resource management. The countries of <strong>the</strong> regi<strong>on</strong> should redouble <strong>the</strong>ir efforts to improve <strong>the</strong>ir<br />
knowledge base in this area and, when possible, undertake research <strong>on</strong> future trends.<br />
One cross-cutting element that is applicable to all of <strong>the</strong> acti<strong>on</strong>s suggested under this guideline is<br />
<strong>the</strong> need to streng<strong>the</strong>n capacities of those who are traditi<strong>on</strong>ally underrepresented in participatory<br />
processes, including women and indigenous and Afro-descendent populati<strong>on</strong>s and communities, thus<br />
ensuring that <strong>the</strong> regi<strong>on</strong>’s diverse languages and cultures are recognized. Citizen participati<strong>on</strong> cannot be<br />
restricted to <strong>on</strong>e language in multicultural countries or to <strong>on</strong>e medium, such as <strong>the</strong> Internet, which has<br />
serious deficiencies in coverage. The State must guarantee citizen participati<strong>on</strong> in decisi<strong>on</strong>-making,<br />
paying special attenti<strong>on</strong> to underrepresented groups by taking specific enabling measures (such as <strong>the</strong><br />
provisi<strong>on</strong> of child-care services and technical capacity-building), introducing affirmative acti<strong>on</strong> policies<br />
(such as quotas in decisi<strong>on</strong>-making forums) and c<strong>on</strong>ducting studies into <strong>the</strong> social impact of projects,<br />
policies, plans and programmes in order to ensure that <strong>the</strong> particular needs of disadvantaged groups<br />
are being met.<br />
Instituti<strong>on</strong>al mechanisms must be created or improved to ensure that those who will be directly<br />
affected by <strong>the</strong> envir<strong>on</strong>mental or social c<strong>on</strong>sequences of decisi<strong>on</strong>s are involved in <strong>the</strong> corresp<strong>on</strong>ding<br />
decisi<strong>on</strong>-making processes. Where infrastructure projects or mining activities could be detrimental to <strong>the</strong><br />
ec<strong>on</strong>omic or social livelihoods of certain populati<strong>on</strong>s (often indigenous communities), certain steps which<br />
are compatible with <strong>the</strong> culture of those populati<strong>on</strong>s should be taken when seeking <strong>the</strong>ir c<strong>on</strong>sent and<br />
could include public hearings, training and <strong>the</strong> introducti<strong>on</strong> of ec<strong>on</strong>omic and social <str<strong>on</strong>g>development</str<strong>on</strong>g> policies.<br />
As part of <strong>the</strong> Three Demands campaign led by The Access Initiative, civil society organizati<strong>on</strong>s have<br />
demanded, am<strong>on</strong>g o<strong>the</strong>r things, <strong>the</strong> establishment of public funding sources to support citizen participati<strong>on</strong> and<br />
representati<strong>on</strong> in legal cases of public interest, including, for example, pretrial assistance to ga<strong>the</strong>r evidence. 7<br />
The following acti<strong>on</strong>s are suggested under this guideline:<br />
(a)<br />
Establish an internati<strong>on</strong>al agreement to take steps towards <strong>the</strong> effective implementati<strong>on</strong> of<br />
principle 10 of <strong>the</strong> Rio Declarati<strong>on</strong>, guaranteeing access to informati<strong>on</strong>, citizen participati<strong>on</strong><br />
and justice in decisi<strong>on</strong>-making <strong>on</strong> envir<strong>on</strong>mental issues, especially to disadvantaged pers<strong>on</strong>s<br />
as a result of discriminati<strong>on</strong>, poverty or poor health<br />
Within <strong>the</strong> framework of <strong>the</strong> discussi<strong>on</strong>s <strong>on</strong> Rio+<str<strong>on</strong>g>20</str<strong>on</strong>g>, Governments of <strong>the</strong> regi<strong>on</strong> and civil society<br />
have raised <strong>the</strong> issue of <strong>the</strong> need to improve mechanisms for access to informati<strong>on</strong>, participati<strong>on</strong> and<br />
justice in decisi<strong>on</strong>-making and have suggested three opti<strong>on</strong>s in this regard. The first proposal is to<br />
establish a regi<strong>on</strong>al legal instrument guaranteeing <strong>the</strong> rights enshrined in principle 10 of <strong>the</strong> Rio<br />
Declarati<strong>on</strong>. This could be based <strong>on</strong> less<strong>on</strong>s learned <strong>from</strong> <strong>the</strong> European experience regarding <strong>the</strong><br />
C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> Access to Informati<strong>on</strong>, Public Participati<strong>on</strong> in Decisi<strong>on</strong>-Making and Access to Justice in<br />
Envir<strong>on</strong>mental Matters (Aarhus C<strong>on</strong>venti<strong>on</strong>). 8 A sec<strong>on</strong>d alternative suggest <strong>the</strong> drafting of a new<br />
internati<strong>on</strong>al instrument and, a third opti<strong>on</strong> is that <strong>the</strong> countries of <strong>the</strong> regi<strong>on</strong> could accede to <strong>the</strong> Aarhus<br />
C<strong>on</strong>venti<strong>on</strong>, which is open for signature by o<strong>the</strong>r member States of <strong>the</strong> United Nati<strong>on</strong>s, despite being a<br />
c<strong>on</strong>venti<strong>on</strong> of <strong>the</strong> United Nati<strong>on</strong>s Ec<strong>on</strong>omic Commissi<strong>on</strong> for Europe.<br />
