เงื่อนไขบริการ (Term & Conditions) 

1. อัตราค่าบริการยังไม่รวมภาษีมูลค่าเพิ่ม 7% (Prices do not include VAT 7%) 

2. หากแต่ละเดือนลูกค้าใช้งานไม่ครบตามจ านวนข้อความ ลูกค้าไม่สามารถโอนจ านวนข้อความที่เหลือไปใช้ในเดือนถัดไปได้ (If customers do not use all their message allowance 

in each month, the unused message allowance cannot be carried over into subsequent months.) 

3. ในแต่ละเดือน หากใช้งานเกินจ านวนข้อความที่สมัคร บริษัทฯ คิดค่าบริการส่วนเกินตามการใช้งานจริง (If customers exceed their included monthly message allowance, the 

excess messages will be charged.) 

4. ลูกค้าไม่สามารถระงับใช้บริการชั่วคราวได้ (Temporary suspension of service will not be allowed.) 

5. ลูกค้าต้องใช้บริการอย่างน้อยเป็นระยะเวลา 3 เดือน หากยกเลิกก่อนก าหนด ลูกค้าต้องเสียค่าปรับเท่ากับค่ารายเดือน 1 เดือน โดยยังไม่รวมภาษีมูลค่าเพิ่ม 7%(Customers are 

required to stay with this contract for at least 3 months. A penalty fee equivalent to one month service will be applied for any prior cancellation of less than the 

minimum 3 months.)

6.) เงื่อนไขและกฏระเบียบทั่วไป (General Rules and Regulations) 

(1) สมาชิกภาพและรหัสสมาชิกนี้สมาชิกไม่สามารถโอนหรือให้บุคคลใดใช้ และไม่สามารถแลกเป็นเงินหรือสิ่งอื่น (Member is not permitted to transfer, or allow any person to 

use, the Membership and User-ID hereunder, and cannot have them converted to cash or otherwise.) 

(2) สมาชิกภาพรายเดือนส าหรับแต่ละเดือนถัดไปจะมีผลใช้บังคับอัตโนมัติเว้นแต่จะมีการเพิกถอนหรือยกเลิกตามใบสมัครนี้ (Monthly Membership for each subsequent month 

shall be automatically effective unless it is cancelled or terminated hereunder.) 

(3) ผู้สมัครอาจบอกเลิกการเป็นสมาชิกเมื่อใดก็ได้ และสมาชิกภาพจะสิ้นสุดทันที ณ วันสุดท้ายของเดือนสมาชิกภาพที่บริษัทฯได้รับหนังสือบอกเลิกล่วงหน้าอย่างน้อย 10 วันก่อนวัน 

สุดท้ายของเดือนสมาชิกภาพนั้นและก่อนวันแจ้งหนี้ของเดือนสมาชิกภาพถัดไป (Applicant may terminate the Membership at any time and the Membership shall cease effect 

immediately at the end of the Membership Month, in which Company shall have received the written notice of termination in advance at least 10 days prior to the end 

of such Membership Month and to the date of the invoice for the following Membership Month.) 

(4) สมาชิกอาจขอเปลี่ยนแปลงประเภทสมาชิกเมื่อใดก็ได้โดยแจ้งให้บริษัทฯทราบเป็นลายลักษณ์อักษรและจ่ายส่วนต่างของค่าสมัครสมาชิกซึ่งการเปลี่ยนแปลงประเภทสมาชิกจะมีผล 

ในรอบบัญชีถัดไป (Member may change the type of his/her Membership at any time by notifying Company in writing of such change and paying the difference in 

Application Fee, upon which the change shall be effective as of the following billing cycle.) 

(5) ในทุกกรณีค่าสมัครสมาชิกไม่สามารถเรียกคืนได้เว้นแต่บริษัทฯไม่อนุมัติรับใบสมัครนี้ (In all cases, Application Fee is non-refundable unless Company rejects this 

Application.) 

