Timber</strong> companies that participate in this project will be provided with incentives in the form of financial assistance to meet<br />
the cost of consultancy for up to a maximum sum of RM5,000 and will be reimbursed 60% of the total auditing cost or a<br />
maximum of RM6,000, whichever is lower, to achieve CoC certification.<br />
The consultancy services provided will assist the company in the preparation of the necessary documents such as the<br />
standard operating procedures (SOP), internal audit and management review reports that are needed by the company<br />
to comply with the CoC requirements for certification under the MTCS. The consultant will also provide training to the<br />
company staff.<br />
Conservation of Biodiversity through Improved Forest Planning Tools Project<br />
The main objective of the Conservation of Biodiversity through Improved Forest Planning Tools Project (or in short the<br />
CBioD project) is to develop tools and generate knowledge needed to ensure that forestry production systems are planned<br />
and managed in a manner which will contribute to biodiversity conservation.<br />
The five-year project is funded by contributions from UNDP-GEF, International Tropical <strong>Timber</strong> Organisation (ITTO), Forest<br />
Research Institute Malaysia (FRIM), University of Miami & Duke University, USA and Perak Integrated <strong>Timber</strong> Complex<br />
(PITC), and is implemented by FRIM with the Ministry of Natural Resources and Environment (NRE) as the national<br />
Executing Agency. The project which commenced in April 2007 is scheduled to be completed in 2012.<br />
MTCC is involved in the implementation of the project as a member of the Technical Working Committee (TWC) which<br />
provides advice on technical issues related to project implementation, as well as to provides a platform for engaging the<br />
relevant stakeholder groups, i.e. the Perak State Government, Forestry Department Peninsular Malaysia, NGOs and local<br />
universities. MTCC participated in two meetings of the TWC held on 23 March and 22 November.<br />
The project is implemented in the PITC concession area which comprises some 9,000 ha of hill forest within the Temenggor<br />
Forest Reserve in the state of Perak. The project is expected to yield the following major outputs:<br />
(i) Forest planners in Perak incorporate tools to measure impacts on biodiversity in their forest management<br />
planning;<br />
(ii) Forest planners in Perak utilise tools for full valuation of goods and services in their forest management planning<br />
and operations;<br />
(iii) Forest planners in Perak integrate ecological and economic tools in forest planning decisions at a landscape level;<br />
and<br />
(iv) Capacity exists to apply methods developed by the project in tropical forest management operations.<br />
A Hands-on Training for CBiod Rapid Biodiversity Assessment Toolkit was conducted on 11-15 April to help forest managers<br />
in assessing biodiversity using a standard and tested methodology.<br />
