PROPOSED RULES<br />

A report <strong>of</strong> each examination shall be made a<br />

part <strong>of</strong> the employee's personnel file. A<br />

medical examination report shall be completed<br />

on any adopted children or relative children <strong>of</strong><br />

direct care staff residing in the maternity home<br />

within 12 months prior to the license date.<br />

The birth children <strong>of</strong> direct care staff who<br />

reside in the maternity home shall be tested for<br />

TB only if one or more <strong>of</strong> the parents tests<br />

positive for TB. There shall be documentation<br />

that adopted children or other relative children<br />

residing in the maternity home have had a TB<br />

skin test or chest x-ray prior to initial licensure<br />

unless contraindicated by a licensed medical<br />

provider. A medical examination and TB test,<br />

if required, shall be completed on any children<br />

or relative children <strong>of</strong> direct care staff who<br />

subsequently begin residing in the maternity<br />

home. Examinations shall include tests<br />

necessary to determine that the children or<br />

relative children <strong>of</strong> staff members who reside<br />

in the maternity home do not have any<br />

communicable diseases or conditions which<br />

pose risk <strong>of</strong> transmission in the facility. A<br />

medical history form shall be completed on<br />

any children or relative children <strong>of</strong> direct care<br />

staff who reside in the living unit. Medical<br />

examination reports and medical history forms<br />

<strong>of</strong> children <strong>of</strong> the residents residing the<br />

maternity home shall be maintained in the<br />

personnel file <strong>of</strong> their parent or relative.<br />

(2) Staff Development. The maternity home staff<br />

shall have a written staff development plan<br />

which provides staff training in the following<br />

areas:<br />

children;<br />

parenting preparation classes;<br />

stages <strong>of</strong> growth in infants;<br />

day-to-day care <strong>of</strong> infants;<br />

disciplinary techniques for infants,<br />

children and adolescents;<br />

education planning;<br />

job seeking skills;<br />

locating housing;<br />

money management;<br />

food management;<br />

child care;<br />

health education;<br />

stress management;<br />

life skills;<br />

decision making;<br />

substance abuse;<br />

pregnancy prevention;<br />

the North Carolina Sheriffs' Education and Training Standards<br />

Commission intends to amend the rule cited as 12 <strong>NC</strong>AC 10B<br />

.0601.<br />

Reason for Proposed Action: This Rule sets out the basic<br />

training requirements for the Detention <strong>Office</strong>r Certification<br />

Course. The purpose <strong>of</strong> the proposed amended rule is the<br />

adjustment <strong>of</strong> hours in some topical areas to better address<br />

curriculum. Total hours remain unchanged.<br />

Procedure by which a person can object to the agency on a<br />

proposed rule: Objections shall be submitted in writing<br />

explaining the reasons for objection and specifying the portion<br />

<strong>of</strong> the rule to which the objection is being made. Such objection<br />

Procedure for Subjecting a Proposed Rule to Legislative<br />

Review: If an objection is not resolved prior to the adoption <strong>of</strong><br />

the rule, a person may also submit written objections to the<br />

Rules Review Commission after the adoption <strong>of</strong> the Rule. If the<br />

Rules Review Commission receives written and signed<br />

objections after the adoption <strong>of</strong> the Rule in accordance with G.S.<br />

150B-21.3(b2) from 10 or more persons clearly requesting<br />

review by the legislature and the Rules Review Commission<br />

approves the rule, the rule will become effective as provided in<br />

G.S. 150B-21.3(b1). The Commission will receive written<br />

objections until 5:00 p.m. on the day following the day the<br />

Commission approves the rule. The Commission will receive<br />

those objections by mail, delivery service, hand delivery, or<br />
