2.1 Ktunaxa Nation Council (KNC)
Since March 12, 2010, BC Hydro and the KNC have participated in a series of meetings,
negotiations and other discussions (in person, written and electronic). During this
period, the consultation has focused on further Project and process information sharing,
benefits, impact management, and procurement opportunities. Drafts of agreements
have been exchanged, as well as proposals and counter‐proposals. The KNC has
designated its wholly owned development company, Nupqu Development Corporation
(NDC), as the entity to receive procurement opportunities related to the Project.
On March 12, 2010, the KNC provided BC Hydro with a copy of the KNC’s letter to the
Commission applying for Intervenor status on the Project.
On April 1, 2010, BC Hydro provided the KNC and its member Bands with a letter
enclosing a copy of BCUC Commission Order G‐54‐10 which laid out the regulatory
timetable for the Project, and highlighted the fact that there was to be a community
input session on April 15, 2010 in Invermere. A copy of that letter and order was also
faxed to the KNC and each of its member First Nations that same day.
On April 8, 2010, BC Hydro met with the KNC and NDC in Cranbrook to further discuss
procurement opportunities, the Archaeological Impact Assessment (AIA) and other
archaeology issues. The KNC informed BC Hydro that they would be requesting an
extension on providing their written evidence.
On April 9, 2010, BC Hydro provided a revised copy of the terms of reference for the AIA
work, and on April 15, 2010, the KNC advised BC Hydro that the KNC was satisfied with
those terms of reference.
Also on April 9, 2010, the KNC provided BC Hydro with an invoice for services related to
the CVT Project. On April 20, 2010, BC Hydro paid that invoice and also provided an
additional nominal advance for future work related to the Project.
