This is an appeal against the judgment of Kanifing Cadi court presided over<br />

by Senior Cadi Masamba Jagne assisted by Cadi Saikou Touray, Cadi Eleman<br />

Ceesay and Bubacar Bai Touray with case No. 407 between Mustapha Dampha as<br />

a plaintiff (the respondent herein) and Kala Keita & others as defendants (the<br />

appellants herein) in the matter of differences between couples. Although the<br />

heading is vague we were able to discover from the statement the plaintiff at page<br />

1 of the record where he said:<br />

“And the reason of bringing the woman (my wife) before the Court is<br />

that, in the year 2005 I took her to the Court because of her refusal to<br />

share the bed with me and well before I divorced her”.<br />

Also in page 2 he said:<br />

“I wanted to see that the following are out of my compound”.<br />

From these two quotations we were able to realize that the dispute was about<br />

divorce and ejectment from the matrimonial house. According to the record of<br />

lower Court page1 the plaintiff / respondent claimed that the divorce took place<br />

since the year 2005 and it extended to the year 2010 and requested from the<br />

Kanifing Islamic Court to eject the divorced wife and her Children out of his<br />

compound as stated in page 2 of the record of proceedings where he said:<br />

“So in my capacity as the father and owner of the compound I want<br />

to see that the following are out of my compound:<br />

1. Divorced wife<br />

2. Bakary Dampha.<br />

3. Ansumana Dampha<br />

4. Kaddy Dampha<br />

And he supported his claim by one witness Called Kebba Manneh who said:
