eceived an authorisation from the Australian Competition and Consumer Commission (ACCC) in this<br />

regard which can be inspected on the public register of the ACCC.<br />

(c) ownership by the franchisor or an associate of the franchisor of an interest in any supplier from which<br />

the franchisee may be required to acquire goods or services; and<br />

Not applicable, we do not have any interest in any supplier from which the Franchisee may be required to<br />

acquire goods or services.<br />

(d) the obligation of the franchisee to accept goods or services from the franchisor, or from an associate<br />

of the franchisor; and<br />

The Franchisee must accept goods or services or materials from us from time to time to facilitate the<br />

promotion, marketing and sale of our Lottery Products including but not limited to Lottery Terminals, ticket<br />

rolls, entry coupons and point of sale materials together with certain services such as training of management<br />

and staff.<br />

If a Franchisee elects to participate in or conduct a ‘store syndicate’ and if the store syndicate shares have not<br />

been sold to customers prior to the ‘stop sell’ time, the Franchisee is required to purchase all such unsold<br />

syndicate shares.<br />

If a Franchisee does not purchase the unsold syndicate shares prior to the ‘stop sell’ time, then such unsold<br />

syndicate shares will be automatically sold to the Franchisee at ‘stop sell’ time and the franchisee is liable for<br />

the cost of any automatically sold syndicate shares.<br />

The Franchisee is entitled to any prizes won in relation to the automatically sold syndicate shares.<br />

(e) the franchisor’s obligation to supply goods or services to the franchisee; and<br />

We are obliged to supply Lottery Terminals and maintenance services to the Lottery Terminals, ticket rolls,<br />

entry coupons and point of sale materials to the Franchisee together with certain services such as initial<br />

training of management and staff.<br />

(f) whether the franchisee will be offered the right to be supplied with the whole range of the goods or<br />

services of the franchise; and<br />

Yes, all products which are able to be sold pursuant to the relevant licence, permit or approval in the relevant<br />

jurisdiction will be offered to the Franchisee for sale unless stated in writing to the contrary by us prior to<br />

entering into the Franchise Agreement.<br />

If an applicant for a Lottery Franchise intends to establish the Lottery Franchise in Queensland, the range of<br />

Lottery Products such person will be offered the right to be supplied with and sell depends on:<br />

(a) the range of products the applicant applies to sell; and<br />

(b) the range of products we offer the applicant to sell.<br />

At times, an applicant who meets our selection criteria to sell the Instant Scratch-Its lottery tickets (an “Instant<br />

Scratch-Its only” outlet) may not meet the selection criteria to sell the full range of our Lottery Products (an<br />

“On-line” outlet).<br />

If an applicant for a Lottery Franchise intends to establish the Lottery Franchise in Tasmania, or Northern<br />

Territory, the applicant will only be offered the right to be supplied with and sell Instant Scratch-Its tickets as<br />

that is the only product Golden Casket is permitted to sell in those jurisdictions.<br />

(g) conditions under which the franchisee can return goods, and to whom; and<br />

Goods can only be returned to us upon the Franchisee receiving our written advice to that effect.<br />

Further, Franchisees can return Instant Scratch-Its tickets of a particular game prior to closure of that game by<br />

us in the following circumstances:<br />

• where tickets beyond the quantity ordered by the Franchisee is delivered in error by us;<br />

• where tickets are delivered in error to the Franchisee by us;<br />

• where tickets are damaged prior to game closure and such loss or damage is not caused by the wilful act<br />

or negligence of the Franchisee;<br />

• where the Franchisee becomes insolvent and, consequently, goes into liquidation or is declared bankrupt<br />

or has a receiver and manager appointed;<br />

• where regulatory or other legal requirements require the recall or removal of a game; and<br />

• such further returns as we may, in our discretion, allow from time to time.<br />

(h) conditions under which the franchisee can obtain a refund for services provided by the franchisor,<br />

and from whom; and<br />

Due to the nature of the franchise (being a lottery business) there are no conditions under which the<br />

Franchisee can obtain a refund for services provided by us.<br />

(i) whether the franchisor may change the range of goods or services, and if so, to what extent; and<br />

We may change the type of games offered to the public subject to obtaining the approval of the various<br />

jurisdictional authorities.<br />
