NOTIFICATION<br />

The 18th July, <strong>2007</strong><br />

<strong>No</strong>. PERS-53/97/4045.—In exercise of the powers conferred by the proviso to article 309 of the<br />

Constitution of India and in supersession of the "Arunachal Pradesh Civil Service Rules, 1995, (notified vide<br />

Government notification <strong>No</strong>.PERS-68/93 dated 1st June, 1995)" and the “Arunachal Pradesh Civil Service<br />

(Junior) Rules, 1980, (notified vide <strong>No</strong>. Apptt.-89/75 dated 6th February, 1980)" except as respects things<br />

done or omitted to be done before such supersession, the Governor of Arunachal Pradesh hereby makes the<br />

following Rules to regulate the method of recruitment to the Arunachal Pradesh Civil Services, as follows :-<br />

1. Short title and commencement : (1) These Rules may be called the Arunachal Pradesh Civil<br />

Service Rules, 2006.<br />

(2) They shall be deemed to have come into force on the lst day of January, 1998.<br />

PART - I<br />

2. Definitions : (1) In these Rules, unless the context otherwise require;<br />

(a) "Commission” means the Arunachal Pradesh Public Service Commission ;<br />

(b) "Committee" means the Selection Committee as constituted under Rule 13 of these Rules;<br />

(c) "Duty Post" means any post specified in Schedule-I and includes a temporary post carrying the<br />

same designation as any of the posts and the scale of pay which is identical to that attached to<br />

APCS Entry Grade posts specified in that Schedule and any other temporary post declared as<br />

duty Post by the Government ;<br />

(d) "Government” means the Government of Arunachal Pradesh;<br />

(e)<br />

"Member of the Service" means a person appointed on a regular basis to any of the Grade of the<br />

Service, and includes a person appointed on probation to APCS Entry Grade of the Service;<br />

(f) "Schedule" means Schedule appended to these Rules;<br />

(g)<br />

(h)<br />

"Service” means the Arunachal Pradesh Civil Service;<br />

“Cadre” and 'Cadre post' shall have the meaning respectively assigned to them in the Arunachal<br />

Pradesh Civil Service Rules, 2006 ;<br />

(i) "Direct Recruitment” means a person appointed to the Arunachal Pradesh Civil Service in<br />

accordance with rule 5 of the Arunachal Pradesh Civil Service Rules, 2006 ;<br />

(j) "State" means the State of Arunachal Pradesh;<br />

(k) "Departmental Examination" means such examination as may be prescribed by the Government<br />

from time to time for members of the service;

(m)<br />

"Lien" means the title of a member of the service to hold on regular basis either immediately or<br />

on the termination of a period of periods of absence, a post, including a tenure post, to which he<br />

has been appointed on regular basis or on which he is not on probation. The junior most person(s)<br />

in the grade will, however, be liable to be reverted to the lower grade if the number of members<br />

of the service entitled to hold the regular posts is more than the number of posts available in<br />

that grade ;<br />

"Grade Pay" means pay drawn by a member of the service in the grade in which he/she is<br />

appointed substantively ;<br />

(n) "Personal Pay" means additional pay granted to a member of the service-(a) to save him/her<br />

from a loss in his substantive pay in respect of a permanent post other than a tenure post due<br />

to a revision of pay or due to any reduction of such substantive pay otherwise than as a disciplinary<br />

measures ; or (b) in exceptional circumstances, on other personal consideration ;<br />

(o)<br />

"DPC" means a Departmental Promotion Committee.<br />

(2) The expression "Schedule Tribes" shall have the same meaning as are assigned to them by<br />

clause (25) of article 366 of the Constitution of India.<br />

3. Constitution of Service and its Classification :- (1) There shall be constituted a General Civil<br />

Service to be known as the Arunachal Pradesh Civil Service.<br />

(2) The Service shall have the following four Grades, namely:-<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

Entry Grade<br />

Senior Grade<br />

Selection Grade and<br />

Administrative Grade.<br />

(3) The posts in all grades shall be General Civil Service Group "A" (Gazetted).<br />

PART-II-AUTHORISED PERMANENT STRENGTH OF THE SERVICE<br />

4. Strength of the Service : (1) The authorized permanent and temporary strength of the<br />

Service and the posts included there in shall be as specified in Schedule-I.<br />

(2) The Strength of the posts in the Administrative Grade shall be as specified in Part A of the<br />

