The highlight of CMHI’s Holiday Open<br />

House at the Riverside Mission Inn on<br />

December 9 th was the announcement of<br />

the recipient of the 2010 Jack E. Wells<br />

Memorial Award.<br />

Honored by his peers <strong>for</strong> his steadfast<br />

and productive work on behalf of our<br />

industry and its customers, Bill Hanks<br />

becomes the 61 st recipient of this<br />

prestigious award.<br />

Mr. Hanks is Vice President of J & H<br />

Asset Property Management, Inc. He<br />

and his business partner, Jim Joffe,<br />

founded the company in 1986. J &<br />

H is a rapidly expanding full service<br />

company, which specializes in the<br />

management of mo<strong>bi</strong>le/manufactured<br />

housing communities. J & H currently<br />

manages properties in Cali<strong>for</strong>nia,<br />

Nevada and Arizona.<br />

Bill has been in the property<br />

management industry, in the<br />

management of mo<strong>bi</strong>le/manufactured<br />

housing communities and apartment<br />

buildings since 1979. He currently<br />

handles the day-to-day responsi<strong>bi</strong>lities<br />

<strong>for</strong> several communities, as well as<br />

administers and oversees the financial<br />

aspects of the company.<br />

Mr. Hanks has been active in local<br />

politics in several city and county<br />

organizations in Cali<strong>for</strong>nia, including<br />

participation in the Oxnard Mo<strong>bi</strong>lehome<br />

Task Force and as a commissioner<br />

on the San Bernardino City Rent<br />

Control Commission. He has spoken<br />

at property management seminars<br />

throughout the state <strong>for</strong> community<br />

owners and managers. He served<br />

a term as president on the Western<br />

Manufactured Housing Communities<br />

Association (WMA) and was on their<br />

Board of Directors <strong>for</strong> several years. He<br />

currently sits as a Board <strong>member</strong> on<br />

the boards of Cali<strong>for</strong>nia Manufactured<br />

Housing Institute (CMHI) and the<br />

Manufactured Housing Educational<br />

Trust (MHET). He is the recipient of the<br />

prestigious Wallace E. Carr Award <strong>for</strong><br />

excellence in industry leadership from<br />

WMA, and the Freedom Fighter’s award<br />

from Cali<strong>for</strong>nia Mo<strong>bi</strong>lehome Parkowners<br />

Alliance (CMPA). Additionally, he has<br />

served on numerous WMA committees<br />

over the years including the Utility<br />

Committee, Education Committee,<br />

Small Park Owners Committee and<br />

currently the Legislative Committee. He<br />

is also currently a <strong>member</strong> of CMHI’s<br />

Legislative Committee.<br />

Bill graduated from Cali<strong>for</strong>nia State<br />

University, Fullerton with a Bachelor’s<br />

Degree in Business Administration.<br />

He is a licensed Real Estate Broker<br />

and has earned the designation of<br />

CPM® (Certified Property Manager)<br />

through the Institute of Real Estate<br />

Management. Bill and his wife, Mindy,<br />

reside in Riverside.<br />

CMHI Board of Directors, staff and<br />

Connie Lamphear – 2010<br />

Lifetime Achievement Award<br />

Recipient<br />

Connie is overwhelmed at being<br />

honored <strong>for</strong> 32 years of service to<br />

CMHI<br />

Connie began her career in the<br />

mo<strong>bi</strong>le/manufactured housing industry<br />

in September 1979. Hired by CMHI’s<br />

predecessor, Western Manufactured<br />

Housing Institute (WMHI) on a part-time<br />

basis to prepare consumer materials<br />

<strong>for</strong> the association’s annual Dodger<br />

Show, she quickly became an asset to<br />

the organization. Her part-time status<br />

evolved into a full time position with<br />

WMHI in December 1980 when she<br />

took over the reigns of the mail room<br />

and copy center.<br />

Ms. Lamphear was in charge of<br />

WMHI’s HUD Label Department where<br />

she filled sales orders of required<br />

HUD labels and shipped them to<br />

manufacturers across the western<br />

United States. She efficiently worked<br />

with label producer, DecoArt, to keep<br />

pace with the many changes required<br />

by HUD.<br />

Her assistance with the planning<br />

and execution of WMHI shows,<br />

meetings and events were instrumental<br />

in ensuring the success of these<br />

functions. By late 1984, she was<br />

appointed WMHI receptionist and<br />

administrative assistant to the president<br />