(6) สมาชิกต้องช าระค่าสมาชิกภาพรายเดือนเป็นการล่วงหน้า ค่าบริการเพิ่มเติม และค่าใช้จ่าย (หากมี) ให้แก่บริษัทฯภายในก าหนดเวลาตามใบแจ้งหนี้จนกว่าสมาชิกภาพจะสิ้นสุด 

ตามใบสมัครนี้ บรรดาหนี้เงินที่ค้างช าระแก่บริษัทฯ จะคิดดอกเบี้ย 15 % ต่อปี (Member shall pay to the Company in advance within a period specified in the invoice the 

Monthly Membership Fee, Extra-Charge and, if any, the expenses until the Membership ceases effect pursuant hereto. All overdue payments to the Company shall 

bear the interest at 15% per annum.) 

(7) การใช้สิทธิประโยชน์ของสมาชิกที่บริษัทฯบันทึกไว้ให้ถือเป็นที่สุดและใช้ในการค านวณค่าบริการเพิ่มเติม (Company's record on Member's use of the privileges is final and 

conclusive evidence for calculation of the Extra-Charge.) 

(8) บรรดาสิทธิประโยชน์ที่จัดให้ไม่สามารถโอนหรือเปลี่ยนเป็นเงินหรือทรัพย์สินใดได้และสิ้นผลทันทีในวันสุดท้ายของการเป็นสมาชิกภาพ(All privileges provided herein in any 

month are not transferable nor changeable into cash or otherwise, and shall cease effect immediately on the last day of following membership.) 

(9) สมาชิกภาพจะเริ่มมีผลใช้บังคับและการให้บริการการเป็นสมาชิกของบริษัทฯถือว่าแล้วเสร็จนับตั้งแต่วันเริ่มสมาชิกภาพที่ต้องการหรือตั้งแต่วันที่ผู้สมัครได้รับรหัสสมาชิกและ 

รหัสผ่านที่บริษัทฯออกให้หากได้รับภายหลังวันเริ่มสมาชิกภาพที่ต้องการ (Membership shall take effect and the Company's membership services shall be deemed fully 

rendered as of the Preferred Membership Date or upon the Applicant receiving User-ID and Password authorized by the Company in the event he/she receives them 

after Preferred Membership Date.) 

(10) สมาชิกต้องใช้ความระมัดระวัง ก ากับดูแล และต้องไม่ใช้ระบบเครือข่ายอินเตอร์เน็ตตามสัญญานี้ ไปในทางที่ก่อให้เกิดการล่วงละเมิดสิทธิของบุคคลอื่น ไม่ว่าบุคคลอื่นนั้นจะใช้ 

ระบบความปลอดภัยของแฟ้มข้อมูลป้องกันหรือไม่ก็ตาม และสมาชิกจะต้องไม่เผยแพร่ข้อมูล ภาพ ข้อมูลหรือภาพของบุคคลอื่นกระจายออกไปในวงกว้างโดยมิได้รับอนุญาตจากผู้ 

เป็นเจ้าของ หากการกระท าใดๆ ของสมาชิกก่อให้เกิดความเสียหายต่อบุคคลอื่น สมาชิกต้องรับผิดชอบแต่เพียงฝ่ายเดียว (Membership shall use reasonable care in the 

supervision and utilization of the Internet Access Services and shall not use such Service in such a way as stated to violate the other's rights, regardless of whether 

such other person employs security measure with respect to its database and Membership shall not publish the data or picture of other person without his/her 

permission. If any act of membership causes the loss or damages to the third party, the membership shall be solely responsible for such loss and damages.) 