Schedule-I.<br />

(3) The number of posts in Selection Grade of the Service shall be as specified in Part B of the<br />

Schedule-I.<br />

(4) The number of posts in Senior Grade of the Service shall be as specified in Part C of the<br />

schedule-I.<br />

(5) The number of posts in Entry Grade of the Service shall be as specified in the Part D of the<br />

Schedule-I.<br />

(6) Subject to such conditions and limitations as may be specified by the Government, the -duty<br />

posts for such period by order may be created.<br />

(7) The Government may, in consultation with the Cadre Review Committee, include in the Service<br />

any posts other than those included in Schedule-I or exclude from the service a post included in the said<br />

Schedule from time to time.<br />

(8) The Government may, in consultation with the Commission, appoint to the service, the regular<br />

incumbent of such post which has been en-cadred in the service under sub-rule (7) in a permanent or<br />

temporary capacity, as may be deemed fit. The suitability of such officer for appointment shall be assessed<br />

by the Selection Committee constituted under Rule 13.<br />

(9) <strong>No</strong>twithstanding anything contained in sub-rule (6) and (7) of these rules, in case any regular<br />

incumbent of such post which has been encadred in the service under sub-rule (7) is not found suitable for<br />

appointment to the service under sub-rule (8), he will continue to hold the post and for this purpose the post<br />

will be treated to have been excluded from the service till it is held by such incumbent. Such persons may be<br />

reconsidered by the selection committee at appropriate occasions.

PART-III-METHOD OF RECRUITMENT<br />

5. Method of Recruitment :- (1) Save as provided under Rule 16 or sub-rule (9) of Rule 4,<br />

appointments to Entry Grade of the Service shall be made by the following methods, namely :-<br />

(a) 80% of the substantive vacancies which occur from time to time in -the authorized permanent<br />

strength of the Entry Grade of the Service shall be filled by direct recruitment in the manner specified in<br />

Part-IV of these Rules; and<br />

(b) 20% of the posts of the entry grade will be filled up by selection on the basis of merit adjudged<br />

from amongst departmental candidates nominated by the prescribed authorities on the basis of their ACRs<br />

and viva voce test to be conducted by the Committee as constituted under Rule 13.<br />

Provided that fractions will be rounded off to the nearest whole number with excess or deficit accounted in<br />

the next recruitment. It shall be filled in the manner as specified in Part-V of these Rules.<br />

(2) Academic & other qualification :<br />

For appointment against direct recruitment vacancies, the incumbent should possess a Bachelors<br />

degree in any discipline from a recognized University.<br />

For appointment by selection from departmental candidates, the incumbent should possess<br />

the following qualifications:-<br />

He/She should be graduate in any discipline from a recognized University.<br />

He/She should hold an appointment in the Group B (<strong>No</strong>n- Gazetted) under Government of<br />

Arunachal Pradesh in the scale of pay of Rs.5500-175-9000/- p.m. or any higher scale; and<br />

He/She should have completed 8 years of service under Government of Arunachal Pradesh<br />

on the date of selection for appointment.<br />

<strong>No</strong> person will be eligible for nomination for appointment by selection from departmental<br />

candidates if he/she has attained the age of 40 years or more.<br />

(3) <strong>No</strong>mination by prescribed authorities for selection of departmental candidates.<br />

On receipt of a requisition from the appointing authority, the Deputy Commissioner and the Secretary<br />

to the Department shall make nomination within the prescribed time, suitable and qualified persons for<br />

selection to the entry grade of the service. The nomination of departmental candidates will be screened by<br />

a Screening Board as may be constituted by the appointing authority. A list of candidates not exceeding five<br />

or six times the number of vacancies to be filled by departmental candidates, or recommended by the<br />

Screening Board will be placed before the committee and only those candidates will be called for interview<br />

by the committee provided that no one will be eligible for nomination unless he has earned successively<br />

three very good reports in his annual confidential roll.<br />

PART-IV DIRECT RECRUITMENT<br />

6. Competitive Examination :- (1) A competitive examination for direct recruitment to the Service<br />

shall be held as per the proviso to the Arunachal Pradesh Public Service combined Competitive Examination<br />

Rules, 2001 notified vide Government <strong>No</strong>tification <strong>No</strong>. PERS-30/97 dated 9th February, 2001, at fixed dates<br />

and time as the Government may, in consultation with the Commission annually. The date on which and the<br />

places at which the examination shall be held shall be fixed by the Commission.<br />