of the association. Her loyalty and<br />

tenacity allowed the successful<br />

transition of WMHI to the Cali<strong>for</strong>nia<br />

Manufactured Housing Institute<br />

(CMHI) in June of 1986. In addition<br />

to her receptionist and administrative<br />

assistant duties, she was appointed<br />

director of Membership Services.<br />

Connie completed computer courses<br />

in word processing and Pitney Bowes<br />

SmartMail® software programs to<br />

assist her in mailings of <strong>member</strong><br />

correspondence and CMHI publications<br />

which often totaled over 7500 pieces<br />

per mailing. In an ef<strong>for</strong>t to stay up-todate<br />

with today’s modern technology,<br />

she also has become proficient in Excel<br />

Spreadsheet and daily maintenance<br />

of CMHI’s website. Ms. Lamphear<br />

has assumed the role of association<br />

historian, librarian and event planner<br />

extraordinaire.<br />

She has two grown children; son,<br />

Bob Vogel and his wife Lisa and her<br />

daughter, Jami and her husband, Tad<br />

Wilson. She is the proud Grandma to<br />

two adorable grandchildren, Trey, age 5<br />

and Kaitlyn, age 4.<br />

For 32 years of achievement on<br />

behalf on CMHI <strong>member</strong>s, staff and<br />

most importantly <strong>for</strong> her concern and<br />

assistance to our homeowners, the<br />

2010 Lifetime Achievement Award is<br />

well earned!<br />

The first time she saw a trailer she<br />

was nine years old with her dad who<br />

was an accountant <strong>for</strong> a company<br />

called Chicago Trailer House that built<br />

shelter <strong>for</strong> the military and gypsies.<br />

A few years later her dad, Jerry<br />

Golden, had an opportunity to run a<br />

trailer factory in Monrovia, CA. The<br />

family moved there six months later and<br />

that is how Joan’s story began.<br />

In 1965, her dad started Golden West<br />

Homes in Fullerton, CA. Joan’s mom<br />

was the receptionist and made all color<br />

choices <strong>for</strong> the homes. In 1968, Golden<br />

West opened its second plant in Santa<br />

Ana, CA and her mother expanded her<br />

responsi<strong>bi</strong>lities to include all the interior<br />

design. That year, Joan began working<br />

part-time to help her mom with design<br />

work. Later on <strong>for</strong> a Housing Show at<br />

Dodger Stadium, Joan’s mother dared<br />

her to decorate one of the models on<br />

her own. She accepted the challenge,<br />

did a “Western Theme” and the house<br />

was sold at the show, fully furnished.<br />

Today that house still stands in Malibu,<br />

CA overlooking the ocean.<br />

After many great years, Golden West<br />

merged with Oakwood in 1994. In 1997,<br />

after a two year sabbatical, Joan’s<br />

husband Harry founded Karsten Homes<br />

of New Mexico and she became the<br />

Interior Design Manager. The company<br />

expanded through a merger with<br />

Harry’s brother, Andy and the Andrew<br />

Karsten Company. They went on to<br />

open Karsten facilities in Stayton,<br />

Oregon and Breckenridge, Texas and<br />

Joan’s role expanded to include design<br />

responsi<strong>bi</strong>lity <strong>for</strong> all the plants. After<br />

eight successful years operating the<br />

four Karsten facilities, Harry and Joan<br />

joined Clayton in 2005 through its<br />

acquisition of Karsten Homes. After,<br />

the acquisition, Joan’s responsi<strong>bi</strong>lities<br />

were expanded to include several other<br />

Clayton owned operations such as<br />

Golden West, Schult and Marlette.<br />

Every product line Joan Karsten<br />

has lent her talents to has been a<br />

design leader in the manufactured<br />

housing industry and there is more<br />

to come. Joan feels <strong>for</strong>tunate that<br />

CURRENT FIRE SPRINKLER<br />

REQUIREMENTS<br />

As we approach the New Year,<br />

questions, rumors and confusion<br />

persist concerning fire sprinkler<br />

system requirements <strong>for</strong> manufactured<br />

housing. Hopefully, the following<br />

will squash the rumors and ease the<br />

confusion:<br />

The 2009 International Residential<br />

Code (IRC) contains requirements <strong>for</strong><br />

fire sprinkler systems in all new one<br />

and two- family dwellings.<br />

By unanimous vote the Cali<strong>for</strong>nia<br />

State Building Standards Commission<br />

adopted the IRC thereby incorporating<br />

