1. CALL TO ORDER - Pursuant to notice duly given and posted, a meeting of the SIPE Board of Directors<br />

was called to order by SIPE Board President Sharon Henslin at 8:46 a.m., April 24, 2009, at the Schools Insurance<br />

Program for Employees office, Atascadero, CA.<br />

2. COMMENTS FROM THE PUBLIC ON ITEMS NOT ON THE AGENDA – There were none.<br />

3. BRAGG & ASSOCIATES WORKERS’ COMPENSATION ADMINISTRATION –Branch Manager<br />

Lynn Cavalcanti reported that as of March 31, 2009, there were 21 new claims, 18 claims closed, 105 future medical<br />

claims, 127 indemnity claims, and 29 medical only claims. She reported that Bragg provided a five-year workers’<br />

compensation claims summary at the countywide workshop in March 2009. She reported that as of June 30, 2008,<br />

temporary disability and claim expenses had decreased during last five years. She stated that she estimates that<br />

temporary disability will remain the same as last year. She reported that before 2004, an open indemnity claim took<br />

about four years to settle and that indemnity claims are now taking a little over a year to settle. She reported that simple<br />

medical only files were taking over a year and now are closing within months. She complemented the districts for<br />

reporting the claims on time and stated that the internal process at the district level has greatly improved. She reported<br />

that the recent file review revealed that some districts need clarification regarding what to pay within the first 60 days<br />

of a workers’ compensation claim under the Education Code. She reported that she would bring information regarding<br />

declination of medical treatment to the next meeting. She requested to schedule the workers’ compensation training<br />

for clerks in August 2009.<br />

4. APPROVE SECOND INTERIM FINANCIAL REPORT FY 2008-2009 – The Board approved the FY<br />

Second Interim Financial report FY 2008-2009. (<strong>Martin</strong>/Hoskins) (9/0).<br />

5. APPROVE FEBRUARY 27, 2009, MEETING MINUTES – The Board approved the February 27, 2009,<br />

meeting minutes as presented. (Stark/Newlon) (9/0).<br />

6. APPROVE THREE PERCENT REBATE FOR DISTRICT: SAN LUIS COUNTY OFFICE OF<br />

EDUCATION –Garth Maijala recommended ninety percent of San Luis Obispo County Office of Education’s three<br />

percent workers’ compensation premium rebate from FY 07-08. The Board awarded the San Luis Obispo County<br />

Office of Education ninety percent of the three percent workers’ compensation rebate. (Stark/Newlon). (9/0).<br />

7. THREE PERCENT REBATE ADJUSTMENT DUE TO DECLINING PREMIUMS – No action<br />

was taken. Executive Director Mike McGuire was directed to bring back options to the Board at the next meeting.<br />

8. DISCUSS POSSIBLE WORKERS’ COMPENSATION PREMIUM REDUCTION FOR MEMBER<br />

DISTRICTS– Executive Director Mike McGuire reported that recommendations for reductions in premiums for<br />

member districts would be presented by Broker Alliant, as well as recommendations for an excess workers’<br />

compensation insurance carrier.<br />

9. COST OF LIVING ADJUSTMENT FOR SIPE STAFF FY 2008-2009 – The Board approved a three<br />

percent cost of living adjustment for SIPE staff, no changes to the health and welfare cap, and retroactive to July 1,<br />

2008. (5/3). It was the consensus of the Board to bring the SIPE staff salary schedules back to the next meeting for a<br />

closed session discussion/action item.<br />

10. HEALTH AND SAFETY DEPARTMENT - Executive Director Mike McGuire reported that the<br />

countywide workshop was well attended and accepted. He recommended a barbeque at either Rancho El Chorro<br />

Outdoor School or the new community school next fiscal year. He explained that the Worksteps program is not a<br />

medical exam. However, it tests for physical ability to perform a certain job requirement. Garth Maijala reported that a<br />

brochure regarding the SIPE online training would be mailed to school districts in California. He reported that SIPE<br />

funding program applications and funding requirements are now available online to assist districts with applying for<br />

SIPE funding and tracking their safety committee expenditures. Mike McGuire reported that he is monitoring<br />

problems with Bragg and Associates/WellComp.<br />

11. REPORTS FROM <strong>BOARD</strong> <strong>MEMBERS</strong>/OTHERS – Christin Newlon reported that the final personnel<br />

leadership workshop on ADA and leave of absences issues is appropriate for management and perspective<br />

management employees. She stated she would forward the workshop information to Cheryl Lunsford to disperse to<br />

board members.<br />

12. ADJOURNMENT – Motion was made and passed to adjourn at 10:00 a.m. (Stark/<strong>Martin</strong>) (9/0).<br />
