intends to amend rule cited as 10 <strong>NC</strong>AC 3H .<br />

LICENSING OF NURSING HOMES<br />

SECTION .0200 - LICENSURE<br />

.0221 ADMINISTRATIVE PENALTY<br />

DETERMINATION PROCESS<br />

{B (a) The surveyor shall identify areas -ef- ot non<br />

oontained in G.S. 131E 117 or rules oontainod in<br />

this Subchapte r.— Th e areas <strong>of</strong> non oomplianoe<br />

shall<br />

be docum ented by the surveyor and a Nega<br />

tivo Aotion Proposal— submitted to the Internal<br />

Review Committee .<br />

{b) The Inte rnal Review Committee shall be<br />

oompriBed <strong>of</strong> three me mbers:<br />

Section, erson designated by the<br />

or a p<br />

ohief <strong>of</strong> th e Licensure Section, who<br />

shall serve as chairman;<br />

{3} The head <strong>of</strong> the Complaints Invoetiga<br />

tion Branch, if the propo s al i s the result<br />

<strong>of</strong> a health care s urvey; or the head <strong>of</strong><br />

the Health Care Facilities Branch, if the<br />

proposal i s the result <strong>of</strong> a complaint<br />

investigation; or a person designated by<br />

the chief <strong>of</strong> the Licensure Section; and<br />

The Department shall notify the licensee by<br />

certified mail within 10 working days from the<br />

The licensee shall have 10 working days<br />

from receipt <strong>of</strong> the notification to provide the<br />

Department—aay additional— written informatioe<br />

relating to the proposed administrative penalty.<br />

Upon request by the licensee, the Department shall<br />

grant the licensee an extension <strong>of</strong> up to 30 days to<br />

submit additional written information relating to<br />

the proposed administrative action.— The licensee<br />

shall have five working days from receipt <strong>of</strong> the<br />

notification to advise the Department as to whether<br />

the licensee,<br />

an authorized representative or both<br />

plan to meet with the Internal Review Committee.<br />

(c)<br />

If the licensee chooses to attend the meeting<br />

as provided in Paragraph (d) <strong>of</strong> this Rule, a sur<br />

vcyor or a representative <strong>of</strong> the branch which<br />

conducted the investigation or survey shall attend<br />

the Interna]— Review Committee meeting when<br />

survey schedules permit.— The Department shall<br />

notify the Divi s ion <strong>of</strong> Aging <strong>of</strong> the licensee's plans<br />

to<br />

meet with the Committee or any change in the<br />

date or time <strong>of</strong> the meeting.<br />

If the licensee choos<br />

cs to attend the meeting, the agency that conducted<br />

the survey or investigation shall be responsible for<br />

notifying the complainant, if any.— The complain<br />

ant, if any, may attend the meeting relating to hi s<br />

or her complaint.<br />

(f) The Internal Review Committee shall review<br />

evidence, and any additional information provided<br />

by the licensee that may have a bearing on the<br />

proposal—sueb—as documentation— not available<br />

during the investigation or survey,<br />

action taken to<br />

correct the violation and plans to prevent the<br />

violation from recurring.<br />

(g) There shall be no taking <strong>of</strong> sworn testimony<br />

nor cro s s examination <strong>of</strong> anyone during the course<br />

<strong>of</strong> Internal Review Committee meetings .<br />

(h)<br />

Time shall be allowed during the Internal<br />

Review Committee meetings for individual proscn<br />

tations, the total for which shall normally be one<br />