the requirement <strong>for</strong> fire sprinkler<br />

systems into the Cali<strong>for</strong>nia Residential<br />

Code (CRC).<br />

All new one and two-family dwelling<br />

units subject to the CRC <strong>for</strong> which<br />

a permit to build is issued on or after<br />

January 1, 2011, must comply with the<br />

Fire Sprinkler System Requirements.<br />

Dwelling unit includes factory-built<br />

(modular) homes.<br />

Manufactured homes must<br />

comply with the HUD Code and are<br />

consequently not governed by the<br />

requirements of the CRC.<br />

Fire sprinkler systems may only be<br />

required in manufactured homes in<br />

jurisdictions that have passed, or pass<br />

in the future, an ordinance requiring<br />

them.<br />

When fire sprinklers are required in<br />

manufactured homes, the systems<br />

must be installed pursuant to Title 25,<br />

Division 1, Chapter 3, Sub-Chapter<br />

2, Article 2.5: Fire Sprinkler Systems.<br />

These preemptive regulations <strong>for</strong><br />

manufactured housing do not mandate<br />

the installation of fire sprinkler systems<br />

in all manufactured homes.<br />

There are approximately 596<br />

jurisdictions in Cali<strong>for</strong>nia – as of<br />

September 3rd 2010 approximately<br />

153 of them have passed ordinances<br />

requiring fire sprinklers in manufactured<br />

homes.<br />

Proposed Changes to<br />

Manufactured Housing<br />

Sprinkler Regulations<br />

On September 2nd 2010, HCD<br />

released a request <strong>for</strong> public comments<br />

on proposed amendments to current<br />

manufactured housing fire sprinkler<br />

regulations.<br />

Section 4306 of the current regulations<br />

reads as follows:<br />

“It is unlawful <strong>for</strong> any person to<br />

sell, offer <strong>for</strong> sale, rent, or lease<br />

within this state any manufactured<br />

home or multi unit multifamily<br />

manufactured housing home with<br />

two dwelling units, if a fire sprinkler<br />

system already installed or intended<br />

to be installed in the manufactured<br />

home or in multi unit multifamily<br />

manufactured housing home<br />

with two dwelling units will not<br />

operate properly given the<br />

water pressure available at the<br />

proposed installation site.”<br />

On October 13, 2010 CMHI responded<br />

to HCD’s request <strong>for</strong> comments as<br />

follows:<br />

When the sale of a home does not<br />

include the installation of the home,<br />

the seller does not necessarily know<br />

where or when the home is to be<br />

installed. This is especially true<br />

<strong>for</strong> cash sales and the increasing<br />

number of FOB sales.<br />

Even when the seller knows where<br />

the home will be installed, there<br />

is no practical way <strong>for</strong> the seller<br />

to know that the necessary water<br />

pressure is available at the time of<br />

the sale nor is there a way to ensure<br />

that the home buyer will have the<br />

necessary pressure available at the<br />

time of installation. There<strong>for</strong>e, we<br />

believe declaring a sale an unlawful<br />

act <strong>for</strong> a condition over which the<br />

seller has limited or no knowledge<br />

and absolutely no control is<br />

inappropriate.<br />

It is CMHI’s position that the<br />

home purchaser would be better<br />

protected by requiring a mandatory<br />

disclosure, to be signed by the<br />

prospective purchaser prior to<br />

the signing of any purchase<br />

documents. The disclosure should<br />

in<strong>for</strong>m the prospective purchaser<br />

that the subject home has or may<br />

be required to have a fire sprinkler<br />

system and of the required water<br />

flow and pressure necessary to<br />

properly operate the system.<br />

There<strong>for</strong>e, CMHI respectfully<br />

recommends that HCD strike the<br />

currently proposed language in<br />

Section 4306 and replace it with<br />

an appropriate Fire Sprinkler<br />

Disclosure Statement.<br />

On November 15, 2010 HCD issued<br />

a notice of “modifications to text of<br />

proposed regulations” which is in<br />

concert with CMHI’s recommendations<br />

<strong>for</strong> Section 4306.<br />

It is CMHI’s position that the new<br />

language in Section 4306, if adopted,<br />

better protects and serves the buyer<br />

and seller of the home. We very much<br />

appreciate the cooperative ef<strong>for</strong>ts from<br />

all concerned parties.

