The countries of <strong>the</strong> regi<strong>on</strong> have toughened <strong>the</strong>ir envir<strong>on</strong>mental laws <strong>on</strong> mining explorati<strong>on</strong>.<br />
Mining companies, for <strong>the</strong>ir part, have put management and certificati<strong>on</strong> systems into place and, in some<br />
cases, have bolstered <strong>the</strong>m with occupati<strong>on</strong>al health and safety strategies, introduced cleaner producti<strong>on</strong><br />
technologies and developed envir<strong>on</strong>mental educati<strong>on</strong> and training projects. 15 Various legal loopholes and<br />
problems with enforcement remain, however. In additi<strong>on</strong>, existing legislati<strong>on</strong> and regulati<strong>on</strong>s <strong>on</strong> mine<br />
closures do not always specify who should shoulder resp<strong>on</strong>sibility for <strong>the</strong> associated envir<strong>on</strong>mental<br />
liabilities (ECLAC, <str<strong>on</strong>g>20</str<strong>on</strong>g>09). Problems c<strong>on</strong>tinue to exist in such areas as governments’ capacity for <strong>the</strong><br />
review of envir<strong>on</strong>mental impact assessments, oversight of mining operati<strong>on</strong>s and of mine closures and<br />
mine aband<strong>on</strong>ment plans, arrangements for dealing with mining operati<strong>on</strong>s’ envir<strong>on</strong>mental liabilities, <strong>the</strong><br />
restorati<strong>on</strong> of <strong>da</strong>maged sites, occupati<strong>on</strong>al safety and accidents, and mining companies’ relati<strong>on</strong>s with<br />
indigenous communities and peoples. Small-scale mining poses a special type of challenge, since such<br />
operati<strong>on</strong>s are often informal and have little access to sophisticated technology or to financing (ECLAC,<br />
