All of <strong>the</strong>se initiatives seek to promote <strong>the</strong> implementati<strong>on</strong> of principle 10 in <strong>the</strong> regi<strong>on</strong>, ensuring<br />

not <strong>on</strong>ly that legislati<strong>on</strong> is passed, but also that it is enforced and that <strong>the</strong>re is a c<strong>on</strong>stant improvement in<br />

citizen participati<strong>on</strong> and government transparency. Box VI.3 c<strong>on</strong>tains <strong>the</strong> proposals of <strong>the</strong> countries of <strong>the</strong><br />

regi<strong>on</strong> in this regard, submitted to <strong>the</strong> C<strong>on</strong>ference secretariat between October and November <str<strong>on</strong>g>20</str<strong>on</strong>g>11 in<br />

<strong>the</strong>ir inputs for <strong>the</strong> Rio+<str<strong>on</strong>g>20</str<strong>on</strong>g> compilati<strong>on</strong> document.<br />

LATIN AMERICA AND THE CARIBBEAN: COUNTRY PROPOSALS ON ACCESS TO INFORMATION,<br />

PARTICIPATION AND JUSTICE IN DECISION-MAKING ON ENVIRONMENTAL MATTERS, WHICH<br />

FORM PART OF THEIR CONTRIBUTIONS TO THE NEGOTIATING DOCUMENT FOR THE<br />

UNITED NATIONS CONFERENCE ON SUSTAINABLE DEVELOPMENT (RIO+<str<strong>on</strong>g>20</str<strong>on</strong>g>)<br />

As part of <strong>the</strong> preparati<strong>on</strong>s for Rio+<str<strong>on</strong>g>20</str<strong>on</strong>g>, <strong>the</strong> C<strong>on</strong>ference secretariat issued an open invitati<strong>on</strong> for submissi<strong>on</strong>s to <strong>the</strong><br />

negotiating document. Presented below are some of <strong>the</strong> proposals received <strong>from</strong> <strong>the</strong> countries of <strong>the</strong> regi<strong>on</strong> with<br />

regard to access to informati<strong>on</strong>, participati<strong>on</strong> and justice in envir<strong>on</strong>mental matters.<br />

Argentina: The inclusi<strong>on</strong> in recent <str<strong>on</strong>g>years</str<strong>on</strong>g> of topics proposed by civil society in <strong>the</strong> political agen<strong>da</strong><br />

dem<strong>on</strong>strates <strong>the</strong> importance of mechanisms for citizen participati<strong>on</strong> in democracy. Instituti<strong>on</strong>alized mechanisms for<br />

citizen participati<strong>on</strong> provide transparent, horiz<strong>on</strong>tal and open channels for <strong>the</strong> <str<strong>on</strong>g>development</str<strong>on</strong>g> of synergies between<br />

stakeholders. They allow citizens to have a bigger part in decisi<strong>on</strong>-making and in <strong>the</strong> adopti<strong>on</strong> of c<strong>on</strong>crete measures<br />

in keeping with <strong>the</strong>ir own interests. The social dynamic as expressed by community stakeholders and supported by<br />

<strong>the</strong> media is a central factor in <strong>the</strong> <str<strong>on</strong>g>development</str<strong>on</strong>g> of <strong>the</strong> collective soluti<strong>on</strong>s required. Debate is of added importance<br />

for <strong>the</strong> enhancement of public policy coordinated at <strong>the</strong> municipal, provincial and nati<strong>on</strong>al levels. More specifically,<br />

envir<strong>on</strong>mental issues lend <strong>the</strong>mselves to increased citizen participati<strong>on</strong>. Rooted in <strong>the</strong> relati<strong>on</strong>ship between civil<br />

society and <strong>the</strong> State, such participati<strong>on</strong> calls for a space in which citizens can feel comfortable, a space that<br />

heightens <strong>the</strong> sense of bel<strong>on</strong>ging individuals need to assert <strong>the</strong>mselves and exercise <strong>the</strong>ir rights.<br />

