2.6 Control of Meeting. The Deputy of Director of B&P, or designee, shall<br />

conduct the face-to-face meeting to discuss the NOVs, Tenant’s corrective action plan,<br />

and ES recommendations on an appropriate corrective action plan.<br />

2.7 Meeting Format. An appropriate corporate officer, a company<br />

representative having knowledge about the allegations, an ES representative and any<br />

other individuals deemed appropriate by the Aviation Department shall attend the<br />

meeting to discuss Tenant’s environmental practices and to develop a compliance<br />

schedule to include a corrective action plan.<br />

2.8 Compliance Schedule to Include Corrective Action <strong>Plan</strong>.<br />

2.8.1 A compliance schedule and corrective action plan shall be<br />

developed and at a minimum, shall include the following information as required by the<br />

City of <strong>Phoenix</strong> Aviation Department Storm Water Enforcement Policy, Section 1:<br />

2.8.1.1 Employee environmental training plan.<br />

2.8.1.2 Equipment requirements.<br />

2.8.1.3 Changes in best management practices.<br />

2.8.1.4 Time schedule for corrective4 action to be completed.<br />

2.9 Termination of NPDES Co-Permittee Status. Depending upon the<br />

severity of Tenant’s NPDES violation(s) and upon Tenant’s efforts to comply with the<br />

NPDES Policy, Aviation staff may recommend to the Director that Tenant’s NPDES copermittee<br />

status be terminated.<br />

Section 3:<br />

Formal Enforcement Action (Compliance Status Review Meeting<br />

Level 3/Penalty Phase).<br />

3.1 Notice of Compliance Status Review Meeting. B&P will hand deliver to<br />

Tenant or send by Certified Mail Return Receipt Requested, a “Notice of Compliance<br />

Status Review” letter if any of the following circumstances apply: 1) if three (3) or more<br />

NOVs are issued to Tenant or Tenant’s contractors, if applicable, within 24 months; 2) if<br />

prior enforcement actions have failed to produce compliance with the City’s NPDES<br />

Policy; 3) if there has been no reasonable commitment to attain compliance by an<br />

established deadline.<br />

3.2 Information to Tenant. The “Notice of Compliance Status Review”<br />

letter shall include a copy of the NPDES Policy, Tenant’s previous NOVs, previous<br />

corrective action plans, a copy of Chapter 32C of the <strong>Phoenix</strong> City Code and a general<br />

statement of the reason this action is being taken. Tenant shall be notified of the time and<br />

place for the meeting. The form of the notice shall follow Attachment D.<br />
