NOTICE OF DISMISSAL WITHOUT PREJUDICE
Plaintiffs filed this action on August 2, 2012, to challenge certain provisions of
the Stop Trading on Congressional Knowledge (“STOCK”) Act, Pub. L. No. 112-105,
126 Stat. 291 (2012), which required the personal financial information of some 28,000
Executive Branch employees, including both civilian and military personnel, to be posted
on the Internet by August 31, 2012, for anyone in the world to see. Plaintiffs alleged that
the challenged provisions violated their constitutional right to informational privacy.
After this Court issued a Temporary Preliminary Injunction, and Congress thrice
postponed the deadline for Internet publication, Congress last week enacted, and the
President on April 15, 2013, signed, legislation providing that the challenged provisions
“shall not be effective” except as to the President, the Vice President, Members of and
candidates for Congress, and certain cabinet and subcabinet level officials. See An Act
To modify the requirements under the STOCK Act regarding online access to financial
disclosure statements and related forms, S. 716 (113th Cong., 1st Sess. (2013)). Plaintiffs

understand that Congress was well aware of this lawsuit and that this Court’s opinions in
this case were influential in arriving at the new legislation.
Accordingly, Plaintiffs having fully achieved their goals in this litigation, and
Defendants not having filed an answer or a motion for summary judgment, Plaintiffs
hereby voluntarily dismiss this action, without prejudice, pursuant to Fed. R. Civ. P.
41(a)(1)(A)(i).
