B. ACCESS TO INFORMATION, PARTICIPATION AND JUSTICE<br />

IN ENVIRONMENTAL DECISION-MAKING<br />

In <strong>the</strong> past two decades, countries in <strong>the</strong> regi<strong>on</strong> have made major progress in <strong>the</strong> legal recogniti<strong>on</strong> of<br />

rights of access to informati<strong>on</strong>, participati<strong>on</strong> and justice in envir<strong>on</strong>mental matters. Examples are Mexico’s<br />

federal law <strong>on</strong> transparency and access to public government informati<strong>on</strong> (<str<strong>on</strong>g>20</str<strong>on</strong>g>02), Chile’s law <strong>on</strong> access to<br />

public informati<strong>on</strong> (<str<strong>on</strong>g>20</str<strong>on</strong>g>09), and Peru’s law, enacted in <str<strong>on</strong>g>20</str<strong>on</strong>g>11, <strong>on</strong> indigenous peoples’ right to prior<br />

c<strong>on</strong>sultati<strong>on</strong>, as recognized in C<strong>on</strong>venti<strong>on</strong> 169 of <strong>the</strong> Internati<strong>on</strong>al Labour Organizati<strong>on</strong> (ILO). In<br />

additi<strong>on</strong>, <strong>the</strong> vast majority of <strong>the</strong> envir<strong>on</strong>ment-related framework laws passed since <strong>the</strong> 1980s incorporate<br />

access to informati<strong>on</strong> and citizen participati<strong>on</strong>, ei<strong>the</strong>r through c<strong>on</strong>sultati<strong>on</strong> or by c<strong>on</strong>vening organized<br />

civil society or integrating it directly into some form of management body. As in o<strong>the</strong>r parts of <strong>the</strong> world,<br />

civil society has played an important role in disseminating <strong>the</strong> access rights enshrined in principle 10 of<br />

<strong>the</strong> Rio Declarati<strong>on</strong> in <strong>the</strong> regi<strong>on</strong>. Of particular note are <strong>the</strong> large-scale, coordinated efforts of around 64<br />

n<strong>on</strong>-governmental and civil society organizati<strong>on</strong>s in <strong>the</strong> regi<strong>on</strong>, which, under The Access Initiative 7 and<br />

assisted by ECLAC, have supported government processes and pushed for more effective implementati<strong>on</strong><br />

of access rights. Since <str<strong>on</strong>g>20</str<strong>on</strong>g>02, The Access Initiative in Latin America has assessed access to informati<strong>on</strong>,<br />

participati<strong>on</strong> and justice in decisi<strong>on</strong>-making processes that affect <strong>the</strong> envir<strong>on</strong>ment in 15 countries of <strong>the</strong><br />

regi<strong>on</strong>, providing an independent evaluati<strong>on</strong> of progress towards implementati<strong>on</strong> of principle 10. The<br />

main advances and remaining gaps regarding <strong>the</strong> three comp<strong>on</strong>ents of principle 10 are outlined below.<br />

1. Access to informati<strong>on</strong><br />

In most countries in <strong>the</strong> regi<strong>on</strong>, access to informati<strong>on</strong> is guaranteed in <strong>the</strong> c<strong>on</strong>stituti<strong>on</strong> (for example, in<br />

Costa Rica, Ecuador, Mexico and Peru) or through specific laws (as in Brazil and Ecuador). In additi<strong>on</strong>,<br />

some countries have enacted specific laws <strong>on</strong> access to envir<strong>on</strong>mental informati<strong>on</strong>, including Argentina<br />

(Law 25831 of January <str<strong>on</strong>g>20</str<strong>on</strong>g>04), Mexico and <strong>the</strong> Plurinati<strong>on</strong>al State of Bolivia (The Access Initiative,<br />

<str<strong>on</strong>g>20</str<strong>on</strong>g>05). Many countries have introduced into domestic law <strong>the</strong> obligati<strong>on</strong> for a designated authority to<br />

submit informati<strong>on</strong> <strong>on</strong> <strong>the</strong> state of <strong>the</strong> envir<strong>on</strong>ment at specified intervals. In special cases, as in Colombia,<br />

<strong>the</strong> c<strong>on</strong>stituti<strong>on</strong> enshrines an obligati<strong>on</strong> to produce annual reports <strong>on</strong> <strong>the</strong> state of <strong>the</strong> envir<strong>on</strong>ment.<br />

Countries in <strong>the</strong> regi<strong>on</strong> have <strong>the</strong>refore invested significant human and financial resources in<br />

compiling and disseminating informati<strong>on</strong> and in reporting <strong>on</strong> compliance with obligati<strong>on</strong>s under<br />

multilateral envir<strong>on</strong>mental agreements. As already menti<strong>on</strong>ed, <strong>the</strong> expansi<strong>on</strong> of access to and <strong>the</strong> use of<br />

informati<strong>on</strong> and communicati<strong>on</strong> technologies have been a major factor in <strong>the</strong> disseminati<strong>on</strong> of available<br />

informati<strong>on</strong>. Despite this progress, not all of <strong>the</strong> regi<strong>on</strong>’s public organizati<strong>on</strong>s systematically disclose<br />

available informati<strong>on</strong> (Acuña, <str<strong>on</strong>g>20</str<strong>on</strong>g>10).<br />

A promising initiative, implemented in Chile and Mexico as a result of commitments acquired in<br />

<strong>the</strong> free trade agreements that <strong>the</strong>se countries have signed with <strong>the</strong> United States, involves, as menti<strong>on</strong>ed<br />

in <strong>the</strong> previous chapter, publishing freely accessible pollutant release and transfer registers (PRTRs) <strong>on</strong><br />

<strong>the</strong> Internet (United Nati<strong>on</strong>s, <str<strong>on</strong>g>20</str<strong>on</strong>g>10). O<strong>the</strong>r bilateral and multilateral free trade agreements have included<br />

articles or chapters recognizing <strong>the</strong> importance of access to envir<strong>on</strong>mental informati<strong>on</strong>.<br />
