Utilities Commission. 12 13 14 15 16 17 18 19 20 21 22 23 3.4 Haida Spectrum 3.4.1 KNC BC Hydro is of the view that the level of consultation in respect of the KNC and its members is probably in the medium to high range of the Haida spectrum. BC Hydro’s view is based on its preliminary assessment that (1) the claims of the KNC member First Nations are reasonable and (2) the Project impacts on asserted Aboriginal rights are likely to be, on balance, low to medium. 3.4.2 SIB BC Hydro is of the view that the level of consultation in respect of the SIB is probably in the medium to high range of the Haida spectrum based on BC Hydro’s preliminary assessment that (1) the claims of the SIB are reasonable and (2) the Project impacts on asserted Aboriginal rights are likely to be, on balance, low to medium. 3 – Consultation Assessment 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 3.4.3 Other SNTC Members In respect of the other First Nations who are members of the SNTC, BC Hydro is of the view that the level of consultation is, at the most, at the low end of the Haida spectrum. This view is informed by BC Hydro’s preliminary assessment that the Project area is located a significant distance from many of these First Nations. In addition, many of the members of the SNTC have deferred to the SIB in consultation with BC Hydro in respect of the Project, which supports BC Hydro’s view that these First Nations have much less interest in the Project area than the SIB. 3.4.4 SALD In the specific context of SALD, BC Hydro is of the view that the consultation obligation is at the low of the spectrum. SALD has claimed a very large area and, until very recently, had deferred to the SIB’s leadership role in consultation. The information BC Hydro has reviewed indicates that the SIB has a much stronger claim to the Project area. 3.5 Adequacy of Consultation All First Nations identified by BC Hydro have received notice of the Project and other Project information, access to funding, a copy of the Application and related materials, and information regarding the BCUC Application hearing process. 3.5.1 KNC BC Hydro has engaged in extensive consultation in good faith with the KNC and is continuing to do so. BC Hydro acknowledges that the KNC has also engaged in the consultation in good faith, has raised issues of importance to the KNC and its member First Nations, and has participated in good faith negotiations regarding benefits, impact management and procurement opportunities. In specific response to the KNC’s concerns, BCTC has changed the transmission line route (Toby Creek diversion) and has committed to avoid riparian habitat as much as possible.
