NOTICE TO BIDDERS BID BULLETIN NO. 1 PROJECT : CDC CONTRACTING SECURITY SERVICES (PACKAGE-2) DATE : 09 December 2005 Pursuant to the queries and discussions made during the pre-bid conference of the project held last December 8, 2005 at Bldg. 2125 OTS Conference Room, hereunder are some modifications and clarifications: 1. Contract Duration. The amount of the Approved Budget for Contract indicated in the advertisement is good for one (1) year only. However, the project contract duration is for a period of two (2) years. 2. Bill of Quantities. The Bill of Quantities form included in the bid documents shall be strictly followed particularly those under items no. A & B. Bidders shall make their individual bid on the item no. C. 3. Surety Bond as Performance Security. The use of surety bond in the amount of thirty percent (30%) of the Contract price shall be allowed as one of the forms of Performance Security to be prescribed by the Procuring Entity to the successful bidder prior to the issuance of Notice to Proceed (NTP). 4. Purchase Agreement. The purchase agreement shall suffice as a supporting document for the compliance on the minimum equipments required. However, the Procuring Entity shall require the successful bidder to comply to whatever agreement was submitted. 5. Cross-posting or Use of Guards on Another Post. As stated in Section VII Scope of Works, Specifications of Required Equipments and Qualification Standards, under the 1 st and 2 nd paragraph of Assignment/ Replacement of Supplier’s Personnel, page 56, the terms on the cross-posting of guards or use of Guards on Another Post is upheld and reserved as prerogative of CDC. 6. Contract. The bid-documents including the eligibility, technical, and financial documents submitted shall form part of the Contract of the successful bidder.

7. Sealing & Marking of <strong>Bid</strong>s. <strong>Bid</strong>ders should comply with the requirements of Instructions to<br />

<strong>Bid</strong>ders (ITB) Clause 24.1. Section II of the Instructions to <strong>Bid</strong>ders page 20 of the <strong>Bid</strong>ding<br />

Documents.<br />

8. Blacklisted Insurance Agency. The three (3) blacklisted Insurance Agency are as follows:<br />

8.1. Stronghold Insurance<br />

8.2. Sterling Insurance<br />

8.3. Prudential Guarantee and Insurance Corporation<br />

8.4. Philippine Charter Insurance Corp.<br />

The above statements shall modify, amend or replace parts of the <strong>Bid</strong>ding Documents and/or<br />

other terms in the issued bid bulletin.<br />

Pursuant to Section 32.3 of the implementing rules of RA 9184, bidders are prohibited from<br />

making any kind of communication with any member of the Committee, the Secretariat or TWG or<br />

to follow-up the status of the bid evaluation until after an award has been made.<br />

CDC reserves the right to accept or reject any or all bids, to extend the date of submission and/or<br />

opening of bids upon prior notice. If in CDC’s opinion there are valid grounds to warrant this; to<br />

waive any defect, formality, informality, or technically in them without affecting the substance of the<br />

bids, or to accept such bids considered, in CDC’s opinion, to be most advantageous to the<br />

government; and annul the bidding process without offering any reason. The decision of CDC on<br />

all matters shall be final. CDC also neither assumes any obligation to compensate nor indemnify<br />

the bidders for any expense or loss that may be incurred in connection with this public bidding, nor<br />

does CDC guarantee that an award will be made.<br />

This is in reference to the additional concerns and query of the <strong>Bid</strong>ding &<br />

Awards Committee on its last meeting on the CDC Contracting of Security<br />

Services. Please take note that the attached items and paragraphs shall be<br />

integrated in the <strong>Bid</strong>ding Documents.<br />

In this connection, request guidance as to where these items should be<br />

added or placed before we print the whole <strong>Bid</strong> Docs for submission to BAC for<br />

final review again. After my discussion with BAC Head Secretariat, no other item<br />

shall be added aside from these matters. Thank you.<br />

I T E M S:<br />

1. Cross-posting of guards on different Sectors shall be allowed only if they<br />

are from the same Security Agency. A Security Agency who won on any<br />

two (2) identified Sectors may interchange their guards on the said<br />

Sectors only. Except or when in the exigency of the service (which shall<br />

be determined by the head of the CDC PSD) when situation warrants that<br />

cross-posting of guards or guards in one Sector shall be allowed to be<br />

assigned in another Sector occupied by another Security Agency.<br />

2. A bidder may bid in all three Sectors but shall be allowed to win only in<br />

any two (2) Sectors, as a maximum. A bidder who happens to win in all


three Sectors shall be required to drop one Sector of his choice,<br />

considering that he can only have two Sectors at the most. He may drop<br />

the lowest or highest (number of personnel required) on any Sector<br />

depending on his own choice. The Sector which he dropped from his bid<br />

shall then be bided out next and whoever has the Lowest Calculated and<br />

Responsive <strong>Bid</strong> shall be the winning bidder for the remaining Sector.<br />

3. Payment of salaries of Guards shall be made through Automated Teller<br />

Machine. The winning bidder shall be required to submit copy of Payroll<br />

to the CDC Treasury Department.<br />

4. Quarterly inspection of individual Guard’s Pay slip shall be conducted by<br />

PSD Technical Administrative Committee. Each Pay slip of Guards must<br />

be computerized print out.<br />

5. Authenticated copies of Official Receipts of Monthly Payments made to<br />

SSS, PAG-IBIG, Phil Health and BIR shall be required from the winning<br />

Agency during submission of monthly billing statement to CDC to protect<br />

continuous compliance of the Agency on its legal obligations.<br />

6. Monthly Evaluation of the winning Agency shall be made by the PSD<br />

Technical Administrative Committee covering the following aspects to<br />

continuously monitor compliance:<br />

a) Status of Tools, Vehicle & Equipment<br />

b) Attendance of Guards<br />

c) Discrepancy or losses on assigned Sector<br />

d) Discrepancy/Violations of Individual Guards