(2) The qualification for admission to the examination and the conduct thereof shall be in accordance<br />

with such regulation as the Government may, from time to time, issue in this behalf in consultation with the<br />

Commission.<br />

7. Nature of Examination :- Until otherwise modified/amended/superseded by the government<br />

in consultation with the Commission, the competitive examination for recruitment to the Service shall continue<br />

to be regulated under the Arunachal Pradesh Public Service Combined Competitive Examination Rules,<br />

2001 notified vide <strong>No</strong>. PERS-30/97 dated 9th February, 2001.<br />

8. Decision of the Commission to be final :- The decision of the Commission as to eligibility or<br />

otherwise of candidate(s) for admission to the examination shall be final and no candidate to whom a<br />

certificate of admission has not been issued by the Commission shall be admitted to the examination.<br />

9. Commission to forward a list of qualified candidates :- Subject to the provision of sub-rule<br />

(2), the Commission shall forward to the Government, a list arranged in order of merit of the candidates who<br />

have qualified by such standards as the Commission may determine.

(2) The candidates belonging to Scheduled Tribes or other special categories of persons may, to<br />

the extent the number of vacancies reserved for the Scheduled Tribes or other special categories of persons<br />

who cannot be filled on the basis of the general standard, be recommended by the Commission by a relaxed<br />

standard to make up the deficiency in the reserved quota, subject to the fitness of these candidates for<br />

selection to the service, irrespective of their ranks in the order of merit at the examination.<br />

10. Physical fitness :- <strong>No</strong> candidate shall be appointed to the Service unless he is declared after<br />

such medical examination as the Government may prescribe to be free from any mental or physical defect<br />

likely to interfere with the discharge of the Service.<br />

Provided that where a candidate whose name is included in the list referred to in the Rule 9 is not<br />

appointed to the Service, the reasons for the same shall be recorded, in writing, by the Government.<br />

11. Inclusion in the list not to confer right to appointment :- <strong>No</strong> candidate shall be appointed<br />

to the service unless he is declared after such medical examination as the Government may prescribe to be<br />

free from any mental or physical defect likely to interfere with the discharge of the duties of the service.<br />

12. Order of appointment :- Subject to the provisions of these rules, the candidates included in<br />

the lists referred to in Rule 9 shall be appointed to the Service in order of merit.<br />

PART - V RECRUITMENT BY SELECTION (LATERAL ENTRY)<br />

13. Constitution of Selection Committee :- Recruitment under sub-rule (8) of Rule 4 shall be<br />

made on the recommendations of a Selection Committee, consisting of the following members namely :-<br />

SELECTION COMMITTEE<br />

Recruitment by selection (lateral entry) to the posts of APCS Entry Grade shall be made on the<br />

recommendations of a Selection Committee, consisting of :-<br />

(1) Chief Secretary - Chairman<br />

(2) Chairman/Member nominated<br />

by Chairman of State<br />

Public Service Commission - Member<br />

(3) Commissioner/Secretary of<br />

the Department - Member<br />

(4) Commissioner/Secretary of<br />

other Department<br />

(not connected with the work<br />

of Department) - Member<br />

(5) One APST officer not below the<br />

rank of Secretary to the Government,<br />

if none of above member belong to APST - Member<br />

14. Conditions of eligibility and procedure for selection :- The Committee shall consider from<br />

time to time the cases of officers eligible under clause (b) of Sub-rule (1) of Rule 5 who have served in the<br />

respective cadre or posts, as the case may be, for not less than eight years and prepare a list of officers<br />

recommended for appointment after taking into account the actual vacancies at the time of selection and<br />

those likely to occur during a year. The selection for inclusion in the list shall be based on merit and suitability<br />

on all respects for appointment to the Service with due regard to seniority.<br />

(2) The seniority of the officers eligible for consideration by the Committee under sub-rule (1) shall<br />

be determined by the Government with due regard to the date (s) of their appointment on a regular basis to<br />

the next higher respective cadre or posts.<br />

Provided that the persons belonging to the same parent service or cadre shall be ranked inter-se in<br />

order of their relative seniority in the parent Service or Cadre, as the case may be.<br />

(3) The names of persons included in the list shall be arranged in order of merit.<br />

(4) The list so prepared by the Committee which in turn shall forward the same with or without<br />

modification, as it deem necessary, to the Government.<br />

(5) The list shall thereafter be approved by the Government with or without modification, if any :<br />

Provided that if the Government propose/suggest any change/modification in the list forwarded by<br />

the Committee it shall do so with prior consultation of the Committee. The Government shall forward to the<br />

Committee all relevant records while suggesting any modification or change along with the reasons to be<br />

recorded in writing.

