NOTICE OF STORM WATER VIOLATION INSTRUCTIONS<br />

Your Company Is Required To:<br />

A. Immediately take measures to safely mitigate the impact of your release, or threatened release, to the<br />

environment. Obtain spill control equipment or perform measures to contain the release and clean the area.<br />

If so directed by Fire or Aviation Department personnel, an environmental emergency response contractor<br />

will be hired by your company.<br />

B. Supervisor/manager must report the incident to the airport Environmental Section at 273-8861 within 24<br />

hours to acknowledge receipt of the Notice of Violation. Weekend reporting can be left on the Aviation<br />

Department answering machine at the same phone number.<br />

C. If your company was performing services for an airport tenant when the incident occurred, report the<br />

incident to your contracting company.<br />

D. Within 15 calendar days of the date of this Notice, submit a detailed report explaining why the incident<br />

occurred and the corrective action taken to prevent future occurrences. At a minimum, the report must<br />

address the following:<br />

1) A summary of the names and positions of persons involved in the incident; equipment involved;<br />

how the incident occurred, including time, place, and materials and quantity released.<br />

2) A detailed description of the investigation and conclusions.<br />

3) How cleanup of released materials was performed, including equipment and materials used in the<br />

clean up, and how waste was disposed.<br />

4) Corrective action your company has taken or plans to take and the time in which all corrective<br />

action will be completed. If corrective action has not been completed within the 15 day period, a<br />

compliance schedule must be submitted for approval by the Aviation Department.<br />

5) Please detail what changes to training, equipment, practices (best management practices);<br />

procedures, or personnel have been implemented to prevent future incidents from occurring .<br />

6) The report must be signed by the supervisor/manager and shall contain the following certification:<br />

“I certify under penalty of law that this document and all attachments were prepared under<br />

my direction or supervision in accordance with a system designed to assure that qualified personnel<br />

properly gather and evaluate the information submitted. Based on my inquiry of the person or<br />

persons who manage the system, or those persons directly responsible for gathering the information,<br />

the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I<br />

am aware that there are significant penalties for submitting false information, including the<br />

possibility of fine and imprisonment for knowing violations.”<br />

This report is due in 15 calendar days from the date of this Notice and shall be sent to:<br />

City of <strong>Phoenix</strong> Aviation Department<br />

cc: To the company for whom you were performing services, if applicable.<br />

Should you require additional time in order to complete the report, a request for an extension must be<br />

submitted and approved prior to the due date.<br />

FAILURE TO COMPLY WITH THE REQUIREMENTS OF THIS NOTICE WILL SUBJECT YOU<br />

TO FURTHER ACTION AND MAY JEOPARDIZE YOUR COMPANY'S STATUS AS A NATIONAL<br />

POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) CO-PERMITTEE AND/OR YOUR<br />

AUTHORIZATION TO CONDUCT BUSINESS ON AIRPORT PROPERTY. COMPLIANCE WITH<br />

THIS NOTICE DOES NOT PRECLUDE THE CITY FROM TAKING ADDITIONAL<br />

ENFORCEMENT ACTION UNDER CHAPTER 32C OF THE PHOENIX CITY CODE.