design career spans fourteen years, at<br />

her side. Actually, it is our industry that<br />

is <strong>for</strong>tunate…..that the “Golden Touch”<br />

goes on!<br />

TAXPAYER ALERT: EMAIL<br />

SCAM TARGETS BOE<br />

TAXPAYERS<br />

Cali<strong>for</strong>nia’s State Board of<br />

Equalization is warning taxpayers of<br />

a possible email scam. Several BOE<br />

taxpayers have notified BOE that they<br />

have received an email which appears<br />

to be from a tax agency and states<br />

that the taxpayer’s federal Electronic<br />

Funds Transfer (EFT) payments did not<br />

go through. The email then directs<br />

the taxpayer to another website <strong>for</strong><br />

additional in<strong>for</strong>mation. The email is not<br />

from a tax agency, neither the federal<br />

IRS nor the State BOE.<br />

Taxpayers should not click on the link<br />

or respond to the sender as it may be<br />

a phishing scam. Phishing is a type of<br />

fraud where an email that appears to<br />

be from a trustworthy entity is used to<br />

acquire sensitive in<strong>for</strong>mation such as<br />

usernames, passwords or credit card<br />

and other personal details.<br />

IRS is aware of this scam and has<br />

in<strong>for</strong>mation available at:<br />

The BOE is working with the IRS to<br />

investigate this situation. If taxpayers<br />

have a question about a BOE EFT<br />

payment, they may call the BOE<br />

Taxpayer In<strong>for</strong>mation Section at 800-<br />

400-7115 or the BOE’s EFT Helpline<br />

at 916-327-4229 to inquire if their<br />

payment has been made.<br />

BOE suggests that taxpayers check<br />

their bank accounts to verify account<br />

status and whether EFT payments<br />

have transmitted. Current normal<br />

protocol when EFT payments are<br />

returned unpaid is that BOE either<br />

makes a phone call to the taxpayer or<br />

sends a <strong>bi</strong>ll through the mail. The BOE<br />

does not regularly send email notices<br />

regarding EFT payment rejections.<br />

Frank Walter Standards Award<br />

Bill Farish, Director of Engineering<br />

– Commercial Structure <strong>for</strong> Clayton<br />

Homes was honored with the Frank<br />

Walter Standards Award. This<br />

award recognizes individuals who<br />

have made vital contributions to the<br />

development of codes and standards<br />

<strong>for</strong> the manufactured housing industry,<br />

ensuring that our homes are built to<br />

the highest level of quality <strong>for</strong> our<br />

customers.<br />

Farish has worked in the industry<br />

<strong>for</strong> 33 years. He is a registered<br />

professional engineer in 30 states<br />

and received his Bachelor of Science<br />

degree in Aerospace Engineering from<br />

the University of Texas at Austin and<br />

his Masters in Civil Engineering from<br />

the University of Texas at Arlington.<br />

He was a founding <strong>member</strong> of<br />

the HUD Manufactured Housing<br />

Consensus Committee and is a past<br />

Chairman of the Technical Activities<br />

Committee. He currently provides<br />

excellent leadership as Chairman of the<br />

Systems Building Research Alliance.<br />

Antifreeze Within Fire Sprinkler<br />

Systems<br />

On October 26, 2010, the State Fire<br />

Marshall issued an In<strong>for</strong>mation Bulletin<br />

concerning the use of antifreeze in fire<br />

sprinkler systems. The following is a<br />

summary of the new regulations:<br />

The approved emergency regulations<br />

will require that only pre-mixed<br />

antifreeze solutions in concentrations<br />

not to exceed 40% propylene<br />

glycol and concentrations of glycerin<br />

not exceeding 50% in residential<br />

occupancies and other dwelling units<br />

be permitted <strong>for</strong> the protection of<br />

sprinkler pipe in freezing conditions.<br />

The use of antifreeze shall only be<br />

used as a last method <strong>for</strong> protection,<br />

with consideration given to recorded<br />

prolonged freezing temperatures,<br />

and approved by the authority having<br />

jurisdiction. This modification is<br />

effective on January 1, 2011.<br />

REPORTS FISCAL SECOND<br />

QUARTER RESULTS<br />

Phoenix-based Cavco Industries Inc.,<br />

which acquired Fleetwood Homes in<br />

August 2009, saw its financial results<br />

improve <strong>for</strong> the 2011 second quarter<br />

as well as <strong>for</strong> the first half of the fiscal<br />

year. For the three-month period, the<br />

manufactured home company posted<br />

net sales of $45.8 million – a gain of<br />

56 percent from net sales of $29.3<br />

million a year earlier. For the first six<br />

months of fiscal 2011, meanwhile, net<br />

sales at Cavco surged 117 percent<br />

to $93.3 million from $42.9 million<br />

during the same time frame of fiscal<br />

2010. “We achieved profita<strong>bi</strong>lity in<br />

a very difficult market environment,”<br />

stated Cavco Chairman, President,<br />

and CEO Joseph Stegmayer. “We<br />

have placed a consistent focus on<br />

developing synergies among all<br />

operations to improve sales and<br />

margins since the Fleetwood Homes<br />

business com<strong>bi</strong>nation one year ago.”<br />

Stegmayer also expressed excitement<br />

about his newly added role as chair<br />

of the Manufactured Housing Institute<br />

<strong>for</strong> the next two years. “MHI’s primary<br />

role is to assist the entire industry in<br />

RECOGNIZED BY HUD FOR<br />

MHCC SERVICE<br />

RADCO is proud to announce that its<br />

President & CEO, Michael I. Zieman,<br />

P.E., was recently recognized <strong>for</strong><br />

his service on HUD’s Manufactured<br />

Housing Consensus Committee<br />