(6) If the Committee considers it necessary to make any change in the list received from the<br />

Government, the Committee shall inform the Government of the change proposed by it or otherwise.<br />

(7) The list shall finally be approved by the Government after taking into account the changes, if<br />

any. If any change or recommendations made by the Committee is not accepted, the reasons for nonacceptance<br />

shall be recorded in writing.<br />

(8) The list, thus finally, approved shall be valid for 12 months or until a fresh list is prepared for the<br />

purpose in accordance with these rules as the case may be, which ever is earlier.<br />

15. Appointment to the Service :- Appointment to the Service shall be made in order of merit in<br />

the list referred to in sub-rule (7) of Rule 14.<br />

Provided that the posts actually filled by direct recruitment and lateral entry in the Entry Grade posts<br />

at any time should not exceed 80:20 ratio in the authorized strength of the Entry Grade posts at any time.<br />

Provided further that if circumstances so warrant, nothing in these rules shall preclude the<br />

Government from holding any vacancies in the Service in abeyance with reasons to be recorded.<br />

PART-VI-INITIAL CONSTITUTION OF SERVICE<br />

16. Initial appointment of persons to the Service :- The service shall include persons who<br />

immediately before the Commencement of these rules were members of the service and had been appointed<br />

so, on regular basis to either APCS (Junior) or APCS (Senior) or APCS Entry Grade of the service as the<br />

case may be as per provisions of APCS (Junior) Rules, 1980, the Arunachal Pradesh Civil Service Rules,<br />

1995 and the Arunachal Pradesh Service Combined Competitive Examination Rules, 2001.<br />

PART-VII APPOINTMENT, PROBATION, TRAINING AND CONFIRMATION<br />

17. Appointment :- All appointments to the Service shall be made to the Administrative Grade,<br />

Selection Grade, Senior Grade and Entry Grade of the service and not against any unspecified posts included<br />

in the Schedule.<br />

18. Disqualification :- <strong>No</strong> person,<br />

(a) Who has entered into or contracted a marriage with a person living, or<br />

(b) Who, having a spouse living, entered into or contracted a marriage with any person, shall be<br />

eligible for appointment to the service.<br />

Provided that the Government may, if satisfied that such marriage is permissible under personal<br />

law applicable to such persons and the other party to the marriage and there are other grounds for so doing,<br />

exempt any person from the operation of this rule.<br />

19. Special provision for the members of Scheduled Tribes and other special categories of<br />

person :- Appointments to the Service made by direct recruitment/ selection shall be subject to orders<br />

regarding special representation in the Services for Scheduled Tribes and other special category of persons<br />

issued by the State Government from time to time.<br />

20. Period of Probation :- (1) Every person appointed under Rule 5 or Rule 15 to Entry Grade of<br />

the Service shall be on probation for a period of 2 (two) years.<br />

(2) The Government may, in the case of any person, for reason to be recorded in writing, extend or<br />

reduce the period of probation.<br />

(3) A probationer who has no lien on any post under the Government, or Central Service at any<br />

time without notice if:-<br />

(i) On the basis of his performance or conduct during probation, he is considered unfit for further<br />

retention in the Service, or<br />

(ii) If on the receipt of any information relation to his nationality, age, health or antecedents, the<br />

Appointing Authority is satisfied that he is ineligible or otherwise unfit for being a member of the Service.<br />

(4) A probationer who holds a lien on a post under the Central Government or any State Government<br />

may be reverted to such a post at any time in any of the circumstances specified in sub-rule (3) above.

