The base amount of the civil penalty can be increased (not to exceed $2,500.00, per violation), decreased (but not less than $500.00, per<br />

violation) or remain the same after consideration of the following:<br />

1. The seriousness of the violation;<br />

2. Any history of such violation;<br />

3. Any good faith efforts to comply with the applicable requirements;<br />

4. The economic impact of the penalty on the violator; and<br />

5. Such other factors as justice may require.<br />

Acids include materials labeled as such (e.g., hydrochloric acid, sulfuric acid, etc.) or any materials with a pH of<br />

4.0 or less.<br />

Bases include materials labeled as such (e.g., sodium hydroxide, pH increaser, caustic soda, lye, etc.) or any materials with a pH of 10.0 or<br />

greater.<br />

“Automotive-related products” include engine oil, lube oils, brake fluid, transmission fluid, gear oil, anti-freeze, cleaners (carburetor, brake,<br />

engine, etc.) and other products used for vehicles or aircraft but does not include solvents, gasoline and other fuels.<br />

“Other fuels” include gasoline, aviation gas, diesel, kerosene, jet fuels or other petroleum based<br />

products used to run equipment or vehicles.<br />
