EXECUTIVE ORDERS<br />

EXECUTIVE ORDER NO. 108<br />

TO DECLARE BY PROCLAMATION THE TRUE BOUNDARY LINE BETWEEN THE STATE OF NORTH CAROLINA<br />

AND THE STATE OF SOUTH CAROLINA<br />

ALONG THE COUNTIES OF JACKSON AND TRANSYLVANIA<br />

WHEREAS, the Joint North Carolina/South Carolina Boundary Commission determined at its duly-convened meeting on<br />

December 11, 1997, to establish the true boundary line between the states along the North Carolina county <strong>of</strong> Jackson and a portion <strong>of</strong><br />

the county <strong>of</strong> Transylvania; and<br />

WHEREAS, both states have undertaken the necessary steps to locate, survey, and mark the 19.3-mile segment <strong>of</strong> the<br />

boundary, as identified through historical research and field work and by using the Global Positioning System ("GPS"); and<br />

WHEREAS, pursuant to N.C.G.S. § 141-5, the completion <strong>of</strong> the survey <strong>of</strong> the above-described boundary has been reported<br />

to the undersigned Governor Michael F. Easley and placed before and approved by the Council <strong>of</strong> State on July 11, 2006; and<br />

WHEREAS, N.C.G.S. § 141-5 further requires that the Governor issue a Proclamation declaring the reported and approved<br />

survey line to be the true boundary <strong>of</strong> the State <strong>of</strong> North Carolina.<br />

NOW, THEREFORE, by the power vested in me as Governor by the Constitution and laws <strong>of</strong> the State <strong>of</strong> North Carolina,<br />

IT IS ORDERED:<br />

(1) That, pursuant to the provisions <strong>of</strong> N.C.G.S. § 141-5, the true boundary line between the State <strong>of</strong> North Carolina and<br />

the State <strong>of</strong> South Carolina along the county <strong>of</strong> Jackson and a portion <strong>of</strong> the county <strong>of</strong> Transylvania is hereby<br />

declared, by PROCLAMATION, to be the surveyed line represented on the attached plat <strong>of</strong> the completed survey<br />

captioned as North Carolina/South Carolina State Boundary from Indian Camp Boundary to the Chattooga River,<br />

dated May 2005, and which is described by a monument located at Latitude 35° 05' 07.96294" North, Longitude<br />

082° 47' 01 .49862" West (North American Datum 1983-86 "NAD 83-86"), and marked by the "●" inside a triangle<br />

on a brass disk stamped with "BLACKBURN, 1996, NORTH CAROLINA, SOUTH CAROLINA, STATE<br />

BOUNDARY LINE" and set in a concrete monument; thence from said point following a geodetic line to a<br />

monument located at Latitude 35° 00' 04.88130" North and Longitude 083° 06' 30.84455" West, NAD 83-86,<br />

marked by the "┼" in the inscription "LAT 35, AD 1813, <strong>NC</strong> ┼ SC" chiseled on Commissioners' Rock on the east<br />

bank <strong>of</strong> the Chattooga River; thence following a geodetic line with a geodetic azimuth <strong>of</strong> 270 degrees to the<br />

centerline <strong>of</strong> the Chattooga River.<br />

(2) That the North Carolina Geodetic Survey <strong>of</strong> the Department <strong>of</strong> Environment and Natural Resources, and the North<br />

Carolina State Property <strong>Office</strong> <strong>of</strong> the Department <strong>of</strong> Administration continue to retain and manage sufficient and<br />

necessary records <strong>of</strong> the state boundary marking and re-markings, including but not limited to this Executive Order.<br />

This Executive Order shall take effect immediately and remain in effect until rescinded.<br />

IN WITNESS WHEREOF, I have hereunto signed my name and affixed the Great Seal <strong>of</strong> the State <strong>of</strong> North Carolina at the<br />

Capitol in the City <strong>of</strong> Raleigh, this twenty-fifth day <strong>of</strong> September in the year <strong>of</strong> our Lord two thousand and six, and <strong>of</strong> the<br />

Independence <strong>of</strong> the United States <strong>of</strong> America the two hundred and thirtieth.<br />
