Government <strong>on</strong> the Strengthening <strong>of</strong> <str<strong>on</strong>g>No</str<strong>on</strong>g>n-Tax Income Management;<br />

- Pursuant <strong>to</strong> the Joint <str<strong>on</strong>g>Prakas</str<strong>on</strong>g> <str<strong>on</strong>g>No</str<strong>on</strong>g>. 995 SHV. BRK dated 28 December 2012 <strong>on</strong> the<br />

Provisi<strong>on</strong> <strong>of</strong> Public Service <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning<br />

and C<strong>on</strong>structi<strong>on</strong>.<br />

ARTICLE 1:<br />

HEREBY DECIDE<br />

The incentive b<strong>on</strong>us is provided <strong>to</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban<br />

Planning and C<strong>on</strong>structi<strong>on</strong> and the <strong>Ministry</strong> <strong>of</strong> Ec<strong>on</strong>omy and Finance, Sub-nati<strong>on</strong>al<br />

administrati<strong>on</strong> (Capital hall, provincial hall, city hall, district, khan, commune, and<br />

sangkat) for supporting the <strong>on</strong>-duty <strong>of</strong>ficers and other <strong>of</strong>ficers <strong>on</strong> public service provisi<strong>on</strong><br />

as well as strengthening the mechanism <strong>of</strong> revenue collecti<strong>on</strong>.<br />

ARTICLE 2:<br />

The provisi<strong>on</strong> <strong>of</strong> this incentive b<strong>on</strong>us is separately divided between central<br />

administrati<strong>on</strong> and capital and provincial competent department <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong><br />

Management, Urban Planning and C<strong>on</strong>structi<strong>on</strong> and the <strong>Ministry</strong> <strong>of</strong> Ec<strong>on</strong>omy and<br />

Finance, based <strong>on</strong> the ground task divisi<strong>on</strong> in public service provisi<strong>on</strong> implemented by<br />

central administrati<strong>on</strong> and public service provisi<strong>on</strong> implemented by capital and provincial<br />

competent department.<br />

ARTICLE 3:<br />

Central administrati<strong>on</strong> <strong>of</strong> <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning and<br />

C<strong>on</strong>structi<strong>on</strong> and capital and provincial cadastral Department <strong>of</strong> <strong>Land</strong> Management,<br />

Urban Planning and C<strong>on</strong>structi<strong>on</strong> is allowed <strong>to</strong> withhold the incentive b<strong>on</strong>us porti<strong>on</strong> by<br />

withdrawing the separately collected revenue from public service as determined in the<br />

joint <str<strong>on</strong>g>Prakas</str<strong>on</strong>g> <str<strong>on</strong>g>No</str<strong>on</strong>g>.r 995 SHV. BRK dated 28 December 2012 <strong>on</strong> the provisi<strong>on</strong> <strong>of</strong> public<br />

service <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning and C<strong>on</strong>structi<strong>on</strong>. Advance<br />

withdrawal <strong>of</strong> this incentive b<strong>on</strong>us is c<strong>on</strong>sidered as advance payment provided by the<br />

nati<strong>on</strong>al budget <strong>to</strong> the central administrati<strong>on</strong> <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban<br />

Planning and C<strong>on</strong>structi<strong>on</strong> and capital and provincial cadastral department for the support<br />

<strong>to</strong> the <strong>of</strong>ficers and strengthening the mechanism <strong>of</strong> revenue collecti<strong>on</strong> as set in Article 1<br />

<strong>of</strong> this joint <str<strong>on</strong>g>Prakas</str<strong>on</strong>g>. The incentive b<strong>on</strong>us which is allowed for advance withholding<br />

including the incentive b<strong>on</strong>us porti<strong>on</strong> <strong>of</strong> <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning

and C<strong>on</strong>structi<strong>on</strong>, the incentive b<strong>on</strong>us porti<strong>on</strong> <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> Ec<strong>on</strong>omy and Finance,<br />

and the incentive b<strong>on</strong>us porti<strong>on</strong> <strong>of</strong> relevant sub-nati<strong>on</strong>al administrati<strong>on</strong>.<br />

ARTICLE 4:<br />

The provisi<strong>on</strong> <strong>of</strong> the incentive b<strong>on</strong>us <strong>to</strong> the central administrati<strong>on</strong>, capital and<br />

provincial competent department, and relevant sub-nati<strong>on</strong>al administrati<strong>on</strong> is determined<br />

as percentage proporti<strong>on</strong> compared <strong>to</strong> the revenue collected as set out in the annex table<br />

attached with this joint <str<strong>on</strong>g>Prakas</str<strong>on</strong>g>.<br />

ARTICLE 5:<br />

Central administrati<strong>on</strong> <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning and<br />

C<strong>on</strong>structi<strong>on</strong> and Capital and provincial cadastral department shall plan the revenue and<br />

expense subject <strong>to</strong> the provisi<strong>on</strong> <strong>of</strong> the incentive b<strong>on</strong>us in separate annual budget <strong>on</strong><br />

revenue and expense plan. The central administrati<strong>on</strong> <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong><br />

Management, Urban Planning and C<strong>on</strong>structi<strong>on</strong> shall plan the incentive b<strong>on</strong>us credit<br />

including the credit for the expense <strong>on</strong> the incentive b<strong>on</strong>us for the central administrati<strong>on</strong><br />

<strong>of</strong> the Capital and provincial Department <strong>of</strong> Ec<strong>on</strong>omy and Finance.<br />

