36 Wednesday, 27th, March 2013 NOTICE NO. 82 NOTICE MADE BY THE GOVERNOR PURSUANT TO ARTICLES 41, 152 and 155 OF THE AIR NAVIGATION (OVERSEAS TERRITORIES) ORDER 2007. OTAR Part 66: Aircraft Maintenance Personnel Licensing; OTAR Part 67: Medical Standards and Recognition of Medical Examiners; OTAR Part 77: Activities Affecting Airspace; (a) (b) (c) (d) (e) This Notice is given pursuant to articles 41, 152 and 155 of the Air Navigation (Overseas Territories) Order 2007, as amended ("the Order"). Article 41 provides for the Governor to give instructions in respect of the operation and safety of aircraft and the safety of persons and property carried therein and in respect of the instruments and equipment to be installed therein or carried thereon. Article 152 provides for the Governor to publish requirements which he considers relevant to determining his satisfaction in respect of certain matters before granting a certificate, licence or other document issued under the provisions of the Order. Article 155 provides, inter alia, for the Governor to issue such instructions as are necessary, requisite or expedient for carrying out the Chicago Convention and implementing any Annex thereto and any amendment to the Convention, or any such Annex made in accordance with the Convention, or generally for regulating and securing the safety of international air navigation. TITLE IMPORT & EXPORT 76 of 2012 Magistrates Court (Appointment of Place for Sitting) Order 2012 77 of 2012 Customs Duties and Consumption Tax (Motor Vehicle) (Exemption) Order 2012 78 of 2012 Eastern Caribbean Supreme Court Civil Procedure (Amendment) Rules 2012 79 of 2012 Tax Information Exchange Agreement (Federal Republic of Germany) Order 2012 80 of 2012 Customs Duties and Consumption Tax (Kenneth Greenaway) (Exemption) Order 2012 1 of 2013 Registration of Births and Deaths (Amendment of Fees) Order 2013 Designates the Training Room at HRMU situated at Government Headquarters as the place for the sitting of the Court. The court shall sit from 9:00 o’clock in the forenoon to 4:00 o’clock in the afternoon (or such later hours as may be required in any particular case) of every weekday. Exempts Herman Francis the winner of the 2012 Montserrat Festival Calypso competition; and Justin Cassell the winner of the most Montserrat Festival Calypso competitions between 1962-2012, from the payment of customs duty and consumption tax on the importation of one motor vehicle. Amends for the time being the Rules in the Schedule to the Eastern Caribbean Supreme Court Civil Procedure Rules 2000, which govern civil procedure in the Eastern Caribbean Supreme Court. Designates the 1 st day of February as the date when the Eastern Caribbean Supreme Court Civil Procedure (Amendment) Rules 2012 shall come into force. Tax Agreement between the Government of Montserrat (as authorized by the Government of the United Kingdom of Great Britain and Northern Ireland) and the Government of Germany concerning the exchange of information on taxation matters, set out in the schedule, has the force of law in Montserrat. Amends part A of the Schedule to the tax information Act (No.21 of 2010). Exempts Kenneth Greenaway from the payment of Customs Duties and Consumption Tax in the amount of $28,913.51 on the importation of specific items, subject to the payment of (a) a processing fee (b) specified customs duties and consumption tax. Replaces Schedule B of the Registration of Births and Deaths Act. Sets 1 st April 2013 as the date when the Act comes into force. 2 of 2013 Marriage (Fees) Order 2013 Specifies the fees to be paid for the performance of duties and services to which they relate under the Marriage (Fees) Act. Sets 1 st April 2013 as the date when the Act comes into force. Repeals the Marriage Act (Fees) Order 1993 (S.R.O. 7 of 1993). 3 of 2013 Bills Of Sale (Payment of Fees) Order 2013 Specifies the fees to be paid and received in stamps under the Act. Sets 1 st April 2013 as the date when the Act comes into force. Repeals the Payment of Fees Order 1985 (SRO 31 of 1985).