(MHCC).<br />

RADCO is a recognized leader in the<br />

manufactured housing industry with<br />

more than 40 years of expertise in the<br />

areas of plan review, quality auditing,<br />

certifications and building codes.<br />

In a personal letter to Zieman, HUD’s<br />

Assistant Secretary <strong>for</strong> Housing –<br />

Federal Housing Commissioner David<br />

H. Stevens said, “On behalf of the<br />

Department of Housing and Urban<br />

Development, I wish to thank you <strong>for</strong><br />

your service on the Manufactured<br />

Housing Consensus Committee<br />

(MHCC) and your significant<br />

contribution to the deliberations and<br />

debate in the pursuit of the public’s<br />

interest in manufactured housing.<br />

Your commitment to public service is<br />

commendable as evidenced by your<br />

untiring ef<strong>for</strong>ts on the MHCC’s behalf.<br />

We further commend RADCO <strong>for</strong> its<br />

complete support of your many hours<br />

of participation.”<br />

Originally appointed by HUD<br />

Secretary Mel Martinez in 2002 as<br />

one of the founding <strong>member</strong>s of the<br />

MHCC, Zieman served tirelessly <strong>for</strong><br />

more than eight years. During his<br />

entire tenure he was the only third party<br />

representative on the Committee, and<br />

served as chairperson of its Standards<br />

Subcommittee. One of Mr. Zieman’s<br />

passions was to see that the HUD’s<br />

standards <strong>for</strong> manufactured housing<br />

were updated to stay competitive<br />

with site built housing and current<br />

technologies. In this vein he helped to<br />

spearhead more than 200 code change<br />

recommendations to HUD on behalf of<br />

the MHCC.<br />

“Being able to serve HUD, the<br />

industry and its consumers on the<br />

MHCC has been a gratifying and<br />

humbling experience,” said Zieman.<br />

“It was gratifying to see how the group<br />

grew in maturity from its initial meeting<br />

where people were feeling each<br />

other out to full-blown cooperation in<br />

working together to do what is best <strong>for</strong><br />

all stakeholders. Though the MHCC<br />

<strong>member</strong>s represent diverse interest<br />

over the years most recommendations<br />

to HUD had near if not total unanimous<br />

support of all <strong>member</strong>s. It was<br />

humbling to see firsthand the breadth<br />

and depth of expertise as well as<br />

the commitment that each <strong>member</strong><br />

brought to the table. I would especially<br />

like to mention Dana Roberts who<br />

provided outstanding leadership as<br />

committee chair <strong>for</strong> many years.”<br />

ABOUT THE MHCC: The MHCC<br />

was created by Congress as a<br />

federal advisory committee with<br />

additional responsi<strong>bi</strong>lities. Among<br />

other things it is responsible <strong>for</strong><br />

providing recommendations to the<br />

Secretary of HUD on the Federal<br />

manufactured housing construction<br />

and safety standards, manufactured<br />

housing installation standards<br />

and all related regulations. The<br />

22-<strong>member</strong> committee is made up of<br />

individuals across three categories:<br />

seven producers and retailers of<br />

manufactured housing, seven users<br />

of manufactured housing, and seven<br />

general interest/public officials.<br />

IN MEMORIAM<br />

Helen L. Bertussi (June 1923 ~<br />

September 2010)<br />

Helen Bertussi was more than a<br />

stay-at-home mother to eight children;<br />

she was a true pioneer of today’s<br />

manufactured housing industry with a<br />

career spanning over 50 years.<br />

In 1956, Helen and her husband,<br />

John, sold their family’s dairy business<br />

to purchase a 20 space trailer park<br />

in El Centro, Cali<strong>for</strong>nia. After a few<br />

renovations, they moved their family to<br />

Pioneer Trailer Park and were open to<br />

the public.<br />

Business was great and Helen<br />

enjoyed housing people both long<br />

and short term, but she knew there<br />

were more opportunities within the<br />

industry. At first she bought, renovated<br />

and sold used trailer units but quickly<br />

established herself with new mo<strong>bi</strong>le<br />

home inventory and started Pioneer<br />

Trailer Sales, one of the first businesses<br />

of its kind.<br />

Helen established several loyal<br />

relationships with factories like<br />

Fleetwood/Cavco, Silvercrest, Skyline<br />

Homes, Brandon by Celtic Corporation,<br />

Viking Homes and Marlette. She<br />

continually out sold every competitor<br />

and was acknowledged with several<br />

trophies and awarded with trips around<br />

the world.<br />

No doubt she enjoyed the perks of<br />

her success, but mostly, she cherished<br />

her business. She had compassion <strong>for</strong><br />

helping people within the community<br />

and philanthropic dedication through<br />

the local Soroptimist Club; an<br />

international organization <strong>for</strong> business<br />

and professional women.<br />

After 25 years, her legacy continues.<br />

From sales to construction, Pioneer<br />

Trailer Sales remains a family affair.<br />

Today, Pioneer Af<strong>for</strong>dable Homes<br />

is Cali<strong>for</strong>nia’s oldest manufactured<br />

housing dealership; owned by her<br />

son, providing the most af<strong>for</strong>dable<br />

manufactured and modular living<br />

alternatives.<br />

At 87, Helen continued to operate<br />

Pioneer Trailer Park maintaining close<br />

relationships with her tenants and<br />

business associates alike. She will be<br />

re<strong>member</strong>ed <strong>for</strong> her enthusiasm <strong>for</strong> life<br />