All operati<strong>on</strong>s <strong>of</strong> revenue and expense shall be recorded in the nati<strong>on</strong>al budget as<br />

other operati<strong>on</strong> <strong>of</strong> revenue and expense <strong>of</strong> central administrati<strong>on</strong> and capital and<br />

provincial competent department <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning<br />

and C<strong>on</strong>structi<strong>on</strong>. Credit planned for this incentive b<strong>on</strong>us is subject <strong>to</strong> m<strong>on</strong>ey withdrawal<br />

mandate <strong>to</strong> make payment for the amount <strong>of</strong> m<strong>on</strong>ey c<strong>on</strong>sidered as advance payment from<br />

the nati<strong>on</strong>al budget (advance withheld revenue).<br />

The revenue and expense record in nati<strong>on</strong>al budget operati<strong>on</strong> <strong>on</strong> the incentive<br />

b<strong>on</strong>us, shall be implemented in accordance with the procedure <strong>of</strong> advance payment as<br />

follows:<br />

A. Revenue secti<strong>on</strong>: record <strong>on</strong> revenue in the nati<strong>on</strong>al budget <strong>on</strong> the amount <strong>of</strong><br />

advance payment shall be made :<br />

- For central administrati<strong>on</strong> <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning<br />

and C<strong>on</strong>structi<strong>on</strong> shall prepare and send the nati<strong>on</strong>al revenue sheet <strong>to</strong> n<strong>on</strong>-tax<br />

income department <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> Ec<strong>on</strong>omy and Finance by attaching with the<br />

report <strong>of</strong> situati<strong>on</strong> <strong>on</strong> the revenue implementati<strong>on</strong> and the table <strong>on</strong> the b<strong>on</strong>us<br />

calculati<strong>on</strong> as well as the report <strong>on</strong> the incentive b<strong>on</strong>us divisi<strong>on</strong> previously<br />

provided. <str<strong>on</strong>g>No</str<strong>on</strong>g>n-tax income department shall issue c<strong>on</strong>firmati<strong>on</strong> letter <strong>on</strong> the<br />

amount <strong>of</strong> the reported revenue.<br />

- For the capital and provincial Department <strong>of</strong> <strong>Land</strong> Management, Urban Planning<br />

and C<strong>on</strong>structi<strong>on</strong>s shall prepare and send the nati<strong>on</strong>al revenue sheet <strong>to</strong> the capital<br />

and provincial Department <strong>of</strong> Ec<strong>on</strong>omy and Finance by attaching with the report

<strong>of</strong> situati<strong>on</strong> <strong>on</strong> the revenue implementati<strong>on</strong> and table <strong>on</strong> the incentive b<strong>on</strong>us<br />

calculati<strong>on</strong><br />

as well as the report <strong>on</strong> the incentive b<strong>on</strong>us divisi<strong>on</strong> previously provided. Capital<br />

and provincial <strong>of</strong> the department <strong>of</strong> Ec<strong>on</strong>omy and Finance shall issue<br />

c<strong>on</strong>firmati<strong>on</strong> letter <strong>on</strong> the amount <strong>of</strong> the reported revenue.<br />

B. Expense secti<strong>on</strong>: Withdrawal mandate recording the expense amount which is<br />

equal <strong>to</strong> advance payment recorded in nati<strong>on</strong>al revenue sheet shall be made.<br />

ARTICLE 6:<br />

Up<strong>on</strong> the completi<strong>on</strong> <strong>of</strong> all procedures as set in Article 5 above the incentive<br />

b<strong>on</strong>us withdrawal shall be implemented as follows:<br />

A. Incentive b<strong>on</strong>us provisi<strong>on</strong> <strong>to</strong> the <strong>of</strong>ficers <strong>of</strong> the <strong>Ministry</strong> <strong>Land</strong> Management,<br />

Urban Planning and C<strong>on</strong>structi<strong>on</strong> shall comply with the decisi<strong>on</strong> <strong>of</strong> the minister<br />

<strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning and C<strong>on</strong>structi<strong>on</strong> based <strong>on</strong><br />

equity principle and work qualificati<strong>on</strong>.<br />

B. Incentive b<strong>on</strong>us provisi<strong>on</strong> <strong>to</strong> the <strong>of</strong>ficers <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> Ec<strong>on</strong>omy and Finance<br />

shall comply with the decisi<strong>on</strong> <strong>of</strong> the minister <strong>of</strong> the <strong>Ministry</strong> <strong>of</strong> Ec<strong>on</strong>omy and<br />

Finance based <strong>on</strong> equity principle and work qualificati<strong>on</strong>..<br />

ARTICLE 7:<br />

ARTICLE 8:<br />

Any regulati<strong>on</strong>s c<strong>on</strong>trary <strong>to</strong> this joint <str<strong>on</strong>g>Prakas</str<strong>on</strong>g> shall be c<strong>on</strong>sidered abrogated.<br />

Department and Head <strong>of</strong> relevant entities under the <strong>Ministry</strong> <strong>of</strong> Ec<strong>on</strong>omy and Finance,<br />

and the <strong>Ministry</strong> <strong>of</strong> <strong>Land</strong> Management, Urban Planning and C<strong>on</strong>structi<strong>on</strong> shall<br />

effectively implement this joint <str<strong>on</strong>g>Prakas</str<strong>on</strong>g> from this signa<strong>to</strong>ry date here<strong>on</strong>.<br />
