which he appo<strong>in</strong>ted his bro<strong>the</strong>r, Alexander, his sole legatee {ih. 4i), and died un<strong>in</strong>. <strong>in</strong><br />

India, Sept. 1780 (J.W. 12). His name, <strong>the</strong>refore, though occurr<strong>in</strong>g <strong>in</strong> <strong>the</strong> entaiLs<br />

<strong>of</strong> 176G-69 and 178-5 is, like that <strong>of</strong> his brotiier John, expre.ssly omitted from <strong>the</strong><br />

entail <strong>of</strong> 1811 («< s«/).). His portrait <strong>in</strong> youth is at Birkhill.<br />

4. Henry Scrymgeour, who succeeded his eldest bro<strong>the</strong>r Alexander, as <strong>Wedderburn</strong><br />

<strong>of</strong> <strong>Wedderburn</strong>, <strong>in</strong> 1811. Sec post, p. 179.<br />

The five dauj,diters were,<br />

1, Grlzel ; 2, Janet ; 3, Grizel ; 4, Elizabeth<br />

; and 3, Marion. Of <strong>the</strong>se tiie eldest<br />

died, ffit. 3 and <strong>the</strong> three youngest also when quite young (J.W. 12), while <strong>the</strong><br />

second, and oidy surviv<strong>in</strong>g one,<br />

Janet Scrymgeour, was bom about 17-17, although she is not named <strong>in</strong> her fa<strong>the</strong>r's<br />

disposition <strong>of</strong> 1753, but only <strong>in</strong> that <strong>of</strong> 1763 («< sup.). She and her issue are<br />

named, after her bro<strong>the</strong>rs and <strong>the</strong> issue <strong>of</strong> her bro<strong>the</strong>r Henry, <strong>in</strong> all <strong>the</strong> entails <strong>of</strong><br />

1766— Itll (lit sup.). She married, 20 May 1776. after contract <strong>of</strong> 18 Maj-, <strong>in</strong><br />

which she is deMcril)ed as her fa<strong>the</strong>r's only surviv<strong>in</strong>g daughter, John Gillespie, sou <strong>of</strong><br />

Dr. John Gillespie <strong>of</strong> Kirktouu and Mountquhannie, co. Fife, and died at Birkhill<br />

18 March 1811 (J.W. 12),' hav<strong>in</strong>g had issue one son and three daughters, viz.,<br />

David (m, Mary, d. <strong>of</strong> (Jeorge Carnegie <strong>of</strong> I'itarrow), Margaret (m. Jame.s<br />

Carnegie), and Elizabeth and Mary Henrietta who d. unmarried.''<br />

Alexander Scrymgeour, afterwards <strong>Wedderburn</strong> <strong>of</strong><strong>Wedderburn</strong> [1742<br />

1811], He was born <strong>in</strong> 1742 (where, I have not ascerta<strong>in</strong>ed) and was bred to <strong>the</strong> law. On<br />

20 Dec. 1765 <strong>the</strong>re is a memorial for him to <strong>the</strong> Lords <strong>of</strong> Council and Session desir<strong>in</strong>g his<br />

trial to be remitted to <strong>the</strong> Uean and faculty <strong>of</strong> advo<strong>ca</strong>tes (S.W. vm., is., 92), which is, I<br />

suppose, <strong>in</strong> connection with his admission as an advo<strong>ca</strong>te. This took place <strong>in</strong> 1766<br />

(Adv. Adni. 6), after which he is constantly described as "advo<strong>ca</strong>te," eg., 9 June 1766,<br />

when he and his bro<strong>the</strong>r David witness a decreet arbitral made by <strong>the</strong>ir fa<strong>the</strong>r (D.C. 102).<br />

On 20 Feb. 1771, <strong>in</strong> view <strong>of</strong> his marriage, his fa<strong>the</strong>r made over his properties to him<br />

(wi SUJ3.) and on his fa<strong>the</strong>r's death <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g year, he succeeded as his heir. He<br />

is named <strong>in</strong> <strong>the</strong> will <strong>of</strong> his cous<strong>in</strong>, David Falconer, 23 July 1776, as universal legatee and<br />

executor (S.W. 652) and be<strong>ca</strong>me, on his death, <strong>the</strong> heir <strong>of</strong> l<strong>in</strong>e <strong>of</strong> his great grandfa<strong>the</strong>r,<br />

Dr. David Falconer <strong>of</strong> S. Andrew's (ante, p 173 n.).<br />

Ou <strong>the</strong> death <strong>of</strong> Grizel <strong>Wedderburn</strong> ot <strong>Wedderburn</strong>, 7 Nov. 1778, he succeeded to <strong>the</strong><br />

estates <strong>of</strong> <strong>Wedderburn</strong>, K<strong>in</strong>gennie, and Bullion, both under <strong>the</strong> provisions <strong>of</strong> her entail and<br />

also " <strong>in</strong> right <strong>of</strong> his great grandmo<strong>the</strong>r, who was sister to her grandfa<strong>the</strong>r " (S.W. 633,<br />

656), be<strong>in</strong>g thus her heir special under <strong>the</strong> tailzie and general <strong>in</strong> right <strong>of</strong> descent.<br />

I have already (ante, p. 16S, n. 3) dealt with his retours to her, 1779-80, some op<strong>in</strong>ions <strong>of</strong><br />

counsel which he took as to <strong>the</strong> terms <strong>of</strong> his succession, and with several letters," etc. <strong>in</strong><br />

regard to <strong>the</strong> matter. Upon succeed<strong>in</strong>g he assumed <strong>the</strong> name <strong>of</strong> <strong>Wedderburn</strong>, and<br />

Elgiva, dan. <strong>of</strong> F. L. Scrymgeour- <strong>Wedderburn</strong> post,<br />

; p. 18-3) ; and a daughter, ilaria Bethuue,<br />

m. 1872 James Carnegie ; wliile <strong>the</strong> daugliter, Susan Gillespie m. James W'r.muss <strong>of</strong> Wemysshall<br />

(b. 1798, d. 1871 1 and had issue two daughters (Mary Carnegie and Susan Jane) and three<br />
