Policy:<br />

In every case concerning bereavement, personal emergency and family<br />

medical leave, ILCWR’s concern is the well-being of those involved.<br />

Procedure:<br />

<strong>Bereavement</strong> <strong>Leave</strong><br />

1. A paid leave of absence of up to three (3) consecutive days including<br />

the day of the funeral will be granted upon the death of a member of<br />

the family.<br />

2. The extent of the leave will be determined by the immediate supervisor<br />

in consultation with the employee and will be based on considerations<br />

of immediacy of family member, closeness of relationship, travel time,<br />

etc. Employees may have the option of using other leaves such as<br />

vacation, banked stat time, etc. to cover an extended leave.<br />

3. This absence must be reported to a supervisor. If the supervisor is not<br />

available, then the employee must report the absence to the on-call<br />

supervisor. Please see the Sick and Short-Notice Absences Process<br />

for Attendant Services for further information.<br />

<strong>Personal</strong> <strong>Emergency</strong> <strong>Leave</strong><br />

<strong>Personal</strong> emergency leave is provided in accordance with the Employment<br />

Standards Act as follows:<br />

1. An employee is entitled to take up to ten (10) days of unpaid leave per<br />

calendar year due to:<br />

<strong>Personal</strong> illness, injury or medical emergency<br />

Death, illness, injury, medical emergency or urgent matter relating<br />

to:<br />

o A spouse<br />

o Parent, step/foster parent, child, step/foster child, grandparent,

step grandparent, grandchild, step grandchild of the employee or<br />

the employee’s spouse.<br />

o The spouse of an employee’s child<br />

o A brother or sister of the employee<br />

o A relative of the employee who is dependent on the employee<br />

for care or assistance.<br />

2. An “urgent matter” will also qualify for personal emergency leave. An<br />

urgent matter is an event that is “unplanned” or out of the employee’s<br />

control.<br />

3. An employee must inform the supervisor before starting the leave that<br />

he or she is taking a personal emergency leave. Please see the Sick<br />

and Short-Notice Absences Process for Attendant Services for further<br />

information.<br />

4. Employees who take personal emergency leave are entitled to the<br />

same rights as employees who take parental leave.<br />

<strong>Family</strong> Medical <strong>Leave</strong><br />

<strong>Family</strong> medical leave is provided in accordance with the Employment<br />

Standards Act as follows:<br />

1. <strong>Family</strong> Medical <strong>Leave</strong> is unpaid, job-protected leave of up to eight<br />

weeks in a six-month period. It may be taken to provide care or<br />

support to certain family members in respect of whom a qualified<br />

health practitioner has issued a certificate indicating that he or she has<br />

a serious medical condition with a significant risk of death occurring<br />

within six months. The medical condition and risk of death must be<br />

confirmed in a certificate issued by a qualified health practitioner.<br />

2. All employees, whether full-time, part-time, permanent or term contract<br />

who are covered by the ESA are entitled to family medical leave.<br />

If additional time is required, a further leave of absence may be arranged,<br />

subject to the approval of the Human Resources & Finance Director.