(5) A probationer who is not considered suitable for confirmation at the end of the period of probation<br />

prescribed in sub-rule (1) or at the end of extended period of probation, if any, under sub-rule (2) above,<br />

shall be discharged or reverted in accordance with sub-rule (3) or sub-rule (4), as the case may be.<br />

21. Execution of Agreement : A probationer who is required to undergo training shall on<br />

appointment to the service execute an agreement in such form as may be prescribed by the Government<br />

from time to time, binding himself and on surely, jointly and severally, in the event of his failing to comply with<br />

any of the provisions of these rules to the satisfaction of the Government, to refund any money paid to his<br />

consequent on his appointment as a probationer.<br />

22. Training and Departmental Examination : A person appointed under Rule 5 to Rule 15, to<br />

the Service shall undergo such training, and pass during the period of probation such departmental<br />

examinations, as the Government may from time to time prescribe.<br />

Provided that the Government may, subject to such conditions as it may impose and having regard<br />

to his past service, experience or academic qualifications, exempt any persons appointed under clause (b)<br />

of sub-rule (1) of Rule 5 to Rule 15, either wholly or partly, from any such training or departmental examination.<br />

23. Confirmation in Service : A person who has been declared to have satisfactorily completed<br />

his period of probation may be confirmed in the Service.<br />

PART - VIII - APPOINTMENT BY PROMOTION<br />

24. CONSTITUTION OF DEPARTMENTAL PROMOTION COMMITTEE (DPC)<br />

Recruitment to the post of APCS Senior Grade, APCS Selection Grade, and APCS Administrative<br />

Grade shall be made on the recommendations of a Departmental Promotion Committee (herein after called<br />

as DPC), consisting of :-<br />

(1) Chief Secretary - Chairman<br />

(2) Commissioner/Secretary of the Department - Member<br />

(3) Commissioner/Secretary of other Department<br />

[not connected with the work of Department] -<br />

Member<br />

(4) One APST officer not below the rank of<br />

Secretary to the Government, if none of<br />

above member belong to APST - Member<br />

25. Appointment to the APCS (Senior Grade) : (1) Appointment of members of the Service to<br />

the APCS Senior Grade shall be made by promotion from the select list prepared by the DPC on the basis<br />

of Selection-by- merit from amongst APCS Junior / APCS Entry Grade. Persons appointed to the service<br />

under rule 16, who are appointed to the post of APCS grade II under the provisions of the Arunachal Pradesh<br />

Civil Service Rules, 1995, shall, however, be deemed to have been appointed to the Senior Grade under<br />

these rules.<br />

(2) An Officer in the entry grade with a minimum of 5 (five) years of service shall be eligible for<br />

being considered for promotion to the APCS (Senior Grade).<br />

(3) The crucial date for determining the Eligibility of officers for promotion to the Senior Grade<br />

shall be 31st December of the year proceeding the year in which the vacancy has occurred.<br />

(4) The Committee shall prepare a list, of persons recommended for appointment to the Senior<br />

Grade and the names of persons included in the list shall be arranged in order of merit. The provisions of<br />

Sub-rule (4) to (8) of Rule 14 shall apply mutatis mutandis in the preparation of the list under these rules.<br />

26. Appointment to the Selection Grade : (1) Appointments of members of the Service to the<br />

Selection grade shall be made by promotion from the selected list prepared by the DPC on the basis of<br />

selection-by- merit from amongst APCS Senior Grade. Persons appointed to the Service under Rule 16 in<br />

the Selection Grade under the provisions of the Arunachal Pradesh Civil Service Rules, 1995, shall, however,<br />

be deemed to have been appointed to the Selection Grade under these rules.<br />

(2) From the appointed day, an officer in the senior grade with a minimum of 5 (five) years of<br />

service shall be eligible for being considered for promotion to the Selection Grade.<br />

(3) The crucial date for determining the eligibility of officers for promotion to the Selection Grade<br />

shall be 31st December of the year proceeding the year in which the vacancy has occurred.<br />

(4) The Committee shall prepare a list of persons recommended for appointment to the Selection<br />

Grade and the names of persons included in the list shall be arranged in order of merit. The provisions of<br />

Sub-rule (4) to (8) of Rule 14 shall apply mutatis mutandis in the preparation of the list under these rules.<br />

27. Appointment to the Administrative Grade : (1) Appointments of members of the Service<br />

to the Administrative grade shall me made by promotion from the selected list prepared by the DPC on the<br />

basis of Selection-by-merit from amongst the APCS Selection Grade.

