NOTICE OF INTENT INSTRUCTIONS<br />

for <strong>Stormwater</strong> Discharges Associated with<br />

INDUSTRIAL ACTIVITY<br />

under the AZPDES 2010 Multi-Sector Permits<br />

Who Must File A Notice Of Intent (NOI)<br />

Under section 402(p) of the Clean Water Act (CWA) and regulations<br />

in 40 CFR 122, stormwater discharges associated with industrial activity<br />

are prohibited to waters of the United States unless covered under an<br />

authorizing permit. In Arizona, such discharges are covered by Arizona<br />

Pollutant Discharge Elimination System (AZPDES) permits. Coverage<br />

may be obtained under one, or both, Multi-Sector General Permits<br />

(MSGPs) by submitting a completed NOI if you operate a facility that:<br />

● Discharges stormwater associated with industrial activities,<br />

identified in Appendix C of the MSGP;<br />

● Meets the eligibility requirements in Part 1.1 of the permit;<br />

● Develops a stormwater pollution prevention plan (SWPPP) in<br />

accordance with Part 5 of the MSGP; and<br />

● Installs and implements control measures in accordance with<br />

Parts 2 and 8 of the MSGP to meet numeric and non-numeric<br />

effluent limits.<br />

One NOI must be submitted for each facility for which you are<br />

seeking permit coverage. However, you do not need to submit a<br />

separate NOI for each type of industrial activity present at your facility,<br />

provided your SWPPP covers all industrial activities.<br />

When to File the NOI Form<br />

Do not file your NOI until you have obtained and thoroughly read the<br />

AZPDES 2010 MSGPs, which are located at:<br />

The MSGPs describe procedures to ensure your eligibility, prepare<br />

your SWPPP, install and implement appropriate stormwater control<br />

measures, and complete the NOI form questions – all of which must be<br />

done before you sign the NOI certification statement attesting to the<br />

accuracy and completeness of your NOI. You will also need a copy of<br />

the appropriate MSGP once you have obtained coverage so that you can<br />

comply with the implementation requirements of the permit.<br />

The SWPPP does not need to be submitted to ADEQ for review<br />

unless the facility is within 2.5 miles of an impaired or outstanding<br />

Arizona water (OAW) or ADEQ specifically requests a copy of the<br />

SWPPP.<br />

Completing the NOI Form<br />

Be certain that you complete all fields. Make a photocopy for your<br />

records before you send or fax the completed form to the location listed<br />

above.<br />

Section A. NOI Revision<br />

This section does not apply to a permit renewal.<br />

Complete this section ONLY if your facility is permitted under one, or<br />

both, of the 2010 MSGPs and information has changed that requires you<br />

to update your NOI.<br />

Section B. Facility Operator Information<br />

Provide the name of the person who will serve as the primary<br />

contact for the facility.<br />

Provide the legal name of the firm, public organization or other<br />

public entity that operates the facility described in this NOI. An operator<br />

is a legal entity that controls the operation of the facility.<br />

Provide the operator’s mailing address, telephone number, fax<br />

number (optional), and email address. All correspondence will be sent<br />

to this address.<br />

Section C. Facility Information<br />

1. Provide the facility’s official or legal name. Unless the name of your<br />

facility has changed, please use the same name provided on prior<br />

NOIs.<br />

2. Provide the street address, city, state, zip code, and county of the<br />

actual physical location of the facility. If the facility does not have<br />

an address, provide driving directions from the nearest<br />

municipality. Do not use a PO Box number.<br />

3. Provide the latitude and longitude of the facility in degrees,<br />

minutes, and seconds. You can obtain these coordinates through<br />

geographic information system tools, topographic maps, or<br />

ADEQ’s web-based GIS mapping system at: http://gisweb.azdeq.<br />

gov/arcgis/emaps/?topic=impaired.<br />

For consistency, take the coordinates from the location of<br />

your facility’s stormwater outfall. Outfalls are locations where the<br />

stormwater exits the facility, including pipes, ditches, swales, and<br />

other structures that transport stormwater. If there is more than<br />

one outfall present, provide the coordinates of the primary outfall<br />

(i.e., the outfall with the largest volume of stormwater discharge<br />

associated with industrial activity).<br />

4. Indicate if industrial stormwater discharges from your facility were<br />

previously covered by a NPDES or AZPDES permit.<br />

If the facility was covered by the 2000 MSGP, include the EPA<br />

tracking number or the ADEQ authorization number, whichever is<br />

applicable. If the facility was covered under an AZPDES individual<br />

permit, include that permit number.<br />

5. Indicate whether the facility is located on Indian Country Lands. If<br />

you answered yes, DO NOT submit this NOI to ADEQ. The<br />

Department does not have permitting authority on Indian County<br />

Lands. You must coordinate with the U.S. EPA for permit coverage<br />

on Indian Country Land within Arizona.<br />

6. Provide the sector and subsector codes, and SIC or Activity Codes<br />

that best describes the primary industrial activities performed by<br />

your facility. Your primary industrial activity includes any activities<br />

performed onsite that are (1) identified by the facility’s SIC code for<br />

which the facility is primarily engaged; and (2) included in the<br />

narrative descriptions of 40 CFR 122.26(b)(14)(i), (iv), (v), or (vii)<br />

and (ix). See Appendix C of the MSGP for a complete list of SIC<br />

codes and Activity Codes. See the footnote in Appendix C, or<br />

Table 1, for how to determine the SIC code.<br />

Enter the area (in acres) of industrial activity at your facility<br />

that is exposed to stormwater.<br />

7. If your facility has co-located industrial activities that are not<br />

identified as your primary industrial activity, identify the sector and<br />

subsector codes, SIC or Activity Codes, and area (in acres) that<br />

describe these other industrial activities. For a complete list of<br />

sector and subsector codes, see Appendix C of the MSGP.<br />

Enter the area of industrial activity (by SIC or AC code) of<br />

all co-located sites exposed to stormwater.<br />

8. Indicate whether the facility is expected to be inactive and<br />

unstaffed at any time during the permit term. If yes, specify the<br />
