10 Envir<strong>on</strong>mental issues are best handled with <strong>the</strong> participati<strong>on</strong> of all c<strong>on</strong>cerned citizens, at <strong>the</strong> relevant level.<br />
At <strong>the</strong> nati<strong>on</strong>al level, each individual shall have appropriate access to informati<strong>on</strong> c<strong>on</strong>cerning <strong>the</strong><br />
envir<strong>on</strong>ment that is held by public authorities, including informati<strong>on</strong> <strong>on</strong> hazardous materials and activities in<br />
<strong>the</strong>ir communities, and <strong>the</strong> opportunity to participate in decisi<strong>on</strong>-making processes. States shall facilitate and<br />
encourage public awareness and participati<strong>on</strong> by making informati<strong>on</strong> widely available. Effective access to<br />
judicial and administrative proceedings, including redress and remedy, shall be provided.<br />
11 States shall enact effective envir<strong>on</strong>mental legislati<strong>on</strong>. Envir<strong>on</strong>mental stan<strong>da</strong>rds, management objectives and<br />
priorities should reflect <strong>the</strong> envir<strong>on</strong>mental and <str<strong>on</strong>g>development</str<strong>on</strong>g>al c<strong>on</strong>text to which <strong>the</strong>y apply. Stan<strong>da</strong>rds applied<br />
by some countries may be inappropriate and of unwarranted ec<strong>on</strong>omic and social cost to o<strong>the</strong>r countries, in<br />
particular developing countries.<br />
12 States should cooperate to promote a supportive and open internati<strong>on</strong>al ec<strong>on</strong>omic system that would lead to<br />
ec<strong>on</strong>omic growth and <str<strong>on</strong>g>sustainable</str<strong>on</strong>g> <str<strong>on</strong>g>development</str<strong>on</strong>g> in all countries, to better address <strong>the</strong> problems of<br />
envir<strong>on</strong>mental degra<strong>da</strong>ti<strong>on</strong>. Trade policy measures for envir<strong>on</strong>mental purposes should not c<strong>on</strong>stitute a means<br />
of arbitrary or unjustifiable discriminati<strong>on</strong> or a disguised restricti<strong>on</strong> <strong>on</strong> internati<strong>on</strong>al trade. Unilateral acti<strong>on</strong>s<br />
to deal with envir<strong>on</strong>mental challenges outside <strong>the</strong> jurisdicti<strong>on</strong> of <strong>the</strong> importing country should be avoided.<br />
Envir<strong>on</strong>mental measures addressing transboun<strong>da</strong>ry or global envir<strong>on</strong>mental problems should, as far as<br />
possible, be based <strong>on</strong> an internati<strong>on</strong>al c<strong>on</strong>sensus.<br />
13 States shall develop nati<strong>on</strong>al law regarding liability and compensati<strong>on</strong> for <strong>the</strong> victims of polluti<strong>on</strong> and o<strong>the</strong>r<br />
envir<strong>on</strong>mental <strong>da</strong>mage. States shall also cooperate in an expeditious and more determined manner to develop<br />
fur<strong>the</strong>r internati<strong>on</strong>al law regarding liability and compensati<strong>on</strong> for adverse effects of envir<strong>on</strong>mental <strong>da</strong>mage<br />
caused by activities within <strong>the</strong>ir jurisdicti<strong>on</strong> or c<strong>on</strong>trol to areas bey<strong>on</strong>d <strong>the</strong>ir jurisdicti<strong>on</strong>.<br />
14 States should effectively cooperate to discourage or prevent <strong>the</strong> relocati<strong>on</strong> and transfer to o<strong>the</strong>r States of any<br />
activities and substances that cause severe envir<strong>on</strong>mental degra<strong>da</strong>ti<strong>on</strong> or are found to be harmful to human<br />
health.<br />
15 In order to protect <strong>the</strong> envir<strong>on</strong>ment, <strong>the</strong> precauti<strong>on</strong>ary approach shall be widely applied by States according<br />
to <strong>the</strong>ir capabilities. Where <strong>the</strong>re are threats of serious or irreversible <strong>da</strong>mage, lack of full scientific certainty<br />
shall not be used as a reas<strong>on</strong> for postp<strong>on</strong>ing cost-effective measures to prevent envir<strong>on</strong>mental degra<strong>da</strong>ti<strong>on</strong>.<br />
16 Nati<strong>on</strong>al authorities should endeavour to promote <strong>the</strong> internalizati<strong>on</strong> of envir<strong>on</strong>mental costs and <strong>the</strong> use of<br />
ec<strong>on</strong>omic instruments, taking into account <strong>the</strong> approach that <strong>the</strong> polluter should, in principle, bear <strong>the</strong> cost of<br />
polluti<strong>on</strong>, with due regard to <strong>the</strong> public interest and without distorting internati<strong>on</strong>al trade and investment.<br />
17 Envir<strong>on</strong>mental impact assessment, as a nati<strong>on</strong>al instrument, shall be undertaken for proposed activities that<br />
are likely to have a significant adverse impact <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment and are subject to a decisi<strong>on</strong> of a<br />
competent nati<strong>on</strong>al authority.<br />
18 States shall immediately notify o<strong>the</strong>r States of any natural disasters or o<strong>the</strong>r emergencies that are likely to<br />
produce sudden harmful effects <strong>on</strong> <strong>the</strong> envir<strong>on</strong>ment of those States. Every effort shall be made by <strong>the</strong><br />
internati<strong>on</strong>al community to help States so afflicted.<br />
19 States shall provide prior and timely notificati<strong>on</strong> and relevant informati<strong>on</strong> to potentially affected States <strong>on</strong><br />
activities that may have a significant adverse transboun<strong>da</strong>ry envir<strong>on</strong>mental effect and shall c<strong>on</strong>sult with those<br />
States at an early stage and in good faith.<br />
<str<strong>on</strong>g>20</str<strong>on</strong>g> Women have a vital role in envir<strong>on</strong>mental management and <str<strong>on</strong>g>development</str<strong>on</strong>g>. Their full participati<strong>on</strong> is <strong>the</strong>refore<br />
essential to achieve <str<strong>on</strong>g>sustainable</str<strong>on</strong>g> <str<strong>on</strong>g>development</str<strong>on</strong>g>.<br />
21 The creativity, ideals and courage of <strong>the</strong> youth of <strong>the</strong> world should be mobilized to forge a global partnership<br />
in order to achieve <str<strong>on</strong>g>sustainable</str<strong>on</strong>g> <str<strong>on</strong>g>development</str<strong>on</strong>g> and ensure a better future for all.<br />
22 Indigenous people and <strong>the</strong>ir communities, and o<strong>the</strong>r local communities, have a vital role in envir<strong>on</strong>mental<br />
management and <str<strong>on</strong>g>development</str<strong>on</strong>g> because of <strong>the</strong>ir knowledge and traditi<strong>on</strong>al practices. States should recognize<br />
and duly support <strong>the</strong>ir identity, culture and interests and enable <strong>the</strong>ir effective participati<strong>on</strong> in <strong>the</strong><br />
achievement of <str<strong>on</strong>g>sustainable</str<strong>on</strong>g> <str<strong>on</strong>g>development</str<strong>on</strong>g>.<br />
23 The envir<strong>on</strong>ment and natural resources of people under oppressi<strong>on</strong>, dominati<strong>on</strong> and occupati<strong>on</strong> shall be protected.