and passion <strong>for</strong> business.<br />

Young J. Paik (1930 ~ 2010)<br />

Born in Korea in 1930, Young lived<br />

the first 15 years of his life under<br />

Japanese rule. When World War II<br />

ended in 1945, Korea became a free<br />

nation. However, when the Korean War<br />

broke out in 1950, in Pyongyang in the<br />

North, Young found himself saluting<br />

a new flag with a red star. He fled to<br />

Seoul by himself at the age of 20.<br />

After scrounging and sometimes<br />

stealing food to survive, he started a<br />

vending business roasting chestnuts.<br />

He saved enough money to enroll in<br />

Yonsei University to pursue a degree in<br />

physics. In postwar Korea, jobs were<br />

scarce and he soon ran out of money<br />

and had to leave school. Through<br />

Heungsadan, an organization <strong>for</strong><br />

young people he learned of a place<br />

called America and was drawn to it<br />

immediately. For the next two years<br />

he focused on obtaining a passport<br />

and a visa. He took test after test from<br />

the Korean government and finally in<br />

January 1956 he arrived in the United<br />

States.<br />

Young worked as a dishwasher<br />

and busboy while at the University<br />

of Oregon, and then at the Indiana<br />

Institute of Technology, where he<br />

earned a degree in civil engineering in<br />

1959.<br />

In 1961, while working as an<br />

engineer-in-training in Ohio, he met his<br />

future wife, Kyung-sook Yang and they<br />

were married.<br />

In 1962, Young received his green<br />

card and he and his wife packed<br />

up and moved to Los Angeles. His<br />

reputation as a capable engineer in the<br />

steel industry began to evolve. After<br />

working 12 years as an engineer <strong>for</strong><br />

several steel companies, he started<br />

his own company, PACO Engineering<br />

Corporation in 1974 offering consulting<br />

services <strong>for</strong> steel structures.<br />

PACO soon became the front runner<br />

in providing welded steel beams to the<br />

manufactured housing industry. An<br />

idea came to Young from an empty<br />

Coca Cola can- the “corrugated<br />

beam”. He noticed that a flimsy<br />

aluminum can became stronger when<br />

it was creased vertically. He put<br />

together the first I-Beam prototype in<br />

his office then convinced Sumitomo of<br />

Japan to manufacture this new beam<br />

system with PACO being the exclusive<br />

distributor in the United States.<br />

Young was a major supporter of<br />

WMHI and CMHI. He was recipient<br />

of CMHI’s 2005 Lifetime Achievement<br />

Award. Young is survived by his wife,<br />

Kyung-sook. His two sons, David<br />

and Nelson manage the day-to-day<br />

business of PACO Engineering Corp.,<br />

and his daughter, Marilyn is a lawyer in<br />

San Francisco.<br />

Young will be deeply missed and<br />

fondly re<strong>member</strong>ed <strong>for</strong> his “Everything<br />

is possible when you put your heart<br />

and soul into it” attitude.<br />

Donald L. DuPar<br />

Don DuPar, partner of Bob Angel,<br />

Angel & Associates, passed away on<br />

October 8, 2010 after a long battle with<br />

cancer.<br />

Don began his professional career as<br />

a police officer after graduating with a<br />

degree in Police Administration from<br />

Golden Gate University in Sacramento<br />

and serving in the U.S. Army <strong>for</strong> three<br />

years. Serving with the Pasadena<br />

Police Department from 1961-’68,<br />

Don transferred to the Novato Police<br />

Department until 1978 when he entered<br />

the manufactured housing business in<br />

retail sales with Burpee and Brekke.<br />

When business declined, Don left the<br />

industry <strong>for</strong> a short time. He returned a<br />

few years later with Burpee and Brekke<br />

and in 1986, the business prospered<br />

and Don purchased the Brekke<br />

interest. With the help of his wife and<br />

children, the business continued to<br />

succeed.<br />

In 1988, Bob Angel became Don’s<br />

partner and the company<br />

became DuPar & Angel (now Angel &<br />

Associates). The company continued<br />

to grow to become the largest volume<br />

retailer in Cali<strong>for</strong>nia. Don attributed the<br />

company’s success to”….always trying<br />

to do their best <strong>for</strong> the customer and<br />

the industry as a whole.”<br />