(2) An officer with a minimum of 5 (five) years of regular service in Selection Grade shall be<br />

eligible for being considered for promotion to the post of Administrative Grade.<br />

(3) The crucial date for determining the eligibility of officers for promotion to the Administrative<br />

Grade shall be 31st December of the year proceeding the year in which the vacancy has occurred.<br />

(4) The Committee shall prepare a list of persons recommended for appointment to the<br />

Administrative Grade and the names of persons included in the list shall be arranged in order of merit. The<br />

provisions of Sub-rule (4) to (8) of Rule 14 shall apply mutatis mutandis in the preparation of the list under<br />

these rules.<br />

PART - IX MISCELLANEOUS<br />

28. Posting of Members of the Service : (1) Every member of the Service shall, unless he/she<br />

is appointed to an ex-cadre post, or is otherwise not available for holding a duty post owing to the exigencies<br />

of Public Service, be posted against a duty post by the Government.<br />

(2) A member of the service shall be liable to be posted anywhere within the State or to required in<br />

the interest of public service. In such a case, the member of the Service shall have no right to challenge or<br />

complain against such posting or transfer.<br />

(3) A member of the service in the entry grade shall have to serve compulsorily a minimum period<br />

of 3 years in independent C.O. HQ. Failure to serve the minimum period in such posting, inspite of getting a<br />

posting in such a place, will amount to serious misconduct for which the officer can be denied promotion to<br />

the higher grade.<br />

29. Duty post to be held by a member of the Service : Every post included in the Schedule<br />

shall be held by a member of the service.<br />

Provided that a duty post in Senior Grade or Selection Grade of the Service may also be held by an<br />

Officer in the junior scale of the Indian Administrative Service cadre of the Joint Arunachal Pradesh, Goa,<br />

Mizoram and Union Territory Cadre and a duty post in the Administrative Grade by an officer in the senior<br />

scale of the same Indian Administrative Service and in that event such duty post shall be treated to have<br />

been excluded from the Service till it is held by such Officer.<br />

30. Seniority : The Government shall prepare a list of members of the service arranged in order<br />

of Seniority as determined in the manner specified below :<br />

(1) Members of the Service appointed at the initial constitution under Rule 16 (shall be ranked<br />

inter-se senior in the order of their relative seniority as determined under the provisions of the Arunachal<br />

Pradesh Civil Service Rules, 1995, Arunachal Pradesh Civil Service (Junior) Rules, 1980 and Arunachal<br />

Pradesh Public Service Combined Competitive Examination Rules, 2001 respectively.<br />

Provided that if the seniority of any such officer had not been specifically determined under the<br />

Arunachal Pradesh Civil Service Rules, 1995 or Arunachal Pradesh Civil Service (Junior) Rules, 1980 and<br />

Arunachal Pradesh Public Service Combined Competitive Examination Rules, 2001 or before the<br />

commencement of these rules, it shall be determined by the Government.<br />

(2) Subject to the provisions of sub-rule (3), and general instructions issued by the government in<br />

the matter and by the Central Government (as are applicable to the employees of the Government of<br />

Arunachal Pradesh), the seniority of persons recruited to the Service after initial constitution shall be<br />

determined in the manner specified below :<br />

(i) Persons recruited on the basis of the results of the competitive examination in any year<br />

be ranked inter-se in the order of merit in which they are placed at the competitive<br />

examination on the basis of later examination.<br />

(ii) The relative seniority inter-se of persons recruited by lateral entry by selection shall be<br />

determined on the basis of the order in which their names are arranged in the list prepared<br />

under Rule 14, those recruited on the basis of a lateral selection.<br />

(iii) The relative seniority of direct recruits and of lateral entry shall be determined according<br />

to the rotation of vacancies between direct recruits and lateral entry which shall be based<br />

on the quotas of vacancies reserved for direct recruitment and lateral entry under Rule 5.<br />

Provided that if adequate number of direct recruits or lateral entry do not become available in any<br />

particular year, rotation of quotas for the purpose of determining seniority would take place only to the extent<br />

of available direct recruits and the lateral entry, as per instructions contained in Government of India<br />

(Department of Personnel) OM <strong>No</strong>. 35014/2/80-Est.(d) dated 7th February, 1986 and the additional recruits<br />

in any of the two categories would be, in the seniority list based on the rotation of the vacancies for that year.<br />

(3) All persons appointed to the Service in terms of Rule 6 shall be junior to all persons who are<br />

members of the Service and those who have been selected for appointment to the Service under clauses<br />

(a) and (b) of Sub-rule (l) of Rule 5 before such appointment and shall be senior to the persons who are<br />

subsequently selected for appointment to the Service. The inter-se seniority of such persons will be<br />

determined with reference to the length of continuous regular service rendered by them in any post<br />

included in Schedule I.

