2 – Consultation Activities Since 11 March 2010 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Further information sharing by email and by telephone between the KNC and BC Hydro occurred between April 15 and April 21, 2010. This included the sharing of updated maps, and discussions around Project benefits, impact management and procurement opportunities. On April 21, 2010, BC Hydro sent a letter to the KNC and its member First Nations and enclosed a copy of BCTC’s Toby Creek Diversion Supplement that had been filed with the BCUC on April 20, 2010. The KNC had underlined the importance of avoidance of the goat habitat at Toby Creek as a very significant environmental issue related to the Project. Also on April 21, 2010, by email, BC Hydro provided to the KNC written responses to the concerns that the KNC had raised with regard to the Environmental Overview Assessment (EOA). KNC’s concerns are expressed in documents dated January 5, January 12 and January 20, 2010 in BCTC’s response to BCUC IR 1.51.1. Three additional individual concerns which were provided by email on or before April 29, 2010. A copy of BC Hydro’s responses (three documents) can be found in Appendix A to this Supplement. BC Hydro understands that KNC is reviewing the responses and BC Hydro expects further discussions with KNC on some of the issues. On April 30, 2010, the KNC provided BC Hydro/BCTC with the first of three reports regarding their Aboriginal Use and Interest Study (Robertson, 2010) (the AUIS) for the Project area. No new Project specific issues were raised in this report. A copy of the Robertson report is attached. The KNC indicated that they had hoped to provide all three of their AUIS reports to BC Hydro in advance of this supplemental filing for BC Hydro’s consideration but they were only able to deliver the one report. BC Hydro understands that the other two reports will be filed by the KNC as part of its proposed evidentiary filing in this proceeding. 2 – Consultation Activities Since 11 March 2010 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 On May 3, 2010, BC Hydro met with the KNC in Cranbrook to continue consultation and negotiations regarding benefits, impact management and procurement and the related agreements. On May 6, 2010, BC Hydro and BCTC met with the KNC and the Ministry of Environment (MoE) in Fairmont Hot Springs to discuss the KNC’s concerns regarding access management on the proposed CVT project right‐of‐way. BC Hydro, BCTC and KNC will continue to discuss benefit, impact management and procurement opportunities and are working towards appropriate agreements as soon as reasonably possible. The next meeting between BC Hydro, BCTC and the KNC is scheduled for May 14, 2010 to continue those discussions and to continue to share AUIS and other Project information. BC Hydro and NDC continue discussions regarding the specialty forestry work which is scheduled to begin in the summer of 2010, and the clearing and road access work. Copies of the various letters and other materials sent to and received from the KNC are included in Appendix A. 2.2 Shuswap Indian Band (SIB) On March 16, 2010, BC Hydro delivered signed copies of the Benefits Agreement and the Contracting Agreement to the SIB. These agreements were previously filed in confidence with the BCUC. On April 1, 2010, BC Hydro provided the SIB with a letter and enclosed a copy of BCUC Commission Order G‐54‐10 which laid out the regulatory timetable for the Project, and highlighted the fact that there was to be a community input session on April 15, 2010 in Invermere. A copy of that letter and order was also faxed to the SIB that same day. On April 21, 2010, BC Hydro sent a letter to the SIB and enclosed a copy of BCTC’s Toby Creek Diversion Supplement that was filed with the BCUC on April 20, 2010.