In 2001, DuPar & Angel was awarded<br />

Retailer of the Year by CMHI. Also in<br />

2001, Mr. DuPar was awarded CMHI’s<br />

Lifetime Achievement Award.<br />

Don in survived by his wife of 49<br />

years, Sheila and three grown children;<br />

Jon, who still works in the business,<br />

Cherie Adamson both of Santa Rosa<br />

and Candace Landino of Maryland.<br />

He also leaves behind several<br />

grandchildren.<br />

Don will be greatly missed by the<br />

industry and CMHI <strong>member</strong>ship.<br />

complete its analysis by December<br />

MHI SETS INDUSTRY<br />

PRIORITIES FOR 2011<br />

During MHI’s 74 th Annual Meeting on<br />

September 26-28, 2010 in Denver, CO.,<br />

MHI <strong>member</strong>s and Board of Directors<br />

outlined priorities <strong>for</strong> the industry and<br />

the association in preparation <strong>for</strong> 2011<br />

and the incoming 112 th Congress.<br />

The priorities detailed below<br />

represent the collective input of<br />

manufacturers, lenders, community<br />

owners, state associations, retailers<br />

and suppliers—the entire MHI<br />

<strong>member</strong>ship. It is important to note<br />

that MHI’s policy focus is not limited<br />

to this list and remains engaged on all<br />

issues to the industry:<br />

Priority: Financial Regulatory<br />

Implementation and Overhaul<br />

The Dodd-Frank Wall Street Re<strong>for</strong>m<br />

and Consumer Protection Act (H.R.<br />

4173; P.L. 111-517) was enacted<br />

into law on July 21, 2010. The law is<br />

considered the most significant rewrite<br />

in decades of rules governing banking<br />

and financial services and will impact<br />

every financial institution and credit<br />

instrument in the nation.<br />

One of the most visible and<br />

significant creations of the law is the<br />

establishment of a new independent<br />

and autonomous Consumer Financial<br />

Protection Bureau (CFPB) housed<br />

within the Federal Reserve, that<br />

will regulate all consumer financial<br />

products and participants, including<br />

mortgages, credit cards, banks, payday<br />

loans and other financial products.<br />

Initial estimates conservatively<br />

indicate the act will require more than<br />

240 new rulemakings, nearly 70 new<br />

on-time reports/studies, and more<br />

than 22 new on-going studies. This<br />

does not include the administration of<br />

existing regulations and laws that will<br />

be transferred to the new CFPB—there<br />

are nearly 20 existing consumer/<br />

housing finance-related laws that<br />

will now fall under the new bureau’s<br />

jurisdiction—or existing rulemakings<br />

that were in progress at the time of the<br />

bureau’s inception.<br />

Provisions in this <strong>bi</strong>ll contain<br />

significant issues <strong>for</strong> lending in our<br />

industry. Addressing these issues, and<br />

correcting them, will be a primary focus<br />

in 2011.<br />

Priority: SAFE Act<br />

Implementation<br />

The Dodd-Frank Bill transfers<br />

jurisdiction and oversight of a number<br />

of mortgage-related laws from the<br />

Department of Housing and Urban<br />

Development (HUD) to the CFPB.<br />

Included in the regulatory transfer is<br />

the shift of en<strong>for</strong>cement over the SAFE<br />

Act from HUD to the CFPB. HUD<br />

maintains jurisdiction over the SAFE<br />

Act until the designated transfer date<br />

of July 21, 2011. It is unclear if HUD<br />

will issue a final rule on the SAFE Act.<br />

However, regulatory oversight of the<br />

statute will eventually shift into the<br />

CFPB.<br />

Achieving clarity in application and<br />

making the SAFE Act more relevant to<br />

the manufactured housing industry will<br />

be a high priority in 2011.<br />

federal support of manufactured home<br />

lending and finance has been limited.<br />

Even with strong Congressional<br />

guidance in the Housing and Economic<br />

Recovery Act of 2008 (HERA) -- which<br />

indicated the GSEs have a duty<br />

to serve the finance needs of the<br />

manufactured housing market -- little<br />

headway has been made to push<br />

GSEs into the business of establishing<br />

a secondary market <strong>for</strong> manufactured<br />

home loans secured by personal<br />

property.<br />

fully and adequately serves the liquidity<br />

needs of the manufactured housing<br />

industry.<br />

*Government Sponsored Enterprise<br />