(11) สมาชิกต้องไม่รับ-ส่งข้อความ ข้อมูล ภาพ หรือรหัสสัญญาณใดๆ ที่เป็นการขัดต่อกฎหมาย หรือเป็นการขัดต่อมติคณะรัฐมนตรี นโยบาย กฎ ระเบียบ ค าสั่ง หรือประกาศ ของ 

การสื่อสารแห่งประเทศไทย หรือที่ทางราชการก าหนด หรือเป็นการขัดต่อความสงบเรียบร้อยและศีลธรรมอันดีของประชาชน หรือเป็นภัยต่อความมั่นคงของประเทศชาติ 

(Membership shall not transmit, receive any statements, data, picture or code which are contrary to the laws or the resolutions of the Council of Ministers or 

policies, rules, regulations, orders or notifications of the Communications Authority of Thailand, or official circulars which are against public order, good moral and the 

peace and security of the nation.) 

(12) สมาชิกจะต้องไม่น าระบบเครือข่ายอินเตอร์เน็ตตามสัญญานี้ ไปใช้ในทางธุรกิจการค้า หรือในเชิงพาณิชย์ใดๆ ไม่ว่าจะโดยทางตรง ทางอ้อม หรือให้บริการต่อ (Resale) และไม่ว่า 

จะมีวัตถุประสงค์แสวงหาก าไรหรือไม่ก็ตาม หรือการให้บริการต่อ เช่น การน าข้อมูลไปขายต่อ การฝ่าฝืนเงื่อนไขดังกล่าวถือว่าเป็นการละเมิดเงื่อนไขการใช้บริการของบริษัท และ 

ละเมิดเงื่อนไขการใช้วงจรสื่อสารของการสื่อสารแห่งประเทศไทย ซึ่งสมาชิกจะต้องชดใช้ค่าเสียหายอันเป็นผลจากการฝ่าฝืนนั้น (Membership shall not use the Internet network 

under this Contract for "Resale", regardless of whether or not profits are made. The breach of such condition shall be deemed a breach of condition of service 

and breach of the condition for the use of the communication circuit of the Communications Authority of Thailand. Any loss or damages, as a result of such breach, 

shall be the sole responsibility of the membership.) 

(13) สมาชิกต้องใช้ความระมัดระวังและไม่กระท าการใดๆ ต่อเครือข่ายอินเตอร์เน็ตเพื่อบุกรุกระบบคอมพิวเตอร์อื่นๆ ไม่ว่าทั้งในระบบเครือข่ายของบริษัทเอง และ/หรือระบบเครือข่าย 

คอมพิวเตอร์อื่นๆ ที่สมาชิกไม่ได้รับอนุญาตให้เข้าไปใช้งาน และสมาชิกจะต้องรักษาความลับของ Password ของสมาชิกเป็นอย่างดี ไม่ให้บุคคลภายนอกน าไปใช้ (Membership 

shall use reasonable care and shall not do any act to the Internet Network in order to gain access to other computer system regardless of whether such computer 

system belong to the Company or to other person to which the membership is not permitted to access, and the membership shall keep his password strictly 

confidential so that no unauthorized person will be able to use it.) 

(14) บริษัทไม่ต้องรับผิดชอบต่อความเสียหายใดๆ อันเกิดจากระบบเคเบิ้ล หรือวงจรสื่อสารต่างๆ ช ารุดบกพร่อง ขัดข้อง หรือไม่สามารถใช้การได้ หรือ เกิดจากการที่ข้อความ ข่าวสาร 

ข้อมูล ภาพ หรือรหัสสัญญาณที่สมาชิกใช้ในการติดต่อสื่อสารเกิดความล่าช้า เสียหาย หรือสูญหาย (The Company shall not be liable for any loss or damages caused by the 

defect, malfunction or unoperationable of the cable system or communications circuit, or the network system linkage causing the delay, loss and damages to 

statements, information, data, pictures or code used by the Membership in communication.)