Brazil: Negotiati<strong>on</strong>s should be launched <strong>on</strong> an internati<strong>on</strong>al c<strong>on</strong>venti<strong>on</strong> <strong>on</strong> access to informati<strong>on</strong>, public<br />

participati<strong>on</strong> in decisi<strong>on</strong>-making and justice in envir<strong>on</strong>mental matters. Support is proposed for setting in moti<strong>on</strong> a<br />

negotiati<strong>on</strong> process at Rio+<str<strong>on</strong>g>20</str<strong>on</strong>g> for an internati<strong>on</strong>al c<strong>on</strong>venti<strong>on</strong> that would ensure implementati<strong>on</strong> of principle 10 of<br />

<strong>the</strong> Rio Declarati<strong>on</strong>. Principle 10 is already <strong>the</strong> subject of regi<strong>on</strong>al instruments designed to increase opportunities to<br />

access envir<strong>on</strong>mental informati<strong>on</strong> and ensure <strong>the</strong> transparency and reliability of procedures. Such mechanisms help<br />

improve envir<strong>on</strong>mental governance by creating mutual trust between civil society and governments, including <strong>the</strong><br />

decisi<strong>on</strong>-making bodies of subnati<strong>on</strong>al authorities. All sectors of civil society and all spheres of government should<br />

participate in <strong>the</strong> process of developing an instrument of this kind.<br />

Chile: Chile c<strong>on</strong>siders that <strong>the</strong> rights of envir<strong>on</strong>mental access, participati<strong>on</strong> and justice embodied in<br />

principle 10 of <strong>the</strong> Rio Declarati<strong>on</strong> must be fully implemented. Chile is also in favour of signing regi<strong>on</strong>al<br />

agreements for <strong>the</strong> adopti<strong>on</strong> of principle 10. Similarly, Chile advocates greater participati<strong>on</strong> of local communities in<br />

decisi<strong>on</strong>-making processes, improving instruments for envir<strong>on</strong>mental oversight and justice without compromising<br />

<strong>the</strong> sovereignty of each country, and soluti<strong>on</strong>s to envir<strong>on</strong>mental <strong>da</strong>mage at <strong>the</strong> internati<strong>on</strong>al level as in <strong>the</strong> case of<br />

territories that are not subject to nati<strong>on</strong>al jurisdicti<strong>on</strong>.<br />

Costa Rica: With regard to m<strong>on</strong>itoring and participati<strong>on</strong>, efforts to establish and c<strong>on</strong>soli<strong>da</strong>te permanent<br />

mechanisms for grass-roots dialogue and c<strong>on</strong>sensus-building should be facilitated through internati<strong>on</strong>al cooperati<strong>on</strong>. This<br />

will ensure that <strong>the</strong> major groups, as key stakeholders, participate in <strong>the</strong> commitment to <str<strong>on</strong>g>sustainable</str<strong>on</strong>g> growth and<br />

<str<strong>on</strong>g>development</str<strong>on</strong>g>, respecting and valuing ecosystem services as part of <strong>the</strong> domestic ec<strong>on</strong>omy. These mechanisms should, inter<br />

alia, c<strong>on</strong>stitute a tool for promoting implementati<strong>on</strong> of Rio+<str<strong>on</strong>g>20</str<strong>on</strong>g> and, in <strong>the</strong> l<strong>on</strong>g term, evaluating <strong>the</strong> outcomes.<br />

Jamaica: In terms of access to informati<strong>on</strong>, Jamaica already has legislati<strong>on</strong> in place to deal with access to<br />

informati<strong>on</strong> and c<strong>on</strong>ducting envir<strong>on</strong>mental impact assessments, and has drafted legislati<strong>on</strong> <strong>on</strong> pollutant release and<br />

transfer registers and third party rights of appeal, am<strong>on</strong>g o<strong>the</strong>r matters. Notwithstanding c<strong>on</strong>cerns over <strong>the</strong> growing<br />

number of treaties, Jamaica c<strong>on</strong>siders that a regi<strong>on</strong>al agreement <strong>on</strong> principle 10 of <strong>the</strong> Rio Declarati<strong>on</strong>, based <strong>on</strong> <strong>the</strong><br />

Aarhus C<strong>on</strong>venti<strong>on</strong>, would enhance public participati<strong>on</strong> in <strong>the</strong> decisi<strong>on</strong>-making process.<br />