Priority: Tax Re<strong>for</strong>m<br />

Section 45L of the tax code provides<br />

a credit of $1,000 to manufacturers of<br />

Energy Star HUD Code manufactured<br />

homes and $2,000 <strong>for</strong> modular homes.<br />

The credit was originally enacted as<br />

part of the Energy Policy Act of 2005<br />

and <strong>for</strong> the past several years has been<br />

extended on an annual/temporary<br />

basis. The credit officially expired<br />

December 31, 2009.<br />

MHI has worked to extend the credit<br />

<strong>for</strong> one year as part of tax extension<br />

legislation (H.R. 4213) that was<br />

approved by the House in May 2010.<br />

The Senate has been unable to move<br />

the measure due to objections over<br />

the costs associated with extending<br />

various tax cuts.<br />

MHI has also worked with Sen.<br />

Olympia Snowe (R-ME) to introduce<br />

stand-alone legislation (S. 1637) that<br />

would increase the credit and extend<br />

it <strong>for</strong> three years. Congressman David<br />

Reichert (R-WA) has introduced similar<br />

legislation (H.R. 4226) in the House.<br />

In 2011, MHI will work to pursue a<br />

strategy that: 1) increases the amount<br />

of the tax credit; 2) provides <strong>for</strong> a longterm/permanent<br />

enactment of the tax<br />

credit; and 3) potentially monetizes the<br />

tax credit.<br />

Priority: Energy Issues<br />

In May 2010, the House adopted<br />

legislation (H.R. 5019) endorsed by<br />

MHI that would provide owners of<br />

manufactured homes constructed prior<br />

to 1976 with a rebate of up to $7,500<br />

to use towards the purchase of a new<br />

Energy Star qualified manufactured<br />

home and provide up to $2,500 <strong>for</strong><br />

decommissioning of the old home.<br />

The measure is based on legislation<br />

(H.R. 1749) developed by Rep. Baron<br />

Hill (D-IN) in collaboration with MHI.<br />

Sen. Jon Testes (D-MT) introduced<br />

similar legislation (S. 1320) that was<br />

marked up by the Senate Environment<br />

and Natural Resources Committee on<br />

August 5, 2010.<br />

If the measure is not adopted this<br />

legislative session it will remain a<br />

priority <strong>for</strong> passage during the 112 th<br />

Congress.<br />

Priority: EISA Energy<br />

Efficiency Standards<br />

The Energy Independence and<br />

Security Act of 2007 (EISA; P.L. 110-<br />

140) contains provisions requiring<br />

the Department of Energy (DOE)<br />

to establish and implement energy<br />

efficiency standards <strong>for</strong> manufactured<br />

housing (Sec.413).<br />

The <strong>bi</strong>ll specifically tasks the<br />

agency with developing regulations,<br />

in consultation with the Department<br />

of Housing and Urban Development<br />

(HUD), that are based on “the most<br />

recent version” of the International<br />

Energy Conservation Code (IECC) and<br />

that:<br />

• take into consideration the design<br />

and factory construction techniques of<br />

manufactured homes<br />

• are based on HUD-established<br />

climate zones<br />

• provide <strong>for</strong> alternative energy<br />

efficiency practices<br />

• are established by 2011 (four years<br />

from the <strong>bi</strong>ll’s date of enactment)<br />

MHI has developed a legislative<br />

proposal that would place<br />

responsi<strong>bi</strong>lity <strong>for</strong> implementing energy<br />

efficiency standards developed by<br />

DOE within HUD and ensure that new<br />

standards strike a balance between<br />

energy efficiency and maximizing<br />

housing af<strong>for</strong>da<strong>bi</strong>lity <strong>for</strong> very low- and<br />

low-income families.<br />

with Palm Harbor’s filing, Fleetwood<br />

Homes committed $50 million, which<br />

may increase to $55 million if certain<br />

conditions are met, <strong>for</strong> a debtor-inpossession<br />

(DIP) credit facility. Subject<br />

to bankruptcy court approval, the credit<br />

facility will be used by Palm Harbor to<br />

extinguish its existing Textron Financial<br />

Corporation facility and to fund postpetition<br />

operations, commitments to<br />

customers, and employee obligations.<br />

Additionally, through a newly<br />

<strong>for</strong>med subsidiary of Fleetwood<br />

Homes, Inc., Cavco and Third Avenue<br />

have entered into an agreement<br />

with Palm Harbor and certain of its<br />