(4) Any case not covered by the above provisions, seniority shall be determined by the Government<br />

in consultation with the Commission.<br />

(5) <strong>No</strong>twithstanding anything contained in these rules, members of the Service appointed to the<br />

Administrative grade under Rule 27 of these rules shall be ranked inter-se in the order of their relative<br />

seniority ad determined by the Committee constituted under Sub-rule (l) of rule 27 senior to all other<br />

members of the Service who were appointed either to Senior grade or Selection Grade of the Service under<br />

various provisions of these rules.<br />

31. Cadre Review : All matters relating to the number of posts in various grades of the service,<br />

addition of any posts to, or removal of any posts from the cadre of the service shall be reviewed from time<br />

to time by a Cadre Review Committee, consisting of :<br />

1. Chief Secretary - Chairman<br />

2. Commissioner/Secretary of the Department - Member<br />

3. Commissioner/Secretary of AR Department - Member<br />

4. One APST officer not below the rank of the<br />

Secretary to the Govt. member, if none of<br />

the above Member belongs to the APST. - Member<br />

<strong>No</strong> Cadre post shall be decadred without the consent of Cadre Review Committee.<br />

32. Pay and Allowances :- The scale of pay attached to the Service at the commencement of this<br />

rule shall be as follows :-<br />

(i) APCS (Entry Grade) : Rs. 8000-275-13500/-<br />

(ii) APCS (Senior Grade) : Rs. 10000-325-15200/-<br />

(iii) APCS (Selection Grade) : Rs. 12000-375-16500/-<br />

(iv) APCS (Administrative Grade) : Rs. 14300-400-18300/-<br />

(2) A person recruited on the results of competitive examination shall on appointed to the service,<br />

draw pay at the minimum of the time scale.<br />

Provided that if he held a permanent post, other than a tenure post is a substantive capacity prior to<br />

his appointed to the Service, his pay during the period of his probation in the Service shall be regulated<br />

under the provision of Fundament Rule 22. The pay and increment in the case of other persons appointed<br />

to the Service shall be regulated in accordance with the Fundamental Rules.<br />

(3) Dearness and other allowances shall be paid to persons holding duty posts at such rates as<br />

may be determined by the Government from time to time.<br />

33. Regulations : The Government may make regulations or issue instructions, not inconsistent<br />

with these rules, to provide for which provisions is necessary or expedient for the purpose of giving effect to<br />

these rules.<br />

34. Residuary matters : In regard to matters not specifically covered by these rules or by<br />

regulations or orders issued there under or by special orders, the members of the service shall be governed<br />

by rules, regulations and orders applicable to corresponding officers serving in connection with the affairs of<br />

the state.<br />

35. Interpretation : If any question arises as to the interpretation of these rules, the Government<br />

decision shall be final.<br />

PART - X TRANSITIONAL ARRANGEMENTS<br />

36. Transitional Provision : On and from the commencement of these rules and until persons<br />

are appointed to hold the duty posts in accordance with the provisions of these rules, such posts may<br />

continue to be held by officers appointed thereto as if these rules have not come into force.<br />

37. Power to relax : Where the Govennnent is of the opinion that it is necessary or expedient to<br />

do so, it may, by order, for reasons to be recorded in writing and in consultation with the Commission, relax<br />

any of the provisions of these rules with respect to any class or category of persons or posts.<br />

38. Saving : <strong>No</strong>thing in these rules shall affect reservations and other concessions required to be<br />

provided for the Arunachal Pradesh Scheduled Tribes and other special categories of persons in accordance<br />

with the orders issued by the Government from time to time in this regard.<br />

39. Repeal : (1) The Arunachal Pradesh Civil Service Rules, 1995 and the Arunachal Pradesh<br />

Civil Service (Junior) Rules, 1980 are hereby repealed.<br />

(2) <strong>No</strong>twithstanding such repeal anything done or any action under the Arunachal Pradesh Civil<br />

Service Rules, 95 the Arunachal Pradesh Civil Service (Junior) Rules, 1980 and amendments thereof -shall<br />

be deemed to have been validly done or taken under these rules.<br />
