<strong>Afghanistan</strong> <strong>Report</strong> <strong>2009</strong><br />

Rule of Law<br />

Italy, as <strong>Afghanistan</strong>’s partner nation for judicial reform,<br />

provided the impetus to improve coordination amongst<br />

all the key international partners by hosting a conference<br />

in Rome in 2007.<br />

RULE OF LAW<br />

The Rome Conference on the Rule of Law in<br />

<strong>Afghanistan</strong> resulted in the National Justice Programme<br />

(NJP) – a five-year reform programme that<br />

implements the vision outlined in the sector strategy.<br />

A total of 360 million USD was pledged during<br />

the conference. Recent developments include :<br />

• National Justice Sector Strategy and the<br />

National Justice Programme established in<br />

March 2008 ( within the framework of the Afghan<br />

Reconstruction Trust Fund (ARTF) 12 );<br />

• The Office of the Attorney General and the<br />

Ministry of Interior (MoI) established a joint<br />

commission to draft guidelines for cooperation<br />

between police and prosecutors in the detection<br />

and investigation of crimes;<br />

• The number of registered lawyers in <strong>Afghanistan</strong><br />

tripled from 200 in 2007 to almost 600 in 2008<br />

with 130 being women;<br />

• UNAMA has deployed rule-of-law officers in<br />

each of its regional offices to help coordinate<br />

international support for the justice sector;<br />

Continuing challenges to progress include :<br />

• Chronic lack of resources;<br />

• Inadequate infrastructure and a shortage of<br />

qualified, experienced, educated and trained<br />

judges and prosecutors;<br />

• Inadequate legal infrastructure;<br />

• Implementation of pay and grade reforms<br />

has been slow and has impacted on the<br />

recruitment and retention of competent<br />

officers;<br />

• Corruption and intimidation by and of officials<br />

remain common;<br />

• Justice personnel vulnerable to influence<br />

and coercion, often lack adequate provisions<br />

to guarantee their personal security.<br />

• The Government enacted laws on terrorism,<br />

abduction and human trafficking and on the<br />

creation of the High Office of Oversight to<br />

combat corruption.<br />

Bank and funded by 30 donors established in 2002.<br />
