NOTICE OF DISMISSAL WITHOUT PREJUDICE<br />
Plaintiffs filed this action on August 2, 2012, to challenge certain provisions <strong>of</strong><br />
the Stop Trading on Congressional Knowledge (“STOCK”) Act, Pub. L. No. 112-105,<br />
126 Stat. 291 (2012), which required the personal financial information <strong>of</strong> some 28,000<br />
Executive Branch employees, including both civilian and military personnel, to be posted<br />
on the Internet by August 31, 2012, for anyone in the world to see. Plaintiffs alleged that<br />
the challenged provisions violated their constitutional right to informational privacy.<br />
After this Court issued a Temporary Preliminary Injunction, and Congress thrice<br />
postponed the deadline for Internet publication, Congress last week enacted, and the<br />
President on April 15, 2013, signed, legislation providing that the challenged provisions<br />
“shall not be effective” except as to the President, the Vice President, Members <strong>of</strong> and<br />
candidates for Congress, and certain cabinet and subcabinet level <strong>of</strong>ficials. See An Act<br />
To modify the requirements under the STOCK Act regarding online access to financial<br />
disclosure statements and related forms, S. 716 (113th Cong., 1st Sess. (2013)). Plaintiffs

understand that Congress was well aware <strong>of</strong> this lawsuit and that this Court’s opinions in<br />
this case were influential in arriving at the new legislation.<br />
Accordingly, Plaintiffs having fully achieved their goals in this litigation, and<br />
Defendants not having filed an answer or a motion for summary judgment, Plaintiffs<br />
hereby voluntarily dismiss this action, without prejudice, pursuant to Fed. R. Civ. P.<br />
41(a)(1)(A)(i).<br />
