count indictment, only four are to be found in the Library of Congress<br />

transcripts. None of them are to be found in the file of the<br />

case, in the United States Court House in Washington.<br />

Of the four broadcasts cited which are available, one, on March<br />

19, 1943, had as its subject Henry Adams and the equation of the<br />

acceleration of the historical process. The transcriber notes that<br />

much of this broadcast was not taken down because of poor reception<br />

and unintelligibility. The other three that are available—May<br />

12, 1943, May 14, 1943, and May 15, 1943—all deal with the<br />

same subject, an exposition of Acting Secretary of State Sumner<br />

Welles' Toledo speech on economic aggression.<br />

The indictment reads as follows:<br />

"par. 1. That Ezra Pound, the defendant herein, was born in<br />

Hailey, Idaho, October 30, 1885, and that he has been at all times<br />

herein mentioned and is now a citizen of the United States of<br />

America and a person owing allegiance to the United States of<br />

America.<br />

"2. That the defendant, Ezra Pound, at Rome, Italy, and<br />

other places within the Kingdom of Italy and outside the jurisdiction<br />

of any particular state or district, but within the jurisdiction<br />

of the United States and of this Court, the District of Columbia<br />

being the district in which he was found and into which he was<br />

first brought, continuously and at all times beginning on the 11th<br />

day of December 1941 and continuing thereafter to and including<br />

the 3rd day of May, 1945, under the circumstances and conditions<br />

and in the manner and by the means hereinafter set forth, then and<br />

there being a citizen of the United States, and a person owing<br />

allegiance to the United States, in violation of said duty of<br />

allegiance, knowingly, intentionally, wilfully, unlawfully, feloniously,<br />

traitorously and treasonably did adhere to the enemies of<br />

the United States, to wit; the Kingdom of Italy and the military<br />

allies of the Kingdom of Italy, with which the United States at all<br />

times since December 11, 1941 and during the times set forth in<br />

this indictment, have been at war, giving to the said enemies of<br />

the United States aid and comfort within the United States and<br />

elsewhere, that is to say,
