Further, there is no necessity for any evidence relat<strong>in</strong>g <strong>to</strong> the alleged failure <strong>to</strong><br />
make disclosures on the f<strong>in</strong>ancial disclosure forms <strong>in</strong> this trial, nor is there any probative<br />
value for that evidence. The pr<strong>in</strong>cipal issue <strong>in</strong> this trial is whether the Defendant<br />
know<strong>in</strong>gly and <strong>in</strong>tentionally misappropriated the gift cards with the requisite crim<strong>in</strong>al<br />
<strong>in</strong>tent. <strong>Evidence</strong> regard<strong>in</strong>g the alleged failure <strong>to</strong> report gifts on the Defendant's f<strong>in</strong>ancial<br />
disclosure forms has absolutely no bear<strong>in</strong>g on any <strong>of</strong> those issues. Rather, the only result<br />
from the <strong>in</strong>troduction <strong>of</strong> such evidence is <strong>to</strong> confuse, mislead, and unfairly prejudice the<br />
jury. As stated above, there are several complicated prelim<strong>in</strong>ary legal and factual issues<br />
relat<strong>in</strong>g <strong>to</strong> whether the Defendant had a duty <strong>to</strong> disclose the gifts <strong>in</strong> the first <strong>in</strong>stance,<br />
which <strong>in</strong> turn requires an analysis <strong>of</strong> the City Ethics Code. Because this evidence has no<br />
bear<strong>in</strong>g on any <strong>of</strong> the issues <strong>in</strong> this case, there is no reason for the Court <strong>to</strong> go down this<br />
path.<br />
III. CONCLUSION<br />
WHEREFORE, for the forego<strong>in</strong>g reasons, Defendant respectfully requests that its<br />
motion <strong>in</strong> lim<strong>in</strong>e be granted.<br />