(15) บริษัทไม่มีหน้าที่ในการควบคุม ตรวจสอบ ป้องกัน เก็บรักษาหรือด าเนินการอื่นใด รวมตลอดทั้งไม่รับประกันในคุณภาพ ข้อมูล ภาพ เนื้อหาข่าวสารที่สมาชิกรับ-ส่งผ่านระบบ 

เครือข่ายของบริษัท และบริษัทไม่ต้องรับผิดชอบในความเสียหายต่อสมาชิกอันเนื่องมาจากความล่าช้า ผิดพลาด ขาดตกบกพร่อง หรือการขัดข้องของวงจรสื่อสาร จานแม่เหล็ก ที่ 

สมาชิกรับ-ส่งผ่านระบบเครือข่ายของบริษัทแต่อย่างใด (The control, detection, protection, storing or any other acts, including the guaranty of the quality of Information , 

data or picture transmitted through the Company's network are not the Company's duties. Also, the loss or damages resulting from the delay, mistakes, defect or 

malfunction of the communications circuit or disk drive, the Membership used by for transmission purpose through the Company's network, are not the Company's 

responsibility.) 

(16) ข้อก าหนดและเงื่อนไขในสัญญานี้ถือว่าเป็นสาระส าคัญของสัญญา ในกรณีที่สมาชิกไม่ปฏิบัติตามข้อก าหนดและเงื่อนไขในสัญญานี้ บริษัทมีสิทธิระงับการให้บริการได้ทันทีโดย 

ไม่ต้องแจ้งให้ทราบล่วงหน้า และมีสิทธิบอกเลิกสัญญานี้ได้ทันที โดยบริษัทไม่ต้องรับผิดชดใช้ค่าเสียหายใดๆให้แก่สมาชิกทั้งสิ้น (Terms and conditions stated in the Contract are 

material conditions. The breach of such terms and conditions shall result the immediate service discontinuation, without giving notice in advance, and termination of 

the Contract.) 

(17) ในกรณีที่สมาชิกไม่ปฏิบัติตามข้อก าหนดและเงื่อนไขในสัญญา เป็นเหตุให้บริษัทหรือบุคคลภายนอกได้รับความเสียหาย สมาชิกตกลงจะเป็นผู้รับผิดชอบในความเสียหายที่เกิดขึ้น 

ทั้งสิ้น (The extent that the loss or damages occur to the Company or the third party is the result of the Membership's noncompliance with the terms and conditions 

stated in the Contract, the User shall be fully responsible to such loss and damages.) 

(18) บริษัทฯไม่ต้องรับผิดชอบต่อผลหรือประโยชน์ทางการค้าจากการใช้บริการ สมาชิกรับทราบว่าบริษัทฯได้รับสิทธิจาก กสท.ในการให้บริการ ในกรณีที่สิทธิดังกล่าวถูกเพิกถอนหรือ 

ถูกยกเลิกหรือระงับไปไม่ว่าด้วยเหตุใดให้ถือว่าใบสมัครนี้ใช้บริการนี้ระงับไปโดยอัตโนมัติทันทีโดยบริษัทฯไม่ต้องรับผิดชอบใดๆบริษัทฯมีสิทธิมอบหมายและโอนบริการนี้รวมทั้งบรรดา

การช าระและเงินอื่นใดให้แก่บุคคลใดๆโดยไม่ต้องขอความยินยอมจากสมาชิกก่อนส าหรับการมอบหมายและการโอนดังกล่าวแต่ทั้งนี้บุคคลผู้รับมอบหมายหรือรับโอนนั้นจะต้องเป็นผู้ที่ 

ได้รับสิทธิในการให้บริการอินเตอร์เน็ตจาก กสท. (Company is not responsible for any commercial outcome or benefit from the use of the Services. Member acknowledges 

that Company was granted the license to provide the Services by the CAT. In case the license is revoked or terminated or expired for whatever reasons, this Service 

Application shall automatically be terminated without any liability to Company. Company has the right to assign and transfer this Service Application, including any 

and all rights and obligations hereunder, and/or Company's rights to receive any and all due or invoiced Service Fees and other payments from Member under this 

Service Application, to any person without requiring any prior consent from Member, provided that such person is the internet service provider licensed by the CAT.)
